About this file

This document is a Memorandum for Record that describes the Contracting Officer's decision to solicit and award a single source contract for recruiting and advertising services to the Alaska School Activities Association, Inc. (ASAA) through their exclusive media and sponsorship partner, Teall Properties Group LLC (TPG).

The 176th Contracting Element at Joint Base Elmendorf-Richardson, Alaska intends to award a sole source purchase order to TPG to provide recruiting and advertising services that showcase and promote the Air National Guard at state-wide high school STEM and athletic activities in Alaska. The sole source award is justified under FAR 13.106-1(b)(1)(i) due to ASAA's exclusive rights and capabilities as the centralized, nonprofit organization recognized by Alaska state regulations to administer and promote high school activities. Market research found TPG, in cooperation with ASAA, is the only contractor capable of meeting the requirements. The anticipated cost does not exceed the simplified acquisition threshold.

DEPARTMENT OF THE AIR FORCE

176TH CONTRACTING ELEMENT

JOINT BASE ELMENDORF-RICHARDSON, ALASKA

11 September 2024

MEMORANDUM FOR RECORD

SUBJECT: W50S6L-24-Q-0004 (176 WG Recruiting and Advertising Services), Determination to Solicit/Award to a Single Source

1. The purpose of this memorandum is to document the Contracting Officer’s decision to solicit, and subsequently award to a single source.

2. IAW FAR 13.106-1(b)(1)(i), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

3. The 176 WG requires recruiting and advertising services which showcase and promote the Air National Guard at all state-wide high school STEM and athletic activities. Services include standing up recruiting booths, displaying banners, running advertisements, and conducting PA announcements across the various events.

4. Market research has been conducted to identify potential sources capable of satisfying the requirement. The findings of the research indicate that the Alaska School Activities Association, Inc. (ASAA) is the sole, exclusive source capable of providing the required services. Since its founding in 1957 by the Territorial Department of Education Superintendents Advisory Commission, ASAA has been responsible for establishing common rules and regulations to guide all high school activities for the state of Alaska. The State of Alaska’s education regulations, specifically 4 AAC 06.115, outline the governance of interscholastic activities. These regulations recognize the necessity of a centralized, nonprofit association and lists ASAA by name to administer and promote these activities effectively, economically, and fairly. Further, ASAA is a non-profit organization and has an exclusive partnership with Teall Properties Group LLC (TPG) to manage their multi-media and sponsorship rights. Prior to reaching this conclusion on 24 July 2024 a sources sought was issued on sam.gov by the Contracting Officer with a close date of 05 August 2024. The CO received 15 responses, indicating that there are many sources capable of providing marketing services, however this was prior to the CO’s knowledge of the State of Alaska regulatory requirement for a non-profit organization to govern interscholastic activities.

5. The anticipated cost for the required services do not exceed the simplified acquisition threshold, making the use of simplified acquisition procedures appropriate and cost-effective.

6. Based on the above considerations, it is determined that a single source award to Teall Properties Group LLC is justified under FAR 13.106-1(b)(1)(i) due to their exclusive rights and capabilities which deem only one source reasonably available and capable of satisfying the agency's requirements.
