FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: Mission and Installation Contracting Command (MICC) Center- Fort Bragg, North Carolina.
2. Description of Action: Directorate of Public Works (DPW) requests a firm-fixed-price, new contract for one each (1) excavator with long reach capability (40’ minimum) and 1-
2.5 yard bucket including all labor, equipment and transportation needed for delivery and return. The contractor will provide on call maintenance and repair for the excavator at the site of use. Site of delivery, use, and pick up for return will be at Fort Bragg on Sicily Drop Zone off of Manchester Road, Hoke County, NC. The Government projects award for 2 July 2020 and fiscal year 2020, Operations and Maintenance, funds will be used.
3. Description of Supplies/Services: The Mission and Installation Contracting Command Center- Fort Bragg (MICC Center-FB) has an urgent need to rent one (1) each excavator with long reach capability (40’ minimum) and 1-2.5 yard bucket including all labor, equipment and transportation needed for delivery and return. The contractor will provide on call maintenance and repair for the excavator at the site of use. Site of delivery, use, and pick up for return will be at Fort Bragg on Sicily Drop Zone off of Manchester Road, Hoke County, NC. for the Directorate of Public Works (DPW) to support troop construction at Sicily Drop Zone’s 24 hour construction project to begin on or about 8 July 2020.
The Sicily Drop Zone landing strip is being repaired and constructed culverts requiring the need for a long-reach excavator. The Troop construction will begin 24-hour real time construction at Sicily beginning on or about 8 July 2020.
4. Authority Cited: 10 U.S.C. 2304(c)(2), as implemented by FAR 6.302-2, Unusual and compelling urgency.
5. Reason for Authority Cited:
Constraints – The request came to our office on 22 May 2019 as a regular rental service procurement. Workload assignment was initially assigned to a new contract specialist and was going to be used as a teaching requirement. However, the 20th
Engineer Brigade, 82nd Airborne Division were initially okay with the original timelines.
But during the course of June the requirement changed and the 20th Engineer Brigade command decided that this project was to go to a 24 hour operation to ensure that the landing strip was repaired by late September 2020; as the 20th Engineer Brigade was being tasked to do other construction projects beginning October 2020. The excavator plays an important part of this requirement as it is needed to build culverts on the landing strip, and all efforts need to be made to avoid any possible interruption of critical construction services supporting the 20th Engineer Brigade’s mission.
Further, during our market research and several calls to several small business vendors found on the Dynamic Small Business Search (DSBS) Quick Market Search website.
