FAR Part 6 Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: Regional Health Contracting Office – Central, Fort Carson Health Contracting Cell, 1681 Specker Ave. Bldg. 1011, Fort Carson, CO 80913

2. Description of Action: The Department of Logistics at Evans Army Community Hospital (EACH) requests a firm-fixed-price follow-on contract to with . The Government projects award for August 2020 and fiscal year 2020, DHP funds will be used.

This action is a follow-on to contract . That contract was not competed under authority 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements: 10 U.S.C. 2304(c)(1).

Paragraph, “Actions to Increase Competition” of the previous justification, stated:

As technology becomes available, research will be performed to consider other products that may meet or exceed the current requirements at EACH. However, until then, as long as the STERIS equipment is being used at EACH, Steris will be the only vendor that can service the equipment. The previous sole source justification and approval can be found in PCF.

3. Description of Supplies/Services:

The requirement is for maintenance and repair services of Steris manufactured medical equipment for the Sterile Processing Department, Dental Clinics, and Veterinarian Clinics located at EACH. Ensuring properly sanitized medical instruments are in serviceable condition, and maintained according to OEM standards. 5. Reason for Authority Cited: Steris Corporation is the authorized supplier of parts and services for Steris equipment. The equipment located at EACH is proprietary and Steris has to perform maintenance services to ensure warranty provisions are not voided. A Dynamic Small Business Search (DSBS) under NAICS 811219 and using keywords “steris maintenance”, revealed zero (0) small business. Failure to procure a follow-on for this requirement will result in a break in service and adversely impact hospital and patient care.

6. Efforts to Obtain Competition: Market research was completed to include a sources sought notice that was posted to beta.SAM.gov from 5 to 11 May 2020. The results of the sources sought can be found in paragraph 10. The Contracting Officer shall publish the notices required by FAR 5.201.

a. Effective Competition: Because this is a sole source action, effective competition is not applicable.

b. Subcontracting Competition: IAW FAR 19.702(b)(1), a subcontracting plan is not required for small business concerns.

7. Actions to Increase Competition: Competition may remain limited until the Steris equipment becomes obsolete or is no longer utilized at EACH. However, the requiring activity and contracting office will publish the notice of proposed contract action IAW

5.201 to ensure we have reached as many potential competitors now and in the future.

Additionally, the Contracting Officer shall publish the Notice of Intent to Sole Source as required by FAR 5.201.

8. Market Research: Market research was conducted from 5 – 12 May 2020. A search of AbilityOne and the Federal Prison Industries websites found that neither source could support this requirement. The GSA e-Library search under FSS Supply Schedule 65 II A, Medical Equipment and Supplies, Category A-89, Sterilizer and Sanitizer Equipment resulted in several vendors. A search through the Small Business Administration’s (SBA) Dynamic Small Business Search (DSBS) using NAICS 811219 and using keywords “steris maintenance” showed zero vendors.

In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 206.302-1(d,) and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a request for information or sources sought was posted to beta.SAM.gov on 5 May 2020 for 6 days and the results generated two (2) responses. LE3 Engineering stated they have the “potential capacity” to support this requirement. A review of the vendor’s website indicate LE3 supports maintenance and repair of equipment used to “administer radiation therapy.” Steris provided a sole source letter stating the vendor is the “sole factory-authorized supplier of parts and services.” The KS reviewed other awarded contracts for the same or similar services on 21 May 2020 and requested further information from Steris Corporation. The vendor confirmed a partnership with Sustainment Technologies, a SDVOSB on 26 May 2020. After further review of Steris

Corporation and the proprietary equipment located at EACH; additionally, to ensure the warranty provisions are not voided, Steris has to perform the maintenance services.
