Control No. _SAS 22-03_______________

SOLE SOURCE JUSTIFICATION

1. Agency/Contracting Activity: U.S. Army Engineer District, Savannah, 100 West Oglethorpe Avenue, Savannah, GA 31401

2. Description of Action:

Nature: New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number W912HN18P5040

Pricing: Firm-Fixed Price Time & Materials Funds: OMA Other Funds:

Name of Proposed Contractor: Harbor Enterprises, LLC Survive-A-Storm Shelters Street Address: 1207 Sunset Drive City, State, Zip Thomasville, GA 31792-6356 Phone: 229-226-0911

3. Description of Services or Supplies:

The total estimated value of the proposed action is: 3 ½ (months) x $8419.00 = $29,466.50 + $1,650.12 (G&A 5.6%) = $31,116.62

4. Authority:

Action using simplified acquisition procedures (select one):

FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines

Contract Number W912HN18P5040 was awarded on 30 Sep 2018. The contract is set to expire on 25 Nov 2021. There are two existing option months in the contract that will be exercised which will extend the current Swing Space lease to 25 January 2022. The Government will need to extend an additional 3.5 months from 26 January through 10 May 2022. The purpose of this contract is to provide swing space in support of repairs to Fire Station #2, Contract # W912HN- 17-D-0004/W912HN18F4101, a 24-hour operations fire house for 10 DES (Directorate of Emergency Services) Fire Operations personnel. The construction contract has been delayed and the swing space for the 24-hour operation is required to be extended until the construction contract is complete (approximately 3 1/2 months). The existing 24-hour services are a requirement and providing different swing space would cause a break in service and be detrimental to mission requirement and potentially cost lives and property damage. The mission requirements of a Fire House are to provide 24-hour emergency response for life safety and protection of property (fire, crash, accidental fire sprinkler activation, active shooter, treed cats, et-cetera). Failure to maintain a space for firefighting personnel, will leave first responding duties to a fire house farther away, hence a slower response, which could result in further spread fire(s) (greater fire, smoke, water damage), and longer wait times for the injured, potentially with the result of death.

that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization)

5. Reasons for Authority Cited:

6. Actions to Increase Competition: This action is a one-time requirement. A Notice of Intent (NOI) to Sole Source the lease extension was posted to sam.gov on 10 November 2021 for 15 days. The NOI advised any potential bidders that if they believe they can provide this requirement at a competitive price to respond via email the Contract Specialist, Jennifer Ford. To date no responses have been received. Any future requirements for temporary modular trailer rentals will be competed.

7. Market Research:

The contract being modified was competitively procured as a 100% Small Business Set-aside. By extending the current contract by an additional 3 1/2 months, the Government would avoid duplication of the delivery, setup, utility connections and removal costs of procuring another unit.

8. Procurement History:

Previous Purchase Order(s) or Contract(s): Yes No

If "Yes", for each purchase order or contract provide:

Purchase order or contract number: W912HN18P5040 Was action competed? Yes No

9. Additional Facts and/or Information to support the justification.

None

10. Technical / Requirements Certification: I certify that the supporting data under my cognizance which is included in this abbreviated J&A is accurate and complete to the best of my knowledge and belief.

The current swing space was built specifically to meet the requirements under the UFGS for housing the Fire Station personnel. Therefore, there is currently only one source available that can meet these requirements in a timely manner without causing further delays to the construction contract.
