CUI//SP-PROCURE
Control Number: 22-RHCO-A-327
RFQ/RFP #: W91YTZ22Q0123
Sole Source Justification for Acquisitions under the Simplified Acquisition Threshold
(Simplified Acquisition Threshold is $250K)
1. Contracting Activity:
Regional Health Contracting Activity – Atlantic (RHCO-A) Bragg Contracting Cell 6021 5th Street, Building 1467 Fort Belvoir, VA 22060-5505
2. Description of Action:
Requirement: New Repeat Pricing: Firm-Fixed Price Time & Materials Cost Funds: OMA Other Funds: _________ Total Dollar ValueXXXXX
Name of Intended Contractor: NC State University College of Veterinary Medicine
Street Address: 1052 William Moore Dr.
City, State, Zip: Raleigh, NC 27607
Phone: (919) 515-8254
Period of Performance: 18 July 2022 - 30 September 2022
3. Description of Services: This procurement is for medical treatment services for two Multipurpose Canines (MPCs) belonging to 3rd Special Forces Group (Bingo, a four (4 )year-old, male, Belgian Malinois and Dora, a four (4) year-old, female, spayed, Belgian Malinois) for symptoms from heat injury. Ms. Cheryl Ricker approved the emergency acquisition on 18 July 2022 using the Fort Bragg Emergency Authorization Number FB22-0018
4. Authority Cited:
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
Controlled by: USAHCA CUI Category: SP-PROCURE Limited Dissemination Control: FED ONLY POC: Cynthia Richardson-Rhone (910) 904-9310
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR
(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR
(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.
5. Reason for Authority Cited: The Two Military working dogs were injured on duty and stabilized at the Ft. Bragg Veterinary Center (VETCEN). The request to referral for outside care was initiated by the United States Army Special Operations Command (USASOC) Command Veterinarian due to the need for advanced capabilities that VETCEN could not support. Coordination was made with Womack contracting office for approval to commit funds. Due to the urgent nature of the requirement, the Contracting Officer Ms. Cheryl A. Ricker authorized emergency care on 18 July 2022 using control number FB22-0018.
If the working dogs cannot meet the mission, they will be found unfit for duty and retired from service.
Funds in the amount of $30K were estimated and approved. MPCs were taken up to NC state on the evening of 18 JUL 22 for ongoing treatment. Both MPCs were discharged by 21 JUL 22 and appear to be doing well. Both dogs were transported to North Carolina State University College of Veterinary Medicine to provide specialty cardiology, internal medicine, and dermatology consultations. The Veterinary Center located at Fort Bragg, NC is not equipped to manage the case and referred the working dog to NC State. The Military Dogs cannot return to work until services are provided. The NC State Clinic is the only clinic located with 100 miles that can provide this level of care at one location in a timely fashion. Without extensive diagnostics and treatment, the military working dog can no longer provide services to support the mission.
6. Actions to Increase Competition: There will be no further actions to increase competition for this requirement.
7. Market Survey: Market Research conducted in accordance with FAR Part 10. Today, 27 April 2022, I researched the following areas indicated below using the Small Business Administration (SBA) Quick Market Research with multiple keywords as well as the North American Industry Classification System (NAICS) code of 541940. Also noted, due to the emergency of the Soldier’s mission, we could not locate any additional specialist medical services having the capability and located outside the 100 miles radius that would be timely required to provide emerging services.
