Sole Source Justification Acquisitions under the Simplified Acquisition Threshold

1. Contracting Activity:

2. Description of Action:

Requirement: New Repeat Pricing: Firm-Fixed Price Time & Materials Cost Funds: OMA Other Funds: Total Dollar Value: $300,000.00

3. Description of Supplies/Services: This action is to support COVID-19 programs as needed to provide continuous Renal Replacement Therapy Supplies for the Intensive Care Unit (ICU) for the base period, and one year option period.

4. Authority Cited:

(a) FAR 13.106-1(b) (1) (i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR

(b) FAR 13.106-1(b) (1) (ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR

(c) FAR 8.405-6(a) (1) (i) (A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR

(d) FAR 8.405-6(a) (1) (i) (B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR

(e) FAR 8.405-6(a)(1)(i)(c): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.

5. Reason for Authority Cited: Requirement is to support COVID-19 project to provide continual Renal Supplies to the Intensive Care Unit (ICU) located at Womack Army Medical Center, Fort Bragg, NC. The requirement is sole-sourced based on the Renal Equipment manufactured by “NX Stage Medical, Inc”. Any further delay of critical procedural cases may ultimately shut down the ICU until supplies are received. Without this purchase, WAMC will not meet their mandated requirements to support the nation with COVID-19 as well as meet the mission for Fort Bragg Soldier’s and their families.

6. Actions to Increase Competition: Due to COVID-19 urgencies, research indicates the company, is the manufacturer of the Renal Products. Therefore, the synopsis will not be posted.

7. Market Survey: Market Research conducted in accordance with FAR Part 10. On 5 May 2020 an on-line search of the SBA Quick Market Research was done. The General NAICS code 339113 search revealed small business contractors having the capability to provide the parts, but the specific word searches conducted on the Small Business Administration (SBA) Quick Market Research revealed zero small business having the capability to provide these products.
