(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR
(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR

5. Reason for Authority Cited: There are no other like items or products available for purchase that would serve the purpose or function and there is only one price for the item/products because of exclusive distribution or marketing rights. Teleflex is the only authorized manufacturer of the AC3 Optimus Intra-Aortic Balloon and necessary accessories. Marathon Medical is the sole distributor and currently provides the equipment that is already located in the Cardiac Catheterization Lab. The expendable supply of balloons are only compatible with the AC2 Optimus Intra-Aortic Balloon pump, which is already located in the Cath Lab at Womack Army Medical Center. This necessitates that the purchase of an additional Intra-aortic balloon pump remain with Marathon Medical. This item is critical to the Catheterization Lab, Department of Medicine, at Womack Army Medical Center. Failure to procure this item will result in diminished patient care.
6. Actions to Increase Competition: A sources sought, synopsis and solicitation will be posted to beta.SAM.gov website. It is anticipated that Marathon Medical is the only contractor that can meet the full requirement due to the distribution and marketing rights provided by Teleflex. No additional steps will be taken to increase competition for this requirement.
7. Market Survey: Pricing information was obtained (quote number 0017234) through Marathon Medical. An internet search did not produce any additional price results. On 23 April 2021 an on-line search was conducted on the Small Business Administration (SBA) quick market research was conducted by using the General NAICS code 339113 (Surgical Appliance and Supplies Manufacturing) and key words “AC3 Optimus Intra-Aortic Balloon”.
