About this file

This document is a Justification and Approval (J&A) for Other than Full and Open Competition for the FY24 Physical Access Control System (PACS) Upgrade in the Charleston District of the U.S. Army Corps of Engineers. The purpose is to upgrade and maintain the PACS in the district office building to make it fully functional and reliable, as the current system is not operational and not repairable, compromising facility security and accessibility. The authority cited is 10 U.S.C. 3204(a)(2) and FAR 6.302-2(a)(2) for unusual and compelling urgency, as Johnson Controls installed the original system in 2011 and is familiar with it, able to quickly order and install the required components. The total estimated value is $. This J&A supports the award of Contract W912HP24P0010 on 2024-09-23 to an unknown vendor for an unknown amount.

Justification and Approval for Other than Full and Open Competition – FAR Part 6

1. Contracting Activity: U.S. Army Corps of Engineers, Charleston District, Charleston Contracting Office, 69-A Hagood Avenue, Charleston, SC 29403-5107

2. Description of Action: The purpose of this procurement is to upgrade and maintain the Physical Access Control System (PACS) in the district office building to make it fully functional and reliable. This is a priority action because the current PACS is not operating and is not repairable, severely compromising the security and accessibility of the facility.

3. Description of Supplies/Services: The contractor will upgrade the PACS to provide new front-end hardware and software and all other components required to make the system fully operational. The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, other items, and non-personal services necessary to perform the procurement, installation, integration, testing, training, and maintenance of the PACS.

The total estimated value of the proposed action is $

4. Authority Cited: 10 U.S.C. 3204(a)(2), as implemented in Federal Acquisition FAR 6.302-2(a)(2). When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.

5. Reason for Authority Cited: Johnson Controls installed the current PACS in 2011 and has provided service and repairs as needed since that time. They also installed and currently maintain the building’s other security systems, including security cameras and monitored burglar alarms, as well as the building fire alarm system. The burglar alarms are integrated with the existing PACS. Johnson Controls is familiar with the existing PACS and has been troubleshooting it since it started having problems. They concluded that the system needs upgraded control boards and other front-end components to ensure the system functions properly. The circuit boards required to repair the current system are no longer manufactured and are not available. Johnson Controls familiarity with the PACS, and the fact that they have diagnosed the fault will enable them to quickly and efficiently order and install the components required to bring the system back into operation. A contractor other than Johnson Controls would have to restart the troubleshooting process on the existing system, a system with which they are not familiar. The additional labor required would add a significant cost and time delay to the upgrade and repairs. Johnson Controls has a proven record of technical competence, responsiveness, and can immediately affect the repairs.

6. Efforts to Obtain Competition: N/A

a. Effective competition. N/A.

b. Subcontracting competition. N/A

7. Actions to Increase Competition: This J&A supports a discrete requirement that will end when the project is complete. Therefore, there are no planned actions to increase competition for the requirement covered by this J&A. This J&A will be posted on SAM.gov IAW 6.305(b).

8. Market Research: On May 14, 2024, the Government queried the SBA’s Dynamic Small Business Search engine to identify the number of companies actively registered under the NAICS code for this program (561621) in South Carolina. 80 companies fell within that search criteria. To narrow the search, the Government searched the NAICS code 561621 with the keyword of “security” in South Carolina. 19 vendors fell within the search parameters.

Johnson Controls installed the current PACS in 2011 and has provided service and repairs as needed since that time. They also installed and currently maintain the building's other security systems, including security cameras and monitored burglar alarms, as well as the building fire alarm system. They can configure existing components at a cost savings to the government.

10. Other Facts:

Approval

Based on the foregoing justification, I hereby approve the procurement of FY24 PACS Upgrade with an estimated value of on an other than full and open competition basis pursuant to the authority of 10 United States Code 3204(a)(1) as implemented in Federal Acquisition Regulation FAR 6.302-2(a)(2) Unusual and Compelling Urgency. When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
