(Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $650K)
1. Agency/Contracting Activity U.S. Army Corps of Engineers, Charleston District, Charleston Contracting Office, 69-A Hagood Avenue, Charleston, SC 29403-5107
2. Description of Action:
Nature: X New Requirement Follow-on Requirement Mod to Existing Purchase Order/Contract Number
Pricing: X Firm-Fixed Price Time & Materials Funds: OMA Other Funds:
Name of Proposed Contractor(s): (Brand specific) Mercury Marine SeaPro 200hp Outboard Motors Street Address:
City, State, Zip:
Phone:
3. Description of Services or Supplies:
This is a procurement action is a request for an original equipment manufacturer of two replacement Mercury Marine SeaPro 200hp Outboard Motors Counter Rotating, 25” Shaft Length with a stainless-steel propeller. This will be a firm-fixed price purchase order for an estimated total value of $50,000.00.
4. Authority Cited: Action using simplified acquisition procedures:
FAR 6.302-1 (c) “An acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer”:
5. Reasons for Authority Cited: In order to overcome further incurred cost and non-compatible equipment of different brands the government is requesting sole source authority to obtain two (2) Mercury Marine SeaPro 200hp Outboard Motors through authorized resellers. This request is for original equipment manufacturer of marine engines that are specific to the current rigging equipment installed on the government vessel the Heiselman. The existing rigging equipment to be used is from a 2016 Mercury 200hp Verado (Model No. 1201V23ED and 1201V24ED). In order to overcome non-compatible equipment of different brands and the replacement of the entire propulsion system only Mercury Marine SeaPro 200hp Outboard Motor can satisfy this requirement. This request is required in order to meet the daily operational mission of the District.
6. Efforts to obtain competition: The government is not limiting sources who can supply equipment, just the brand name of the equipment that they can supply due to reasons stated in paragraph 5. Several approved sources can supply the Mercury Marine SeaPro 200hp Outboard Motor.
7. Actions to increase competition:
In accordance with FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization)
The customer (Survey Section) will continue to monitor the market to keep abreast of industry changes to avoid possible sole source purchases in the future. A review of available documentation demonstrates that there are NO significant factors which limits feasibility of competition for this requirement as multiple vendors can supply this Brand Specific item.
8. Market Research: Market research was conducted by Matthew Foss, Chief of Survey, by calling and internet research on the following agencies and obtaining information for an availability of a Mercury Marine SeaPro 200hp Outboard Motor. The results of the market research are as follows:
a. BAR Marine - (Small Business) 1113 Hope Plantation RD, Jacksonboro, South Carolina 29452, (843) 893-2286 http://www.barmarine.com/
b. Marine Propulsion Corp - (Small Business) 2429 Marina Rd, Wadmalaw Island, South
Carolina 29487, (843) 559-1025 https://www.marinepropulsionsc.com
c. Duncan’s Boats – (Small Business - not listed in SAM) 4350 Bridge View Dr, North Charleston, SC 29405, (843) 483-8979 https://www.duncansboats.com
d. East Coast Marine Repair CO., INC, (Small Business) 401 Parris Island Gateway, Beaufort, SC, 29906, (843) 522-3186
Market research indicates multiple vendors can supply various 200hp Outboard Motors at a fair and reasonable pricing, but only an Authorized Vendor can provide the Mercury Marine SeaPro 200hp Outboard Motor. All four of the vendors listed above are within 50 miles and are Small Businesses.
9. Other Interested Sources: The government is seeking competitive bidding on this brand specific requirement and is requesting the advertisement be posted or synopsized in a public place or on a government point of entry such as Beta.SAM.
10. Other Facts: In order for the Government to remove or overcome any barriers to competition, it would require this technology to be widely available in the marketplace.
