SINGLE SOURCE DETERMINATION
1. CONTRACTING AGENCY: Kansas City District (NWK), U.S. Army Corps of Engineers (USACE), Contracting Division, 601 E. 12th St., Kansas City, MO 64106.
2. DESCRIPTION OF ACTION: This action is for a firm fixed price single source requirement using Fiscal Year 2020 Operations and Maintenance funds to perform emergency dredging of the navigation channel, at River Mile (RM) 133, of the Missouri River.
3. DESCRIPTION OF SERVICE: USACE, NWK, requires urgent dredging services to clear the navigation channel and reduce risk to river traffic at RM 133. Total estimated cost for this requirement is $185,000. The source for this purchase is Capital Sand Company, Inc, 700 Mokane Rd, Jefferson City, MO 65101. The period of performance will be 7 days from award. Award was completed on 11 Sept 2020. Work was completed 15-19 Sept 2020. All work has now been completed. There are no options or continuation of services clauses. This contract resulted in the vendor coming to the site and performing this service.
4. AUTHORITY CITED: FAR 13.106-1(b), Soliciting from a single source.
5. REASON FOR AUTHORITY CITED:
a. BACKGROUND: Maintaining a navigable channel on the Missouri River is one of the core missions for the Kansas City District, US Army Corps of Engineers. The Missouri River has various stone structures, built in channel, that are designed to ensure the navigation channel is self-scouring in order to maintain a depth that will allow barge traffic. During the flooding event of 2019 many of the river structures that maintain the flow of river and the navigation channel were damaged at various locations up and down the river. At river mile 133, the damage of to these structures has led to shoaling and unsafe conditions for navigators transporting material on the river. There have been multiple groundings at this location in the past month and there is concern that the shoaling is progressing much quicker than first identified. There is not time to wait for the river stone structures to be repaired to make the navigation channel usable again. To ensure safe navigation at this time, the channel must be dredged.
Dredging has been done in the past but only in similar situation such as this one, where the self-scouring design was damaged and not operating correctly. Various contractors have completed dredging in the past but it is not a regular required service.
b. JUSTIFICATION: Safety is a top priority for the Kansas City District. This priority extends to our Mission of maintaining a safe navigation channel on the Missouri River.
Assumptions: Per Dane Morris, PM for MO Riverbank Stabilization and Navigation Project (BSNP), monetary damage to the navigation industry is estimated at $40-$80k per day as there have been several navigation companies on the river lately. Hermann Towing is running one to two boats, Far West one to two boats, MV Lampton of Magnolia Marine, Big Eddy and others are attempting to transit these shoaled areas. In addition, risks to tows posed by these shoals have the potential to damage government property including the river training structures on the Missouri River potentially causing $10k to $100k to each structure.
Assumptions: Per PM, Dane Morris, when depths in the channel are not to authorized depth (9’) for the full authorized width (300’), the Missouri River is treacherous to navigate. Tow pilots risk beaching barges in shallow water or shoaled areas which can cause tows to break apart, thereby allowing uncontrolled drift downstream of 200+ ton barges that could cause severe damage to bridge piers, government property, or other vessels. Vessels also risk inducing serve damage that could sink the vessel and/or injure or kill personnel on board, deckhands on the barges, or colliding (?) with another vessel in the river. In addition, if the contents of the tow are hazardous, damage to the barge and container integrity could cause uncontrolled release of this substance into the environment.
Fact: Per PM, Dane Morris, A recent grounding caused a petroleum barge to break loose and float uncontrolled down river for several miles before it was caught just upstream of a major highway bridge.
Fact: Per Contractor and USACE Personnel, Capital Sand was already working in this area under their permits for sand production and had time available to do additional dredging work and time was of the essence. Other dredging companies were not located close by and would have required unacceptable amount of time for mobilization.
Competition for this action was not feasible as noted in this background and justification information; therefore, for this action, there were no efforts undertaken to obtain competition/find alternative and/or additional sources. Market research established that Capital Sand was the only source available to respond due to the urgent nature of this requirement.

I hereby determine the circumstances of this contract action deem only one source reasonably available due to unusual and compelling urgency. In accordance with FAR 13.106-3(a)(2)(iii), Pricing will be determined as Fair and Reasonable based on comparison to national averages and knowledge of river engineers familiar with this type of work.
