JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
FOR BOOM HOIST MOTOR REPAIRS OF THE
DB HENRY M. SHREVE - 2022
1. Contracting Agency: US Army Engineer District, Corps of Engineers, 502 Eighth Street, Huntington, WV 25701.
2. Description of Action: This is a proposed new FFP contract action for a sole source procurement using civil works funds to purchase repair services for the boom hoist motors of the DB HENRY M. SHREVE.
3. Description of the Supplies/Service: The Regional Rivers Repair Fleet (R3F), Heavy
Capacity Fleet Unit (HCF), Louisville, KY, has need for repair of the boom hoist motors of the DB HENRY M. SHREVE. The projected cost is $20,000 to repair the motors.
4. Authority Cited: 10 U.S.C. 2304(c)(2); FAR 6.302-2 – Unusual and Compelling
Urgency. When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
5. Reason for Authority Cited: The HCF is currently unable to complete its mission due to the unexpected failure of the boom hoist motors of the DB HENRY M. SHREVE. The repair fleet costs approximately $70,000 per day and is in midst of a major miter gate replacement project at Cannelton L/D. The HENRY M. SHREVE is the only crane within USACE that can safely remove the damaged miter gates, and if not repaired will be unable to complete the Cannelton L/D Miter Gate Replacement Project, creating significant delays to navigation traffic on the Ohio River. The total estimated cost of the repairs is significantly less than one day delay to the fleet. Any time spent obtaining competition would cost the government significantly more than can be expected to be saved.
Furthermore, the injury to the Government is that the crane itself is in a locked position with a boom. The current status of the crane is in a dangerous position and would cause a health/life/safety risk if not immediately repaired.
A market research analysis was performed, and the lead times for repairs other than a certified dealer to fix the crane revealed several weeks of lead time which the Government cannot afford due to the position the crane is locked in.
The local contractor that revealed the capabilities to do the work without a lead time is:
Gatterdam Industrial Services, Inc.
4615 Bittersweet Rd.
Louisville, KY 40218
502-776-3937
Contract Control Number: LRH-FY22-50
6. Efforts to Obtain Competition: No efforts to obtain other competition were completed due to the urgency of the situations.
7. Actions to Increase Competition: No actions to obtain other competition were completed due to the urgency of the situations.
8. Market Research: Market research was performed to gauge the ability of contractors who are able to complete repairs on the unique boom hoist motors on the DB HENRY M.
SHREVE, and Gatterdam Industrial Services, Inc. is the only locally available contractor who has experience with these repairs and can complete these repairs in a timely fashion without an extensive lead time.
9. Interested Sources: To date, no other sources have written to express an interest. The notices required by FAR 5.201 shall be published and any bids or proposals received shall be considered.
