DETERMINATION FOR OTHER THAN FULL AND OPEN COMPETITION

(SIMPLIFIED ACQUISITION PROCEDURES – BRAND NAME)

1. Contracting Activity:

U.S. Army Corps of Engineers, Huntington District, CELRH-CTD, 502 8th Street, Huntington, WV, 25701

2. Description of Action:

The action hereby submitted for approval is for a brand name procurement of parts for the repair of two generators on the Service Barge 185. The Service Barge 185 is a barge owned and operated by the Regional Rivers Repair Fleet’s (R3F) Heavy Capacity Fleet (HCF).

The cost for the supplies exceeds Government Visa purchase thresholds. This will be procured as a commercial supply contract using the Service Barge 185’s plant account funds.

3. Description of Supplies/Services:

The purpose of this procurement is to obtain parts for the repair of two of the Service Barge 185’s generators. The repair will be performed by USACE employees and no service will be provided in the contract. The parts match those of the existing generators. The total estimated cost of the parts is approximately $60,000.

4. Authority Cited:

FAR 6.302-1, as the existing equipment inventory precludes consideration of products manufactured by another company.

5. Reason for Authority Cited:

The two generators being repaired are two Caterpillar 3406 Generators. Only Caterpillar parts will be able to be used to replace the existing parts. To be able to continue to operate the Service Barge 185, the generators will need these repairs or replaced with similar generators. The costs to replace two generators would be around $130,000, much greater than the cost to repair with the Caterpillar parts.

6. Efforts to Obtain Competition:

In accordance with FAR 5.101 and 5.102, competition will be obtained by posting a solicitation to betaSAM.gov to allow all interested and eligible vendors to submit quotations for the required products. Vendors will be provided no less than seven (7) calendar days to submit quotes. Based on market research, it has been determined it is in the best interest of the Government to set aside this procurement 100% for small business in accordance with FAR 19.502.

7. Actions to Increase Competition:

As stated in Number 6 above, this procurement will be solicited via betaSam.gov to allow for maximum practicable competition. No actions have been taken to further increase competition.

Competition is being restricted to brand name supplies due to agency requirements.

It has been determined it is in the best interest of the Government to set aside this procurement 100% for small business. No other actions have been taken to increase competition.
