BRAND NAME DETERMINATION
Far Subpart 13.106-l(b)
1 CONTRACTING AGENCY: US Army Corps of Engineers (USACE), Walla Walla District (CENWW-CT) 201 North 3rd, Walla Walla, WA 99362.
2 DESCRIPTION OF ACTION: The U.S. Army Corps of Engineers, Walla Walla District has a requirement for the purchase of one Genie GS-3232 Scissor Lift for use in McNary Lock and Dam's Spillway Gate Repair Pits.
3 DESCRIPTION OF ITEMS: This action is for a new Firm Fixed Price (FFP) contract to purchase a commercial item, off the shelf, from a distributor who can supply a GS- 3232 Genie electric scissor lift. This lift has a 32-ft platform height max, a 6-ft 10-in stowed machine height with the rails folded, and a 2-ft 8-in width. The estimated cost of this purchase is $.
4 AUTHORITY CITED:
FAR 11.105(a)(l), Items Particular to One Manufacturer. The particular brand name, product, or feature is essential to the Government ' s requirements, and market research indicates other companies ' similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency' s needs.
FAR 13.106-1 (b) Soliciting.from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
5 REASONS FOR AUTHORITY CITED:
a. JUSTIFICATION:
McNary Dam needs a dedicated scissor lift for their spillway gate repair pit. There are two bays in the pit connected by a man-door. The lift must be narrow enough to fit through the man-door and it must have a sufficient platform height to allow personnel to reach the top of a spillway gate leaf when stored in the spillway gate repair pit. The lift will used for maintenance, repairs and inspections of the spillway gates.
McNary routinely maintains and inspects spillway gates in the spillway gate repair pit. The activities must be performed from a scissor lift. The gates are large and when stored on the pit pedestals, the top of the upper gate leaf is 31.3 feet off the ground.
There are two spillway gate repair pits, one for the lower gate leaf section and one for the upper leaf. The pits are connected by a man-door which is 86-in tall by 41-in wide.
The new scissor lift must have a platform height sufficient to allow a person to step onto the top of a gate and must fit through the man door. Therefore, the lift must have a maximum platform height of at least 31.3 feet and have a machine height ofless than 86-in and a machine width ofless than 41-in. According to McNary staff research, the Genie GS-3232 scissor lift is the only scissor lift that meets those requirements.
b. IMPACT:
McNary does not have a dedicated scissor lift for the spillway gate repair pit, and none ofMcNary's scissor lifts fit through the man-door. Therefore, any time a gate needs preventative maintenance, repair or an inspection, a scissor lift must be transported to the pits, the pits need to be un-covered, and the lift must be lowered into the pit. When the lift needs to be moved from the lower leaf pit (the south bay) to the upper leaf pit (the north bay), it needs to be lifted out of one pit and back into the other pit. This requires a crane, a crane operator and rigging crew. It is a time consuming and therefore costly job. Additionally, because of the limited scissor lifts on-site, and limited crew support, this work often leads to delays in other jobs. It also leads to delays in the required hydraulic steel structure (HSS) inspections of the spillway gates, putting McNary out of compliance with EM-385. It also causes delays in required repair and maintenance which puts McNary Dam out of compliance with the spill patterns required by the fish passage plan.
c. ALTERNATIVES:
It is not in the best interest of the Government, or taxpayer, to purchase an alternative brand name or model of scissor lift. Other companies offer similar lifts with similar capabilities but only the Genie 3232 has the required max platform height, machine height and machine width.
6 EFFORTS TO OBTAIN AND INCREASE COMPETITION:
Genie Scissor lifts are sold by a wide range of distributers. As such, the scissor lift will be purchased from a competitive pool of bidders.
7 FAIR AND REASONABLE COST DETERMINATION:
The cost is well within the range of other scissor lifts of similar platform height. The market for this scissor lift is competitive and should result in a fair and reasonable price;
however, no contract will be awarded unless the price is determined fair and reasonable.
8 MARKET RESEARCH: McNary staff reached out to multiple vendors for estimates.
Star Rentals, Pape Material and Handling, Wheco and Mid-Columbia Forklift. These vendors supply multiple different scissor lift brands including Skyjack, JLG, Haulotte, Hy-Brid, Genie, Aichi, and Noblelift.
