If the Contractor violates Public Contract Code § 4100 et seq., the County of Sacramento may exercise the remedies provided under Public Contract Code § 4110. The County of
Sacramento may refer the violation to the Contractors State License Board as provided under Public

The withdrawal of a Bid does not prejudice the right of a Contractor to file a new or revised Bid in accordance with the Notice to Contractors. Bids may be revised in the Agency's eProcurement system prior to the Bid due date and time.
2-13 PUBLIC OPENING OF BIDS
Section 2-13, “Public Opening of Bids,” of the Standard Construction Specifications is hereby deleted and replaced with the following:

The Contractor is responsible for the accuracy of the Contractor’s own layout work.
All Contractor work using GNSS equipment shall be performed by or under the direction and supervision of a Contractor provided responsible-charge California Licensed Land Surveyor or

Staking requests must take into consideration the level of effort required to provide the controlling stakes and priorities established as necessary. Advance notice must provide sufficient time to complete at least the first priority requested. Unless authorized by the Agency, work done without line and grade is at the Contractor’s risk.
The Agency will typically provide the following stakes:
1. Clearing & Sawcut Limits – The stakes/markings will be placed at even station intervals and/or any change in horizontal direction.
a. Stakes will be spaced so that the contractor can see from one stake to another but not less than 100 feet apart.
b. All sawcut markings will be set at actual locations.
2. Rough Grade – One line of stakes/markings spaced every 50 feet, horizontal and vertical angle points on each side of the construction to control cut/fill and slopes.
a. The markings will be placed in the asphalt outside of the proposed Sawcut line. If these points fall within 6 feet or less from the proposed Lip of Gutter they will be considered a Finished Grade stake and must be protected.
b. For areas of heavier grading, large channels or embankments slope staking will be provided, with cut/fill data to control the grading of the feature.

Erosion and sediment control BMPs shall be placed, monitored for effectiveness, and maintained throughout the construction process. The following precautions shall be implemented regardless of the season:
1. A stabilized construction site access shall be constructed at any construction staging and/or stockpile site as determined appropriate by the Engineer.
2. Temporary stockpiling of construction materials, including vehicles and portable equipment, supplies, fuels and chemicals, will be restricted to designated construction staging areas within the project area.
3. Any wet season requirement shall be implemented if conditions exist which may cause erosion and sedimentation.
4. The contractor shall not be limited to the requirements listed above, but shall be responsible for implementing whatever measures are necessary to prevent erosion and sedimentation.
The Contractor shall demonstrate the ability and preparedness to fully implement soil stabilization practices and sediment control measures to protect soil-disturbed areas on the project site before the onset of precipitation. A quantity of soil stabilization and sediment control materials shall be maintained on site equal to 100 percent of that sufficient to protect unprotected, soil-disturbed areas on the project site. A detailed plan for the mobilization of sufficient labor and equipment shall be maintained to fully deploy control measures required for the protection of soil-disturbed areas on the project site prior to the onset of precipitation. A current inventory of control measure materials and the detailed mobilization plan shall be included as part of the WPCP.
The wet season is hereby defined as the period between October 1st and April 30th. Erosion control (i.e.
soil stabilization) BMPs shall be applied during the wet season. All other BMPs included in the approved
WPCP shall be installed/implemented and maintained year round.
Throughout the wet season:
1. Soil-disturbed areas of the project site shall be considered to be non-active whenever soil disturbance activities are to be discontinued for a period of 20 or more days and the areas are fully protected. Areas that will become non-active during the wet season shall be fully protected with soil stabilization practices and sediment control measures within 10 days of the discontinuance of soil disturbing activities or prior to the onset of precipitation, whichever is first to occur.
2. Active soil-disturbed areas of the project site shall be fully protected at the end of each day with soil stabilization practices and sediment control measures unless fair weather is predicted through the following workday. The Contractor shall monitor the weather forecast on a daily basis. The
National Weather Service forecast shall be used. An alternative weather forecast proposed by the
Contractor may be used if approved by the Engineer. If precipitation is predicted prior to the end of the following workday, construction scheduling shall be modified, as required and functioning control measures shall be deployed prior to the onset of the precipitation.
3. Inspections of the construction site shall be conducted by the Contractor to identify deficient measures, as follows:
A. Prior to a forecast storm;
B. After any precipitation which causes runoff capable of carrying sediment from the construction site;
C. At 24 hour intervals during extended precipitation events; and
D. Routinely, a minimum of once every 2 weeks.
If the Contractor or the Engineer identifies a deficiency in the implementation or functioning of an identified control measure, the deficiency shall be corrected immediately. The deficiency may be corrected at a later date and time if requested by the Contractor and approved by the Engineer in writing, but not later than the onset of subsequent precipitation. The correction of deficiencies shall be at no additional cost to the County.
The Contractor shall implement, year-round and throughout the duration of the project, control measures included in the WPCP for sediment tracking, wind erosion, non-storm water management and waste management and disposal.
The schedule of values shall reflect the items of work and costs for the control measures required for the
WPCP, except for critical temporary controls and permanent control measures which are shown on the project Plans and for which there is a contract item of work.
