Single Source/Brand Name Justification FAR 13.106-1(b)(1) – Simplified Acquisitions

1. AQM Contracting Office: Chattahoochee-Oconee NF.

2. Description of Action: Wanda Wetlesen-Shepherd requests a firm fixed price contract with T.L. Gowin & Company, Inc.

3. Description of Supplies/Services: Brasstown Bald Visitor Center Theater Roof Repairs- Phase 2

4. The rationale or circumstances for limiting competition

In accordance with Federal Acquisition Regulation 13.106-1(b)(1) For purchases not exceeding the simplified acquisition threshold.(i) Contracting Officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deems only one source reasonably available.

TL Gowin & Company, Inc. is the commercial roofing contractor which Seaman Cooperation Inc. uses to make repairs to roofs which fall under a currently active warranty. Brasstown Bald’s membrane FiberTite roof is currently under warranty until 2024.

In 2015, Seaman’s Cooperation was called to make a repair to the visitor center roof membrane the building had a substantial leak just above the visitor center desk. Seaman Cooperation called TL Gowin & Company to make the repair. This repair was covered under the current warranty.

TL Gowin & Company came again later in 2015 to make repairs to the radio operator’s room, as icicles from the antennas pierced the roof, causing water to enter the room.

In 2016, Brasstown Bald experienced heavy rainfall. Several gallons of water were vacuumed up from the theater floor after one particularly heavy rainstorm. After this weather event, the concessionaire contacted Seaman Cooperation to conduct and inspection of the roof and diagnose the cause of leaking. A representative from Seaman Cooperation Inc. came to Brasstown Bald to look at the leak over the theater, along with a contractor from TL Gowin & Company. Gene Norberg, from Seaman Cooperation who deals specifically with FiberTite roofing systems, determined that the roof membrane was intact, but the parapet wall around the perimeter of the observation deck was not sealed properly (as such is not covered under warranty). He recommended using TL Gowin & Company, Inc. to make repairs as needed.

In 2018, the Forest Service contracted with TL Gowin to permanently address the leaks in the roof above the theater room, as the repairs on the parapet wall in 2016 did not address the problem. However, due to budget limitations, only the bottom 3’ of outside wall perimeter above the theater (versus a total wall height of 11’) was sealed. TL Gowin stated that this would likely not address all of the issues, and that this would be a minimal repair.

Version – October 2019 FOR OFFICIAL USE ONLY

In 2020, the Forest Service received additional funding to fully address the complete scope of repairs that was proposed by TL Gowin in 2018. This work will provide a watertight seal above the theater roof by installing ice and water shields completely around the remaining 8’ of height of the walls above the theater roof. Competition is determined inadequate based on the cost-benefit analysis and the existing warrant. T.L. Gowin & Company, Inc completed only the bottom 3’ of outside wall perimeter above the theater versus a total wall of 11’ was sealed.

TL Gowin & Company, Inc.is approved by Seaman’s to conduct warranty repairs and maintenance.
