About this file

This Justification for Exception to Fair Opportunity document details a bridge modification for security support services in Kuwait by Triple Canopy, Inc. The U.S. Army Contracting Command - Rock Island (ACC-RI) is seeking a firm-fixed-price modification to an existing task order for Kuwait Security Support Services, specifically for Area Support Group Kuwait (ASG-KU) at Camp Arifjan and Camp Buehring. The contract extension is intended to provide continuous security services for U.S. Service Members, Department of Defense Civilians, DoD Contractors, and Coalition Nation personnel until a competitive follow-on task order can be awarded.

Market research identified multiple potential contractors, but Triple Canopy is deemed the only contractor capable of performing these critical security services without disruption due to existing infrastructure, personnel, and operational knowledge. The bridge modification is justified by delays in the competitive follow-on process, which encountered challenges in contract award, including multiple solicitation amendments and complex evaluation criteria. The government plans to continue market research and eventually compete the follow-on task order among seven GPS IDIQ contract holders, with the goal of maintaining uninterrupted security support in the Kuwait Area of Responsibility.

Supply/Service: Kuwait – Security Support Services

Although market research indicates there are multiple contractors capable of performing the required security services in the Kuwait AOR, due to the reasons stated in paragraph 5, Triple Canopy is the only contractor capable of performing the requirement without a disruption or lapse of critical services.

7. Actions to Increase Competition: The follow-on TO (K-GPS) will be competed among the seven GPS IDIQ contract holders.

Additionally, The Government recognizes the importance of staying informed about changes in the marketplace to ensure that all capable contractors are considered. To this end, the Government will continue to conduct market research throughout the acquisition process. This includes:

- Monitoring industry trends and advancements in private security services.

- Engaging with industry through Requests for Information, Sources Sought

Notices, and industry days to identify new entrants or changes in contractor capabilities as the GPS IDIQ does allow for new contractors to on-board if requirements are met.
