Fair Opportunity Exception Justification

FAIR OPPORTUNITY EXCEPTION JUSTIFICATION

UNDER GSA ALLIANT GWAC (FAR PART 16.505)

GSA Task Order ID no. 9Q0SCMIS001

I. Contracting Agency and Activity

The General Services Administration, Federal Acquisition Service, Pacific Rim Region, 50 United Nations Plaza, San Francisco, California 94102 plans to contract by means other than full and open competition. This document sets forth the justification and approval for award of a task order modification under an “Exception to Fair Opportunity”.

II. Nature of Action Being Approved

The General Services Administration supporting the U.S. Army Corps. of Engineers proposes to enter into a sole-source task order modification to increase the ceiling price of CLIN 4004 by $500,000 over a 3 month period of performance with CACI Inc. Federal of Chantilly, Virginia for continued information technology support services against the terms and conditions of their Alliant GWAC contract (GS00Q09BGD0020). CLIN 4004 is a time and materials CLIN for Resident Management System (RMS) Development and Support for System Enhancements.

The current task order (GSA Task Order ID no. 9Q0SCMIS001) was awarded under fair opportunity through e-Buy RFQ no. 45608 dated April 28, 2010 by GSA, Pacific Rim Region, Acquisition Operations Division to CACI Inc. Federal on June 23, 2010. The task order was solicited and awarded with a 12 month base period and four option years. The task order is currently in the fourth and final option period.

III. Description of Supplies/Services

The expenditure of the additional $500,000 will be focused on increasing the rate of development for RMS 3 because end user demands and working environments are now exceeding some of the RMS 2.38 capabilities. In recent years, the demand for data to be exchanged between construction contractors and USACE has exceeded the capabilities of the

2.38 version of RMS. This demand is driven by the need and desire to exchange larger attachments of data such as documents, spreadsheets and images. As one such example, in 2013, USACE mandated the use of paperless contract file on all construction contracts. To comply with said mandate, the number of attached documents within the RMS system has grown substantially.

In addition to the increase demand for large attachments, the deployment of RMS has widened to more distant and remote locations throughout the world. Construction sites in these areas sometimes have poor or non-existent data networking capabilities. The 2.38 version of RMS requires a stable network connection in order to operate.

Therefore, it has been, and continues to be the desire of USACE to use CLIN 4004 to further the development and deployment of RMS 3. While RMS 3 has some elements of known scope, such as porting over much of the functionality of RMS 2.38, it cannot be anticipated what other demands may be requested by the user community. As is the case with most systems and organizations, unanticipated events occur due to policy changes, changes in organization and changes to related systems and processes.

It is anticipated that the development will be concentrated on the 7 tasks as identified under the expenditure plan:

Description Source code including development documentation for RMS 3.0 submittal items Source code including development documentation for RMS 3.0 pay estimates Source code including development documentation for RMS 3.0 RFIs Source code including development documentation for RMS 3.0 QA/QC Source code including development documentation for RMS 3.0 Correspondence Source code including development documentation for RMS 3.0 Reports Source code including development documentation for RMS 3.0 RFIs Source code including development documentation for RMS 3.0 Unanticipated item solutions

IV. Authority Permitting a Fair Opportunity Exception

FAR 16.505(b)(2)(i)(C), “The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order”.

V. Applicability of Authority

There are no known alternatives to this sole-source task order modification.

Additionally, due to the normal timelines for full and open contract re-compete, there is no capability to meet a delivery schedule that precludes a loss of capability/contractor coverage.

This task order modification will satisfy this shortfall.

If additional contractor support cannot be garnered for the period of this task order modification, the U.S. Army Corps. of Engineer’s mission will be negatively impacted. Over 1,000 offices within the U.S. Army Corps. of Engineer rely on the RMS for day to day operations in managing construction contracts throughout the world. In recent years, the demand for data to be exchanged between construction contractors and the U.S. Army Corp of Engineer has exceeded the capabilities of the current 2.38 version of RMS. Delay in the development and deployment of RMS version 3 will negatively impact the use of RMS in areas with poor communications including war zone areas, emergency operations areas, and underdeveloped areas of the world.

CACI Federal Inc., the incumbent Contractor, has the institutional knowledge to continue the mission critical support without disruption and without the unnecessary administrative costs resulting from a short term transition period for this interim solution.

VI. Efforts to Obtain Competition

This is an interim measure for a short-term task modification until the follow-on task order can be competed and awarded.

This task order modification is anticipated to have an approximate start date of late March, early April of 2015. This modification will fill the gap between the current task order end date and the new task order begin date. The three-month performance period of this sole source task order modification allows sufficient time for award of the follow-on competitive task order under fair opportunity.

VII. Fair and Reasonable Costs

The hourly rates that will be utilized shall be identical to the rates currently being charged under CLIN 4004 under the fourth and final option period of Task Order ID no. 9Q0SCMIS001 as originally proposed by CACI Federal Inc. under the original award. The price for option period four was competitively proposed in 2010 and still represents the best price available as indicated in GSA’s May 8, 2014 Determinations and Findings to exercise option period 4.

VIII. Market Research

Market research is in process under the re-competition of the follow-on task order. This modification is only an interim measure providing sustainment services, until the follow-on task order can be properly competed and awarded. The period of performance of this modification is approximately 3 months based on an anticipated start date of late March, early April of 2015.

The US Government has a critical need for information technology support services sustained by this contract action. Continuity of service for current operations must be maintained pending the award of the new full and open task order.

IX. Other Facts

These services directly support the continuing US defense missions at home and abroad.
