Absence of Competition: Net Annual Rent Does Not Exceed $250k

Re: SLAT for Simplified Acquisition –Succeeding Lease On-Airport Property

The proposed action is for a new lease to replace Lease No. LHI01592, to provide USDA Animal Plant Health Inspection Service (APHIS) continued occupancy of its current premises, approximately 5,453/RSF of space, located at, 375 RODGERS BLVD., HONOLULU, HI 96819. The rentable space shall yield a minimum of 5,453/USF available for use by tenant for personnel, furnishings and equipment. The premise will provide no surface parking spaces. This lease action is regulated by GSAM 570.402. The succeeding lease is for a term of 20 years, 10 firm. Lease

LHI01592 expiration date is July 31, 2022.

The annual rent is estimated to be and the net annual rent is estimated to be per annum.

The annual net contract value does not exceed the Simplified Lease Acquisition Threshold (SLAT) of $250,000.00 net annual rent [see FAR 2.101, Definitions.]. Simplified lease acquisition threshold means the simplified acquisition threshold (see FAR 2.101), when applied to the net average annual amount of rent for the term of the lease, including option periods and excluding the cost of services.

Per GSAM 570.402-1(a), if the value of the lease extension does not exceed the SLAT, the justification and approval requirements in FAR 6.3 do not apply, and the only requirements are the simplified procedures in GSAM 570.2 and an explanation of the absence of competition in the file.

APHIS has a continuing need and has occupied the above referenced space under Lease No. LHI01592, since August 1, 2007. A succeeding lease is required to support the agency’s mission at the Daniel Inouye Airport (HNL),at

Honolulu, Hawaii.

If other space was leased through the competitive process, the Government would incur relocation costs for a new lease. Not only does such a move create administrative hardships, it will interrupt the agency’s operations. The agency has provided a mission based reason for remaining On-Airport.
