Justification for Other than Full and Open Competition, Lease Extension
U.S. General Services Administration
GSA Region 4
Leasing Division – Branch 4PLF
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
LEASE NUMBER: GS-04B-59827
PROJECT NUMBER: 9FL2478
Agency Name: Social Security Administration-SSA
1. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED.
The Social Security Administration currently leases 6,296 Rentable Square Feet (RSF) with a Common Area Factor (CAF) of 1.190620272, yielding 5,288 ANSI BOMA Office Area square feet (ABOA) at the Location Code (FL2405ZZ), Senate Square Building 14361 Commerce Way, Miami Lakes, Florida 33014, under lease number GS-04B-59827 for the SSA. The current lease expires August 02, 2020.
Approval is requested to extend the current lease for TWO (2) years with the incumbent lessor without full and open competition. The agency is planning to close this office and does not need a long term lease.
Additionally, the extension will avert the Government from placing itself in a high risk holdover situation and occupying space without the proper lease contract in place.
2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED.
It is advantageous for the Government to secure 6,296 RSF of office space with the incumbent in order to satisfy the Social Security Administration’s mission and prevent disruption in its operations.
The short term requirement is to complete a 2 year extension. The estimated cost for such is:
3. IDENTIFICATION OF STATUTORY AUTHORITY.
41 U.S.C. 3304(a) (1): Only one responsible source and no other supplies or services will satisfy agency requirements. FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements.
4. DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.
GSAM 570.402-4 allows that if the contracting officer does not identify any potential acceptable locations through advertisement or via the market survey, to prepare a written justification to negotiate directly with the present Lessor.
5. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICAL.
Market research was performed on July 25, 2019 using CoStar report and the research did not identify any acceptable locations that met or could meet the space requirements of 6,296 RSF (5,288 ABOA) of contiguous sq. feet of space with the exception of the incumbent.
6. DESCRIPTION OF MARKET RESEARCH CONDUCTED.
As outlined above, market research was conducted by searching CoStar report. All research led to the same conclusion that there are zero locations that met or could meet the requirements of the agency.
7. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.
SSA Agency Office has occupied the above referenced space under Lease No. LFL59827 since August 3, 2010. A short-term extension is required to allow time for SSA Agency Office closure.
There are no outstanding issues and the current space has no fire or life safety deficiencies and the option does not include an increase in square footage. The incumbent Lessor, Graham Companies, The.
is the responsible party and is meeting the requirements of the lease.
8. LIST OF SOURCES THAT EXPRESSED INTEREST IN THE ACQUISITION.
INCUMBENT – The Graham Companies, Senate Square Building 14361 Commerce Way, Suite 3400, Miami Lakes, FL 33016-1565
9. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION.
Competition is not required for office closure.
10. TECHNICAL REQUIREMENTS PERSONNEL CERTIFICATION
I certify that the supporting space requirements data used to form the basis of this Justification is complete and accurate to the best of my knowledge and belief.

11. CONTRACTING OFFICER CERTIFICATION AND DETERMINATION THAT THE ANTICIPATED
COST WILL BE FAIR AND REASONABLE.
Therefore, as the rate quoted by the incumbent Lessor falls within market range and the lack of additional response from other interested parties, the Contracting Officer determines that the short term extension is in the best interest of the Government and the above quoted rate is fair and reasonable.
