Millennium Challenge Corporation Request for Quotation (RFQ) No. 95332420Q0067
Amendment 0001 Questions and Answers
1. estion: Is this is a new requirement, or is there a current or previous contractor who has performed similar services? If available, can you please send along the incumbent contract or task order number?
Answer: This is a new requirement and there is no incumbent contractor.
2. Question: On Page 42 of the solicitation it is said about Past Performance: "The Technical Quotation shall also include information on at least three (3) current or past projects of similar scope and size that demonstrate the offeror's capability to perform the scope of work identified in Section C." Is this referring to the past performance of a firm, or the past performance of the team put together by a firm to perform the work?
Answer: This is referring to the past performance of a single firm/offeror i.e., the prime contractor. However, one of the three past performance references may be for a significant subcontractor/partner, if applicable.
3. Question: In case one single firm cannot fulfill all the requirements set forth in the solicitation, can multiple firms team up to submit a quotation with one of them representing the consortium?
Answer: Yes, multiple firms can team up to submit a quotation, with one firm representing the consortium as the prime. The prime offeror should clearly identify all subcontractors in their quotation. If the quotation is successful, MCC will issue the contract to the prime offeror; there would be no contractual relationship between MCC and the subcontractor firms.
4. Question: As per the RFQ instructions, we would appreciate to have a clarification with regard to sample analysis submission. A sample market structure analysis and a sample political economy analysis are requested.
Some of the work produced relating to market structures and political economy issues in the transport sector are highly sensitive and confidential as they tend to inform public or private sector decision-making in high stakes environments. We would appreciate clarifications on how confidentiality is guaranteed regarding the sample of work requested to be shared with MCC.
Answer: Upon receipt of quotations, MCC establishes a Technical Evaluation Panel (TEP) for review of said quotations. Each TEP member must sign a "Source Selection Participation Agreement" that covers the rules of conduct regarding conflicts of interest and safeguarding of confidential information. Specifically, the agreement states the following with regard to confidentiality:
"In accordance with Title 48, Code of Federal Regulation Part 3, Subpart 3.1, Section 3.104-4, I will not knowingly disclose any proposal/quote information or evaluation or source selection information regarding this acquisition directly or indirectly to any person other than a person authorized by the Contracting Officer to receive such information."
Note: The following individuals are generally authorized by the Contracting Officer to receive source selection information (including the contents of quotation submissions): (1) Members of MCC's Contracts and Grants Management Division who are working on the procurement and/or must review the source selection decision prior to award in accordance with standard internal procedures (typically a total of 2-3 people); (2) MCC's Procurement Attorney in the Office of General Counsel; and (3) Individuals specifically appointed as TEP members who must sign the aforementioned "Source Selection Participation Agreement."
Further, the Agreement states the following with respect to its continued applicability after the source selection
95332420Q00670001 process is complete:
"I will not discuss evaluation or source selection matters, including proposal/quote information, with any unauthorized individuals (including Government personnel), even after the announcement of the successful contractor, unless authorized by the Contracting Officer. All discussions of evaluation and source selection matters with other evaluation members shall be conducted solely in those areas designated for deliberations."
In addition to these internal safeguards, MCC encourages offerors to mark their confidential information with appropriate disclaimers (on the cover page or document footer, for instance) to further ensure its proper treatment.
