USHMM RFP #9531-18-R-0900-0002
Security Staffing Q&A update
1. Given that successor offerors will negotiate a new Collective Bargaining Agreement with the union after the first contract period with terms unknown and unknowable at this time and that FAR 52.222-43(b) precludes inclusion of a contingency allowance to cover increased costs, it seems inappropriate for Offerors to provide proposals that anticipate cost of living wage escalations for the contract periods that follow the current CBA, inviting variability and inconsistency in choosing the wage rates for Armed Officers and Control Room Operators among Offerors. For instance, one Offeror might use OY1 rates for the remainder of the contract life since the CBA will be renegotiated, another Offeror might use the 1.5% CPI at a 5-year average to adjust their wage rates, and a third may use the 2.6% historical increase in the CBA to price the years not covered by the CBA. To reduce potential confusion, we request that USHMM consider providing all Offerors with direct instructions for pricing Armed Officers and Control Room Operators for the years not covered by the CBA and beyond the first contract period.
The request is understandable, and is an excellent articulation of our collective dilemma here. On the one hand, Museum regards rates falling outside the CBA to be a matter of Offeror discretion, subject to the caveats we have already described (see, e.g., Q&A #94) and of course we want to lock in pricing as best we can for the potential full life of the contract. On the other hand, Offerors' discretion is clearly constrained by the SCA and whatever new CBA emerges from good faith, arms-length negotiations. Rather than risk eliminating price competition entirely by dictatinge wage rates, we prefer to remind Offerors of the obligation to state their pricing assumptions (see L.09.5). In this way we'll retain transparency regarding the adopted approach, whatever it may be.
2. Q&A #17 re EXHIBIT 7 - Estimated Staffing Requirements in the RFP reflects 3,328 Console Operator Augmentee hours. However, after the Site Visit, a revised Exhibit 7 - Estimated Staffing Requirements was provided that does not show any Console Operator Augmentee hours. Attendees were informed that the revised Exhibit 7 would be formally provided with the Q&A release. Can USHMM clarify which Exhibit 7 offerors should use?
Exhibits 2 & 7 heretofore provided are replaced and superseded by the attached spreadsheets (XLS and PDF).
3. Q&A #92 - USHMM’s answer to Q&A 92 directs Offerors to bid Armed Officers performing work at the Shapell Center in Maryland as non-union. However, per Section 1.1 of the CBA attached as Exhibit 1, this facility falls under the union agreement where it states, “The Employer hereby recognizes the Union as the exclusive

The above location is hereinafter referred to as “site.” Can USHMM clarify if offerors should use Exhibit 1 USHMM CBA (2017) for pricing CLIN 0013 Armed Officer (Shapell Campus), CLIN 0014 Temporary Additional Services (Shapell Campus), and CLIN 0015 Training (Shapell Campus)?
We hereby correct our response to Q&A #92 to “yes.” The Shapell Center *does* fall under the current CBA.
