Justification for other than full and open competition 41 U.S.C 3304(a)(3) and FAR 6.300
(1) Identification of the agency and the contracting activity: Commodity Futures
Trading Commission, Financial Management Branch.
(2) Nature and/or description of the action being approved. Purchase of meals for a conference.
(3) A description of services required to meet the agency’s needs (including the estimated value).
The Office of Customer Education and Outreach requires three meals (dinner, breakfast, and lunch) for the 2018 Agricultural Conference (AgCon 2018) in Overland Park, KS on April 5th and 6th, 2018.
The CFTC seeks to award this requirement to the Overland Park Development Corporation (dba Sheraton Overland Park).
The total value of this purchase is $36,531.25
(4) An identification of the statutory authority permitting other than full and open competition. FAR 13.106(b)(1)(i) - (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
(5) A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
This conference is being held at the Sheraton Overland Park (Overland Park Development Corporation). The Sheraton Overland Park hotel does not allow outside catering on its premises, and the Commission must therefore procure the planned meals for AgCon 2018 from the Sheraton Overland Park.
(6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Other vendors were not solicited for this effort.
This action was publicized in accordance with FAR 5.102.
(7) A determination by the Contracting Officer that the anticipated cost to the
Government will be fair and reasonable. The Contracting Officer has determined the cost to the Government is fair and reasonable.
(8) A description of the market research conducted and the results or a statement of the reason market research was not conducted. There are other catering services in the area with comparable rates. However, the Sheraton Overland Park does not allow outside catering vendors into its space.
(9) Any other facts supporting the use of other than full and open competition.
None.
(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
None.
(11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. When possible, CFTC will make every effort to compete future conference related purchase orders.
