About this file

This document is a Federal Acquisition Regulation (FAR) Part 13 Determination to Solicit from a Single Source for contract number 951700-25-P-0034. The U.S. Agency for Global Media (USAGM) is seeking a qualified audit and compliance consulting firm to conduct a comprehensive financial review of five non-federal entities, including a full accounting of money spent by grantees through subgrants, contracts, fellowships, and non-profits.

The scope of work includes desk reviews, cost allowability evaluations, and on-site visits (both domestic and international) to ensure expenditures comply with federal statutes, cost principles, and administrative regulations. The agency has justified a sole-source procurement under the "unusual and compelling urgency" criteria, citing the vendor's prior experience with these specific grantees and an existing understanding of USAGM's grant oversight framework. The final deliverable will be a detailed audit report with findings, recommendations, and documentation reviews. While this acquisition is being awarded non-competitively, USAGM indicates it will conduct market research and potentially compete similar requirements in future procurements.

FEDERAL ACQUISITION REGUALTION (FAR) PART 13 DETERMINATION TO

SOLICIT FROM A SINGLE SOURCE

(SIMPLIFIED ACQUISITION PROCEDURES)

CONTRACT Number: 951700-25-P-0034

1. FAR 13.106-1(b) states that contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source to be reasonably available.

2. I determine only one source to be reasonably available based one of the following circumstances as described by FAR 6.302:

Only one responsible source and no other supplies or services will satisfy Agency requirements.

Unusual and compelling urgency

Expert Services

International agreement

Authorized or required by statute

National security

Public interest

3. The U.S. Agency for Global Media (USAGM) requires the services of a qualified audit and compliance consulting firm to conduct a comprehensive financial review of five (5) non-federal entities. The contractor will provide a full accounting of all money spent by grantees, including subgrants, contracts, fellowships, and non-profits. The effort includes desk reviews, cost allowability evaluations, and on-site visits (domestic and international) to ensure expenditures are in compliance with applicable federal statutes, cost principles, and administrative regulations.

The final deliverable will be a detailed audit report that includes findings, recommendations, and documentation reviews.

4. This acquisition is being conducted under the authority of FAR13.106-1(b)(1)(i) – Soliciting from a single source, which permits the use of non-competitive procedures when the contracting officer determines that the circumstances of the contract action deem only one source reasonably available, and the acquisition does not exceed the simplified acquisition threshold (SAT).

Due to the specialized nature of the requirement, the agency has identified a source that has prior experience auditing these specific grantees and an existing understanding of USAGM’s grant oversight framework. Awarding to this source will ensure continuity, reduce duplication of effort, and allow for expedited execution under tight time constraints.

Competing this requirement would introduce delays and a learning curve that could compromise the timeliness and quality of the review. This is particularly critical due to upcoming reporting deadlines and oversight obligations from federal stakeholders.

5. While this acquisition is being awarded non-competitively, future requirements of a similar nature may be competed when time allows. USAGM routinely conducts market research and will continue to evaluate additional sources for subsequent audit support services.

6. Market research was conducted via the System of Award Management database and General

Services Administration Schedule 541611 vendors to determine the availability of qualified firms under the SAT. While several firms offer general financial audit services, only a limited number demonstrated prior experience with foreign assistance grantee audits and the specific compliance standards applicable to this program.

7. Note that this determination satisfies the requirements of FAR 13.106-1(b) & FAR 13.106-

3(b)(3)(i). The requirement to prepare a written justification in accordance with FAR 6.303 does not apply to purchases using simplified acquisition procedures.

8. In accordance with FAR 5.202(a)(2), the contracting officer need not submit the notice required by FAR 5.201 when the decision to solicit from a single source is based on unusual and compelling urgency and complying with the time periods specified in FAR 5.203 would injure the Government.
