QUESTIONS & ANSWERS- FURTHER CLARIFICATION

Further clarification was requested on the answers previously provided.

Q: Is there a requirement to include contractor information such as DUNS number, representations and certifications, and exceptions and deviations?

A: Please refer to Section E 52.212-1 Instructions to Offerors -- Commercial Items. (Jan 2017), and Attachment D.10, Offeror Instructions and Evaluation.

Further clarification:

FAR 52.212-1(b)(8) requires “a completed copy of the representations and certifications at FAR

52.212-3 (see FAR 52.212-3(b)) for those representations and certifications that the offeror shall complete electronically.”

FAR 52.212-3(b)(2) requires that the offeror has completed the annual representations and certifications electronically via the System for Award Management (SAM) which can be accessed at https://www.sam.gov/SAM/. Submission of an offer constitutes verification by the Offeror that the representations and certifications posted electronically have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation. If there are no exceptions, completion of the annual representations and certifications electronically in SAM is sufficient to meet the requirements of this solicitation.

If there are exceptions to the representations and certifications posted electronically in SAM, those exceptions shall be identified in accordance with FAR 52.212-3 paragraphs (c) through (u), and submitted as part of the offer. Any changes provided by the offeror are applicable to this solicitation only, and do not result in an update to the representations and certifications posted electronically on

SAM.

FAR 52.212-1(b)(5) requires offerors to show the terms of any express warranty included as part of the offer. Warranty, as defined in FAR 2.101 Definitions, “means a promise or affirmation given by a contractor to the Government regarding the nature, usefulness, or condition of the supplies or performance of services furnished under the contract.” If the Offeror includes a warranty in its offer, the terms of said warranty should be clearly stated.

Q: Should the pricing section, Volume I – Price Factor, be attached to the whole proposal, or separated as an individual attachment?

A: Please refer to Attachment D.10, Offeror Instructions and Evaluation, Section B, “Offerors shall prepare a separate document for each evaluation factor that contains all the requested information and details…”

Further clarification:

For each factor (Price Factor, Technical Factor, and Past Performance Factor) the government expects a separate attachment rather than one attachment containing all factors.
