About this file

This is a Proposal Report for Project 61972, a state and local transportation infrastructure project managed by the Pennsylvania Department of Transportation (PennDOT) for State Route 222 in Berks County. The project involves 4.5 miles of reconstruction and widening of roadway, providing two twelve-foot lanes, one ten-foot outside shoulder, and one four-foot inside shoulder in each direction, along with a center median barrier, bridge replacement, and roundabouts at Richmond Road and Pleasant Hill Road. The project is located in Richmond and Maidencreek Townships from approximately Shaeffer Road to the Kutztown Bypass. The bid package includes extensive work items across clearing and grubbing, demolition of 29 parcels, excavation (189,381 cubic yards of Class 1 excavation), asphalt paving operations with multiple mixture types and depths, drainage infrastructure including reinforced concrete pipes ranging from 14 inches to 36 inches in diameter, concrete structures, guide rails and barriers totaling over 42,000 linear feet, sign and lighting installations, traffic control and management, erosion and sediment control measures, and specialized construction including bridge structure work. The scheduled let date is November 5, 2026, with an anticipated Notice to Proceed of December 21, 2026, and required completion by October 26, 2032. No pre-bid meeting is scheduled, and prequalification is required for bidders.

The project cost range is $80,000,000 to $89,999,999.99, classified as a Standard project type with Federal funding oversight through PennDOT. The project requires wage rate compliance and includes 5 percent structure work requirements. The DBE (Disadvantaged Business Enterprise) participation goal is 0 percent. The project is subject to federal provisions including the Build America, Buy America Act, which mandates that all iron, steel, manufactured products, and construction materials be produced in the United States, with limited exceptions not to exceed $1 million or 5 percent of total applicable costs. Significant liquidated damages apply for traffic delays, including Road User Liquidated Damages (RULD) assessments ranging from $1,500 to $3,500 per day depending on the detour stage and timeline. The project incorporates extensive environmental compliance requirements including erosion and sediment pollution control plans, post-construction stormwater management, infiltration testing, and hazardous material abatement. All addenda will be electronically posted through the ECMS system, and the public bid opening will occur at the Commonwealth Keystone Building in Harrisburg.

b. If the Department needs assistance in any matter arising out of the RTKL related to this Contract, the Department will notify the Contractor using the legal contact information provided in this Contract. The Contractor, at any time, may designate a different contact for such purpose upon reasonable prior written notice to the Department.

c. Upon written notification from the Department that it requires assistance in responding to a request under the RTKL for information related to this Contract that may be in the Contractor’s possession, constituting, or alleged to constitute, a public record in accordance with the RTKL (“Requested Information”), the Contractor will:

1. Provide the Department, within 10 calendar days after receipt of written notification, access to, and copies of, any document or information in the Contractor’s possession arising out of this Contract that the Department reasonably believes is Requested Information and may be a public record under the RTKL; and

2. Provide such other assistance as the Department may reasonably request, in order to comply with the RTKL with respect to this Contract.

d. If the Contractor considers the Requested Information to include a request for a Trade Secret or Confidential Proprietary Information, as those terms are defined by the RTKL, or other information that the Contractor considers exempt from production under the RTKL, notify the Department and provide, within 7 calendar days of receiving the written notification, a written statement signed by a representative of the Contractor explaining why the requested material is exempt from public disclosure under the RTKL.

e. The Department will rely upon the written statement from the Contractor in denying a RTKL request for the Requested Information unless the Department determines that the Requested Information is clearly not protected from disclosure under the RTKL. Should the Department determine that the Requested Information is clearly not exempt from disclosure, provide the Requested Information within 7 calendar days of receipt of written notification of the Department’s determination.

Add 106.11 BUILD AMERICA, BUY AMERICA ACT PROVISIONS.•

106.11 BUILD AMERICA, BUY AMERICA ACT PROVISIONS—

(a) Build America, Buy America Act. The Federal Bipartisan Infrastructure Law (Public Law 117-58) includes the Build America, Buy America Act that requires all iron, steel, manufactured products, and construction materials used to be produced in the United States.

The term produced in the United States defined as:

1. Iron or Steel Products. All manufacturing processes from the initial melting stage through the application of coatings occurred in the United States according to Section 106.10(a).

2. Manufactured Product. Final assembly of all manufactured products permanently incorporated into the project must be manufactured in the United States.

2.a A manufactured product, not predominantly steel or iron, is defined as an article, material, or supply that has been processed into a specific form and shape, or combined with other articles, materials, or supplies to create a product with different properties than the individual articles, materials, or supplies.

2.b Predominantly steel or iron is defined as greater than or equal to 50 percent of the total cost of the manufactured product.

2.c Manufactured products that are predominantly steel or iron must comply with Buy America provisions according to Section 106.10(a).

2.d If an article, material, or supply meets this definition but could also be classified as an excluded material or other product category, that article, material, or supply is not a manufactured product.

2.e Mixtures of excluded materials delivered to a work site without final form for incorporation into a project are also not manufactured products.

2.f Manufactured products where the final assembly did not occur in the United States may be used, provided the cumulative cost of such manufactured products is no more than the lesser of $1 million or 5% of total applicable costs for the project.

3. Construction Materials.

CHANGES TO SPECIFICATIONS: SECTIONS 313, 314, 360, 410, 412, and 413

Provision Body:

SECTION 313—SUPERPAVE ASPHALT MIXTURE DESIGN, STANDARD CONSTRUCTION, BASE COURSE

Section 313.3(m) Tests for Depth. Revise to read as follows:•

(m) Tests for Depth.

(m) Tests for Depth. Replace with the following:

Control the loose depth of each layer to construct the base course to the compacted depth indicated and within the specified tolerance. On the top lift and in the presence of the Inspector, drill full-depth cores at one random location selected by the Inspector according to PTM No. 1 in each 3,000 square yards of completed base course and at other locations the Inspector suspects are deficient. After the Inspector completes depth measurements, backfill, compact, and seal core holes with the mixture used to construct the course.

The Inspector will measure the full-depth cores according to PTM No. 737. Pavement deficient in depth by 1/2 inch or more and that cannot be satisfactorily corrected is defective. Immediately delineate the limits of pavement deficient in depth from the core location by proceeding longitudinally, forward and backward, obtaining additional pavement cores every 50 feet until the depth is less than 1/2 inch deficient of the design depth. The defective course will be the full width of the affected lane.

SECTION 314—SUPERPAVE ASPHALT MIXTURE DESIGN, STANDARD CONSTRUCTION, ASPHALT RICH BASE COURSE

Section 314.3(m) Tests for Depth. Revise to read as follows:•

(m) Tests for Depth.

(m) Tests for Depth. Replace with the following:

Control the loose depth of each layer to construct the ARBC to the compacted depth indicated and within the specified tolerance. In the presence of the Inspector, drill full-depth cores at one random location selected by the Inspector according to PTM No. 1 in each 3,000 square yards of completed ARBC and at other locations the Inspector suspects are deficient. After the Inspector completes

Page 27 of 120September 22, 2026 14:39:24 PM depth measurements, backfill, compact, and seal core holes with ARBC.

SECTION 360—ASPHALT TREATED PERMEABLE BASE COURSE

Section 360.2(e)3. Production. Revise to read as follows:•

3. Production. During the first day of production, take at least three asphalt content and gradation tests to verify the mixture conforms to the JMF. After the first day, perform tests for asphalt content and aggregate gradation according to the QC Plan and PTM No. 1. Produce ATPBC conforming to the gradation requirements in Table A and with an asphalt content within 0.8% of the JMF (n=1). Ensure the aggregate is uniformly coated with asphalt and no runoff of excess asphalt is observed.

Section 360.3(m). Tests for Depth. Revise to read as follows:•

(m) Tests for Depth: Binder and Wearing Courses. Replace with the following:

Carefully dig or drill one random 6-inch diameter test hole selected by the Representative according to PTM No. 1 to the full depth of the ATPBC for each 3,000 square yards, or less, of completed base course. The Representative may require additional test holes in areas the Representative suspects are deficient in depth. The Representative will measure the depth of the base course. Using material acceptable to the Representative, backfill the test holes and compact the material to fill the test hole flush with the completed base course.

ATPBC deficient in depth by 1/2 inch or more is defective. Immediately delineate the limits of ATPBC deficient in depth from the location by proceeding longitudinally, forward and backward, obtaining additional test holes every 50 feet until the depth is less than 1/2 inch deficient of the indicated depth. The defective course will be the full width of the affected lane.

PTM No. 757 $500 $2,000

* For full lots (n ≥ 3) where the original test results indicated a defective lot, only the pay factor(s) where original test results indicated a defective lot for asphalt content or percent passing the 75 μm (No. 200) sieve will be utilized to determine the retest cost.

** For partial lots (n < 3) where the original test results indicated a pay parameter (asphalt content, percent passing the 75 µm (No. 200) sieve, or both) did not meet the Single Sample (n = 1) requirements in Table B, only the pay parameter(s) that did not meet the Single Sample (n =1) requirements will be utilized to determine the retest cost.

SECTION 413—SUPERPAVE MIXTURE DESIGN, STANDARD AND RPS CONSTRUCTION OF PLANT-MIXED ASPHALT

COURSES WITH PERCENT WITHIN LIMITS AND LTS TESTING (PWS-LTS)

Section 413.2(e)1. Recycled Asphalt Material. Revise to read as follows:•

1. Virgin Material Mixtures. Size, uniformly grade, and combine aggregate fractions, asphalt binder, and either WMA Technology additive(s) or modifier(s) in proportions to produce a JMF that conforms to the material, gradation, and volumetric Superpave Asphalt Mixture Design requirements according to Bulletin 27, Chapter 2A. Produce an asphalt mixture for the specified nominal maximum aggregate size and design ESALs except as procedurally modified by the WMA Technology Manufacturer Technical Representative (Technical Representative) to address laboratory procedures when preparing, compacting and testing asphalt mixtures to achieve a uniform blend. Special additive(s) or modifier(s) need not be used if mixture temperature, workability, and compaction can be achieved solely through plant mechanical modification to produce foamed asphalt. Do not incorporate the WMA Technology additive, modifier or process during the volumetric asphalt mixture design process, so that the JMF volumetrics and material percentages are based on a mixture with no WMA Technology. Only use the WMA Technology additive, modifier or process to evaluate results from moisture susceptibility testing during the mix design process.
