The Department will advise the public of these restrictions and possible delays.

Notify property owners ten (10) calendar days in advance of driveway restrictions affecting their properties.

Provide all property owners and/or residents affected by construction written notification of impending work. Provide information in accordance with the Special Provision entitled “Public Notification.”

Coordinate with any local events taking place during the duration of the project.

Coordinate work with projects in or near the limits of work. No time extensions will be given in this contract, due to delays on work to be performed by others.

Coordinate all electrical work associated with Item 9000-0003 “Remove and Reset Highway Lighting Pole” with the City of Nanticoke Department of Public Works. See Special Provision entitled “Item 9000-0003 Remove and Reset Highway Lighting Pole” for additional information.

Obey local municipality ordinances related to noise, working hours, and all other construction activities.

Right-Of-Way must be staked out within ten (10) days of Notice to Proceed.

Survey and record all existing pavement locations, elevations, and breakpoints within proposed mill and overlay sections prior to performing any milling operations. Proposed pavement to match existing pavement locations, elevations, breakpoints, and cross slopes within proposed mill and overlay sections.

Record all existing pavement markings prior to the start of any excavation, milling, or paving operation. Proposed pavement markings to match existing locations within proposed mill and overlay sections.

Submit all concrete mix designs at the pre-construction conference.

Submit all asphalt mixture designs for Department approval a minimum of two (2) weeks prior to the first placement. If more than one asphalt supplier is used, ensure that each source has Department-approved mix designs.

As soon as possible after receiving Notice to Proceed, schedule field utility meeting with all affected utility companies to coordinate aerial utility relocations, associated tree trimming needs for aerial utility relocation, and project construction schedule. Coordinate tree trimming needs with affected utility companies in advance of performing tree trimming work. Perform tree trimming work prior to tree cutting restriction. Stake new utility pole locations for UGI Electric Company as indicated on Contract Drawings.

All underground utility relocations will be PRIOR work and all aerial utility relocations will be COORDINATED work. Existing and relocated utility relocations shown on the Contract Drawings are approximate and are for reference only.

An initial PA One Call must be placed, and a meeting with all necessary parties scheduled within ten (10) days of when contract work is to begin.

August 26, 2026 10:51:37 AM Page 12 of 89

Be responsible for protecting all utilities within the construction area. Be responsible for any damages to existing utilities caused by construction operations. Contact the applicable authority immediately in the event of any damage.

Provide to the Department confirmation of fabrication and scheduled delivery of the precast box culvert, precast end sections, and precast cutoff walls prior to the implementation of the detour.

For list of detour coordination contacts, as well as for additional information and project restrictions, see Special Provision entitled “Item 0901-0001 Maintenance and Protection of Traffic During Construction.”

Road User Liquidated Damages will be assessed on this project in accordance with the specifications established in the Special Provision entitled “Road User Liquidated Damages (RULD),” which provides detour date and duration restrictions as well as RULD amounts.

Submit any alternate work plan along with proposed methods of traffic control a minimum of two (2) weeks prior to the pre-construction conference for Department review and approval. Submit alternate plans only when a time savings or significant benefit to the Department is approved.

For night work, provide the necessary number of illumination devices to satisfactorily illuminate the work area. Illuminate the work area to the satisfaction of the Department Representative. Illumination devices will be considered incidental to the item of work being performed and will not be paid separately. For additional night work requirements, see Special Provision entitled “Item 0901-0001 Maintenance and Protection of Traffic During Construction.”

Complete all paving work, including the final wearing course, prior to removing the detour and opening SR 2008 to traffic.

All pavement joints, including longitudinal joints, are to be sealed.

Complete all permanent pavement markings within 3 calendar days of placing the final wearing course and prior to removing the detour and opening SR 2008 to traffic.

Maintain access to all driveways at all times. Maintain access to Facilities Rd at all times. Do not store any material or equipment on Facilities Rd or on any existing driveway.

Maintain access to Birchwood Rehabilitation and Healthcare Center at all times.

Construct the project in accordance with all mitigation commitments specified on the ECMTS matrix.

Comply with all non-Department permits as well as the construction schedule as required in this contract.

This project is located within the vicinity of the Northern Long-Eared Bat, the Indiana Bat, and the Tricolored Bat Summer Occupancy Habitat. To ensure take is not reasonably certain to occur, do not conduct tree trimming or removal from April 1 to November 15.

Avoidance and Minimization Measures for the project include:

- Make all operators, employees, and contractors working in areas of Northern Long-Eared Bat, Indiana Bat, and Tricolored Bat suitable habitat aware of all Transportation Agency environmental commitments, including all applicable Avoidance and Minimization measures.

- Ensure tree removal/trimming is limited to that specified in project plans and ensure that contractors understand clearing limits and how they are marked in the field (e.g., install bright colored flagging/fencing prior to any tree removal/trimming to ensure contractors stay within clearing limits).

- Ensure tree removal/trimming is limited to the inactive season, occurs within 100 feet of the road, and is outside of documented habitat for the Northern Long-Eared Bat, Indiana Bat, and Tricolored Bat.

Due to the presence of Palustrine Forested Wetlands on each side of SR 2008, no access roads are permitted at this project site and no equipment is permitted beyond toes of proposed roadway fill slopes or in wetland areas. Perform all work from roadway above or within proposed excavation limits, including the placement of rock. Place streambed material on apron from roadway above and place it in culvert without the use of equipment. Place streambed material inside culvert and on aprons before guide rail is installed.

Grubbing is prohibited within temporarily disturbed wetland areas. All tree trimming must be performed from the roadway. Do not disturb existing trees or other vegetation beyond the grading limits unless noted otherwise on the plans. Do not remove trees within any wetland areas to remain, including wetland areas that have temporary impacts.

Prior to start of work, and as indicated in the contract drawings, install Temporary Protective Fencing around wetland areas to avoid impacts to wetlands in the project area not slated for impact.

August 26, 2026 10:51:37 AM Page 13 of 89

The temporary impacted wetland areas will be restored on-site by restoring grade and seeding with Formula W where necessary.

Except for within the work area between the temporary diversion dams, maintain flow in Espy Run at all times.

Construct sedimentation control devices in affected work area prior to performing clearing and grubbing operations, as approved by the Project Manager. Satisfactorily remove all sedimentation control devices when adequate stabilization has occurred, as directed by the Project Manager, and in accordance with the Erosion and Sediment Pollution Control Plan.

Inspect all erosion and sediment pollution control devices daily and after each rainstorm that results in runoff. The Department will monitor these inspections. Repair or replace any defective devices prior to resuming construction activities.

Maintain drainage structures and drainage courses to be functional throughout construction of the project.

The work area is to be maintained in a neat and orderly condition. Remove all debris from the work area at the close of each day’s operations.

As indicated on the approved Erosion and Sediment Pollution Control Plan, place a concrete washout and perform concrete truck washing at an approved off-site location. Be responsible for ensuring all offsite washout locations have approved Erosion and Sediment Pollution Control Plans and associated permits. The Department has not provided additional time in the contract for acquiring areas for the concrete washout and/or permits for these areas.

There are no on-site waste areas. The contractor will be responsible for hauling all excess spoils to an offsite location(s). Be responsible for ensuring all offsite waste areas have approved Erosion and Sediment Pollution Control Plans plans and associated permits. The Department has not provided additional time in the contract for acquiring waste areas and/or permits for these waste areas.

Protect any material being hauled to or away from the construction site. Cover any loads which create dust or other undesirable conditions. Loads of waste material emitting any liquid drippings are not allowed on any public roadway. Clean or sweep debris left from construction activities on any public roadway with a street sweeper or broom to the satisfaction of the Representative at no additional cost to the Department.

No additional contract time will be permitted for alternate temporary stream diversion concept submissions, review or permitting. The contractor is responsible for acquiring Department acceptance for all alternate temporary stream diversion submissions prior to submitting for a DEP permit modification. A minimum of 5 calendar days of review time is required by the Department for each contractor submission. The contractor is required to provide the Department with all waterway permit modification documents for submission to DEP. All permit modification submissions will be made by the Department through the KEES system. The Department is not responsible for permit review times required by DEP.

The term produced in the United States defined as:

1. Iron or Steel Products. All manufacturing processes from the initial melting stage through the application of coatings occurred in the United States according to Section 106.10(a).

August 26, 2026 10:51:37 AM Page 19 of 89

2. Manufactured Product. Final assembly of all manufactured products permanently incorporated into the project must be manufactured in the United States.

2.a A manufactured product, not predominantly steel or iron, is defined as an article, material, or supply that has been processed into a specific form and shape, or combined with other articles, materials, or supplies to create a product with different properties than the individual articles, materials, or supplies.

2.b Predominantly steel or iron is defined as greater than or equal to 50 percent of the total cost of the manufactured product.

2.c Manufactured products that are predominantly steel or iron must comply with Buy America provisions according to Section 106.10(a).

2.d If an article, material, or supply meets this definition but could also be classified as an excluded material or other product category, that article, material, or supply is not a manufactured product.

2.e Mixtures of excluded materials delivered to a work site without final form for incorporation into a project are also not manufactured products.

2.f Manufactured products where the final assembly did not occur in the United States may be used, provided the cumulative cost of such manufactured products is no more than the lesser of $1 million or 5% of total applicable costs for the project.

3. Construction Materials.

SECTION 107—LEGAL RELATIONS AND RESPONSIBILITY TO THE PUBLIC

Section 107.28 EROSION AND SEDIMENT POLLUTION CONTROL PLANS AND PERMITS. Revise to read as follows:

107.28 EROSION AND SEDIMENT POLLUTION CONTROL PLANS AND PERMITS—Install and maintain erosion and sediment (E&S) pollution control devices as indicated or submit an alternate plan for accomplishing equal or better temporary and permanent erosion and water pollution control. If an alternate plan is submitted, do not start work until the plan is approved by the County Conservation District and the Department. If a National Pollutant Discharge Elimination System (NPDES) Permit is involved, do not start work until the plan is approved by the DEP or the authorized County Conservation District and the Department. Concrete clean out areas, either contractor designed or indicated within the contract documents, are incidental to the contract items.

When a general or individual NPDES Permit is involved:

At the preconstruction conference, submit a Preparedness, Prevention and Contingency (PPC) Plan and identify a licensed professional (Professional Engineer, Geologist, Land Surveyor or Landscape Architect) registered in the Commonwealth and if applicable, their designee to be present onsite and responsible for implementing critical stages of the

CCD.

Within 14 days of completing the construction of a stormwater control measure (SCM) as determined by the licensed professional or designee, submit a completed Chapter 102 SCM Construction Certification Form for each SCM to the Representative through PPCC. Form CS-102 has information required to complete the Chapter 102 Form(s). Ensure the General Project and SCM Information, Construction Information, and Licensed Professional Certification sections are completed by the identified licensed professional responsible for overseeing the critical stages of the approved PCSM plan.

Prepare an as-built (record) PCSM Plan to be sealed and signed by the identified licensed professional registered in the Commonwealth. All construction survey, plan preparation, and engineering required for the as-built (record) PCSM Plan will be incidental to the contract items. The as-built (record) PCSM Plan must accurately reflect deviations from the approved PCSM Plan including, but not limited to, plan locations, dimensions, inverts/elevations, materials used and grading. Update the as-built (record) PCSM Plan as construction of the project’s PCSM features progresses. Have the identified licensed professional immediately notify the Representative of all deviations from the approved PCSM Plan. Deviations to the approved PCSM Plan must be submitted for approval. Assist with the determination and documentation if the as-built deviations require a permit amendment or if the PCSM features must be removed and replaced as indicated on the PCSM Plan.

Assist the Representative in performing visual site inspections weekly and after each precipitation event greater than 0.25 inches to ensure the project's E&S Best Management Practices (BMPs) are functioning properly. Immediately initiate corrective actions, at no additional cost to the Department, upon notification by the Representative of noncompliance with the provisions of this section that the Representative has determined requires immediate corrective action under Department policies. For all other notifications of noncompliance, initiate corrective actions within 24 hours. Failure or refusal to promptly comply with such notice upon receipt may, at the Department’s sole discretion, result in: the withholding payment of estimates for work completed until the requirements of the E&S Plan are met, assessment of E&S noncompliance liquidated damages as specified in Section 108.07(d) or issuance of a written order stopping all or part of the work until the corrective action has been taken and the requirements of the E&S Plan are met. No claims for extension of time, costs, or damages arising from, related to, or based upon such notices of noncompliance or stop orders will be granted, paid, or considered.

Nothing in this Section is to be interpreted to relieve the Contractor of its obligation to fully and timely comply with all applicable laws and any permits for the project. The time periods set forth in this Section do not supersede any more stringent time periods required by applicable laws or permits for the project.

If corrective action or noncompliance with the provisions of this Section result from design errors/omissions or a precipitation event exceeding the design storm criteria as specified in applicable Department publications; the cost and/or time required for the performance of the corrective actions for noncompliance notices or stop work orders will be considered as specified in Section 110.03 and Section 108.06, as applicable.

Utilize Department, DEP, or other authorized agency’s form(s) included in the contract or project permits unless directed otherwise by the Representative, DEP, the County Conservation District or other authorized regulatory agency.

For the purpose of determining compliance with the provisions of this section, “substantial completion” will be considered to have been attained when all of the following project milestones have been reached:

Either a semi-final or final inspection has been performed, physical work is complete, and an Environmental Commitments and Mitigation Tracking System (ECMTS) Sheet has been executed if applicable to the project.

Earth disturbance activity has been permanently stabilized and sufficient vegetative growth has been achieved to meet permit conditions (uniform 70% perennial vegetative cover) and agreed to by DEP or delegated CCD.

Installation of PCSM SCMs have occurred if applicable. Upon completion of PCSM conversions and facilities, the County Conservation District must approve the removal of all remaining E&S BMPs.

Once a project with a general or individual NPDES Permit has reached substantial completion, submit to the Representative a DEP Notice of Termination (NOT) Form ensuring Sections 2, 3, 4, 7 and 8, are fully executed. The NOT is to be accompanied by the required as-built (record) PCSM Plan, the final certification by the licensed professional and the Contractor’s executed portion of the ECMTS Construction Tracking Signature Sheet.
