About this file

This is a Construction Bid Addendum No. 1 issued by the Michigan Department of Technology, Management and Budget's State Facilities Administration Design and Construction Division for the EGLE Jamestown Automotive project in Jamestown, MI (File #761/19135.SAR). The addendum modifies the original bid documents by adding specifications for well abandonment work, with a bid opening date of July 17, 2019. The project involves demolition and remediation work at two structures - a former fire station and library. The scope includes asbestos abatement of multiple materials found in both buildings, including floor tiles, wall adhesives, window caulk, and other materials that were identified through a detailed hazardous materials survey. The work also includes abandonment of one 4-inch potable well estimated at 100 feet depth.

The bid schedule includes 21 line items covering various aspects of demolition, site work, and remediation including geotechnical investigation, structural monitoring, temporary closures, utility work, soil/groundwater removal and disposal, backfill, and surface restoration. A provisionary allowance of $60,000 is included for unforeseen site conditions. The hazardous materials survey identified significant quantities of regulated materials requiring special handling, including asbestos-containing materials and lead-based paint with concentrations up to 24% lead content. Pricing must be provided on a lump sum basis for most items, with some unit pricing for quantities of materials to be removed and disposed.

EXECUTIVE SUMMARY

BDN Industrial Hygiene Consultants, Inc. of Portage, Michigan was retained by Fleis & Vandenbrink, in Grand Rapids, Michigan to conduct a building surveys for asbestos at two structures in Jamestown, Michigan. The intent of the survey was to identify any suspected asbestos-containing building materials and heavy metals in paint coatings prior to demolition. The survey was conducted on May 29, 2019.

Four (4) building materials sampled from the former fire station were found to contain asbestos. An adhesive identified under wood wall panels in the office area, an adhesive identified under Formica wall panels in the restroom, a black floor underlayment in the office area, and 12”x12” floor tile and mastic located on the stairs to the basement.

Two (2) building materials sampled from the former library were found to contain asbestos. The 9”x9” floor tile and mastic located under carpet in the east room and an interior brown window caulk in the west room.

A detailed inventory of building materials, locations and quantities is described within the body of this report and in Appendix C.

The asbestos-containing materials identified in the survey that may be disturbed during demolition activities are required to be removed prior to the commencement of such activities. If suspect ACMs not identified within the report are encountered during renovation activities for which no analytical data exists, BDN recommends the material(s) remain undisturbed until the asbestos content of the material(s) is determined in accordance with USEPA and OSHA regulations.

Four (4) paint samples were collected from the buildings. All the samples collected were found to contain concentrations of regulated heavy metals. The OSHA construction standard does not specifically list a concentration that is considered a hazardous level. Michigan Department of Corrections is obligated to inform contractors that lead and other regulated heavy metals were detected at the site and provide them with a copy of the analytical report. The employer of the construction crews is required to perform monitoring for their employees depending on the scope of work when lead and other heavy metals are present on a jobsite in compliance with the OSHA standard.

INTRODUCTION

BDN Industrial Hygiene Consultants, Inc. of Portage, Michigan was retained by Fleis & Vandenbrink, in Grand Rapids, Michigan to conduct a building surveys for asbestos at two structures in Jamestown, Michigan. The intent of the survey was to identify any suspected asbestos-containing building materials and heavy metals in paint coatings prior to demolition. An inspection is required prior to any demolition or renovation by the US EPA under the NESHAP standard and enforced by the Environmental, Great Lakes & Energy (EGLE) department in the State of Michigan. The survey was conducted by Travis Noa, asbestos inspector accreditation number A38262 and David Steger, asbestos inspector accreditation number A1788 of BDN, on May 29, 2019.

FIELD ACTIVITIES

Field inspection alone is not conclusive to identify asbestos-containing materials. Samples of suspected asbestos-containing building materials were obtained using EPA/OSHA protocols by a State of Michigan, accredited inspector and analyzed to determine if asbestos fibers were present, and if found, the types and percentages of asbestos were reported.

The former fire station is a single-story building with a partial basement. The building consists of a concrete foundation, block walls and steel beam construction. The interior walls are drywall, wood panel, Formica, and concrete block. Flooring consists of concrete, linoleum, and floor tile. The exterior walls of the structure are concrete block. The roof consists of rubber membrane.

The former library is a single-story building. The building consists of a concrete foundation, brick walls and wood beam construction. The interior walls are wood panel. Flooring consists of carpet on concrete, linoleum, and floor tile. The exterior walls of the structure are brick and the roof asphalt shingle.

The buildings were divided into functional spaces, and building materials that could possibly contain asbestos were identified and categorized as homogenous areas.

Representative samples of suspect asbestos-containing materials were collected and locations marked on a diagram, and included with this report as Appendix A - CAD Diagrams. Photographs of asbestos containing materials can be found in Appendix B - Photographic Documentation. The information is also included in Appendix C - Functional Space Summary. The laboratory data for asbestos is presented in this report as Appendix D - Analytical Results - Asbestos. The laboratory data for lead is presented in this report as Appendix E - Analytical Results – Lead.

ANALYTICAL RESULTS

Asbestos Results

Building material samples collected from the both structures were submitted to the asbestos laboratory at BDN Industrial Hygiene Consultants in Portage, Michigan.

Laboratory descriptions of materials analyzed by Polarized Light Microscopy (PLM) method for asbestos content was based upon the microscopists’ visual observations of bulk samples that were homogenized and prepared for analysis. Due to the preparation of the sampled materials and the minute level of observation by the laboratory personnel, the descriptions in the analytical report may not match the sample descriptions recorded by BDN in the field. BDN’s sample descriptions and locations should be used to identify materials that were sampled and BDN’s sample numbers should be used to correlate analytical results for the sampled materials.

REGULATORY COMPLIANCE AND OBLIGATIONS

The OSHA Asbestos Standard for Construction, (29 CFR 1926.1101) and Part 602, the MIOSHA Asbestos Standard, requires that all building facilities (excluding residential owner-occupied homes) constructed prior to 1981, where employees may enter, work, or contact building materials must be inspected for asbestos-containing building materials (ACBM). Also, all such vacant buildings scheduled for renovation or demolition must have an asbestos building survey completed prior to the start of the renovation or demolition.

The survey/inspection must adhere to the Asbestos Hazard Emergency Response Act (AHERA) inspection protocol and be performed by a Michigan accredited asbestos building inspector or Certified Industrial Hygienist (CIH). The building survey must also include the presence, location, and quantity of all suspected ACBM. Additionally, laboratory analysis information should be a part of the building survey document.

Building owners removing asbestos-containing materials from their own structure are not required to be a Michigan licensed asbestos abatement contractor. However, the building owner’s employees performing the work must comply with the requirements of Part 602, the MIOSHA Asbestos Standards for Construction.

The Asbestos Abatement Contractors Licensing Act (i.e., Act 135, P.A. 1986, as amended) requires asbestos abatement contractors and exempt trade groups to notify the MLARA- Asbestos Program of any asbestos abatement project exceeding 10 linear feet or 15 square feet, or both, of friable asbestos materials. This requires a 10-calendar-day notice.

The Notification of Intent to Renovate/Demolish form required by the USEPA NESHAP regulations must be prepared and submitted to the EGLE-AQD at least 10 working days prior to demolition of a building, regardless of whether or not ACMs are present in the building. If ACM is present and included for removal and the quantity is greater than 260 linear feet and/or 160 square feet, a 10 working-day notice is required.

CONCLUSIONS AND RECOMMENDATIONS

If suspect ACMs not identified within the report are encountered during demolition activities for which no analytical data exists, BDN recommends the material(s) remain undisturbed until the asbestos content of the material(s) is determined in accordance with USEPA and OSHA regulations. BDN’s quantities are intended to be “Order of Magnitude” estimates and the estimated quantities and other information in this report should not be used as an exclusive source of information for bid formulation or for notification to regulatory agencies.

It should be noted that many asbestos-containing materials are currently available for purchase and may be inadvertently installed into a building. Some protection can be obtained by reviewing the Safety Data Sheets (SDS) for each suspect material before it is installed in the building. Examples of building materials to check BEFORE installation are:

COPYRIGHT 2019 BDN INDUSTRIAL HYGIENE CONSULTANTS, INC. 5

ceiling tiles, floor tile, roofing materials, dry wall, joint compounds, and any other materials that need to be durable or heat resistant. The manufacturer is required to disclose if a material contains asbestos in the SDS under “Hazardous Materials”. To obtain an SDS for a particular product, contact the merchant or the manufacturer.

The CONTRACTOR shall comply with all federal, state and local laws and ordinances relating to performance of the work. Unless otherwise provided for in these contract specifications or under written directive from the State, all work is to be done in accordance with Part 127, Michigan Water Well Construction and Pump Installation Code, 1978 PA 368, as amended (Act 368), and the specifications described therein.
