About this file
This is a Request for Quotations (RFQ) issued by the Export-Import Bank of the United States (EXIM) to establish Blanket Purchase Agreements (BPAs) for worldwide recovery services.
EXIM seeks qualified vendors to provide collection, servicing, legal enforcement, restructuring, asset protection, and recovery services for EXIM claims involving obligors, guarantors, assets, or enforcement activity located worldwide. The acquisition is conducted under FAR Part 12 (commercial services) and FAR Subpart 13.5 using a best-value tradeoff approach. The solicitation number is 83310127Q0007, with questions due October 28, 2026, and quotations due November 11, 2026, at 10:00am EST. Submissions must be electronic via email to Travis Finkle at travis.finkle@exim.gov. The NAICS code is 541110 (Offices of Lawyers; $15.5 million size standard), and the PSC is R418 (Support, Professional: Legal). The anticipated BPA ordering period is five years, with an estimated aggregate value of approximately $9,000,000 per BPA, though this does not constitute a guaranteed commitment. All communications, quotations, reports, invoices, and deliverables must be in English with pricing stated in United States Dollars.
The Performance Work Statement requires contractors to perform preliminary research and case evaluation, asset searches, credit analysis, extrajudicial collection efforts, litigation management when authorized, credit restructuring, and periodic status reporting. Pricing consists of two CLINs: CLIN 0001 for a firm-fixed-price Due Diligence Fee per assigned case, and CLIN 0002 for contingency fees payable only on successful recoveries. Evaluation emphasizes worldwide geographic coverage and direct international organizational presence, with Factor One (Technical and Management Approach) weighted more heavily than Factor Two (Past Performance), and both significantly more important than Factor Three (Price). Vendors must demonstrate credible operational capability in proposed countries, distinguish between vendor-owned offices (Category 1), affiliated entities (Category 2), established subcontractors/partners (Category 3), and unrelated third parties (Category 4), and submit three or more past performance projects. Key deliverables include a Due Diligence/Recovery Plan within 60 calendar days, extrajudicial collection status reports within 90 calendar days, litigation request forms before litigation expenses, and semiannual litigation/recovery status reports.

Notice: The information collection requirements contained in this solicitation/contract that are not required by regulation have been approved by the Office of Management and Budget under OMB Control No. 3090-0163.
1. REQUEST FOR QUOTATIONS
The Export-Import Bank of the United States (EXIM), Washington, DC, is issuing this Request for Quotations (RFQ) to establish Blanket Purchase Agreements (BPAs) with qualified sources to provide collection, servicing, legal enforcement, restructuring, asset protection, and recovery services for EXIM claims involving obligors, guarantors, assets, or enforcement activity located worldwide.
This acquisition is worldwide in scope. Vendors shall identify the countries in which they can provide credible, timely, and legally compliant recovery services. Broader verified country coverage will be evaluated more favorably, with additional consideration given to coverage delivered through the Vendor's own offices and personnel rather than through unrelated third parties.
The Government intends to acquire these requirements as commercial services using the procedures of FAR Part 12, FAR 13.303, and FAR Subpart 13.5. The Government will evaluate quotations using a best-value tradeoff approach consistent with FAR 13.106-2. Use of FAR Subpart 13.5 is subject to the Contracting Officer's determination, supported by market research, that the anticipated quotations will include only commercial products or commercial services.
1.1 NAICS Code and Product Service Code
• NAICS: 541110 - Offices of Lawyers (size standard: $15.5 million)
• PSC: R418 - Support, Professional: Legal
1.2 Type of Agreement
EXIM intends to establish one or more BPAs. The number of BPAs established, if any, will be based on evaluation results, anticipated competition at the call level, geographic coverage, and the Government's best interests. A BPA is not a contract and does not obligate funds. The Government is obligated only to the extent of authorized purchases made under an awarded BPA.
The Government estimates that the aggregate value of purchases made under each BPA may be approximately $9,000,000 over the BPA period. This amount is provided solely for acquisition-planning purposes and does not constitute a minimum purchase commitment, guaranteed quantity, guaranteed value, or promise of future work. Each individual BPA Call is subject to the applicable ordering limitations of FAR Part 13 and other applicable law and regulation.
EXIM may issue multiple BPA Calls during the BPA period. For purposes of this solicitation, a "BPA Call" means an individual purchase made under a BPA. Each BPA Call will identify the applicable country or countries, case, authorized work, deliverables, schedule, price or ceiling, and other case-specific conditions.
1.3 Communications, Language, and Currency
All communications, quotations, reports, invoices, and deliverables shall be in English. All proposed and awarded monetary values shall be stated in United States Dollars (USD).
1.4 SAM Registration and Invoicing
A vendor must maintain an active registration in the System for Award Management (SAM) at the time of BPA establishment and as required during performance. Additional invoicing instructions will be provided in each BPA and BPA Call.
1.5 BPA Cancellation and Order Termination
Either party may cancel a BPA in whole or in part by providing written notice. Cancellation of a BPA does not, by itself, terminate an existing BPA Call. Any cancellation or termination of a BPA Call will be governed by the terms of that BPA Call and the provisions and clauses incorporated into it, including FAR 52.212-4 when applicable.
1.6 Period of Performance
The anticipated BPA ordering period is five (5) years from the effective date stated in each BPA. The period of performance for each BPA Call will be stated in that BPA Call. Any option or extension applicable to an individual BPA Call will be expressly identified in that BPA Call and exercised in accordance with its terms and applicable FAR requirements.
1.7 Place of Performance
The place of performance may include any country identified in a BPA Call. Work may also be performed at the Contractor's facilities or at EXIM offices in Washington, DC. The Contractor shall furnish all personnel, supervision, facilities, systems, travel, local counsel, and other resources required for performance unless a BPA Call expressly identifies Government-furnished property or information.
2. BPA PRICING AND CALL/ORDER STRUCTURE
CLIN 0001 (Firm-Fixed-Price): Due Diligence Fee applicable to new cases on a per-case basis. Follow-on tasks are not always included with this fee.
CLIN 0002 (Contingency): Percentage of recovered assets, payable only on successful recoveries accepted under the applicable BPA Call.
The following rates are requested for BPA establishment and evaluation. The awarded BPA will state accepted rates or ceilings.
Each BPA Call will establish the final authorized price and payment terms. No work may begin before issuance and acceptance of an authorized BPA Call.
CLIN Description Vendor Proposed Amount
0001 Due Diligence Fee, per assigned case (FFP / NTE ceiling at call level) $________________ per case
0002 Contingency Fee, payable only on recoveries accepted under the BPA Call ________________ %
**Vendors may submit clearly identified supplemental pricing by country, region, bundled case assignment, or optional follow-on task. You can use an additional spreadsheet or other pricing method to as fully and completely detail all of your pricing method and options. Supplemental pricing does not alter the requirement to submit prices for both CLINs above.
Extraordinary or unusual expenses, including litigation expenses outside the authorized scope, are not reimbursable unless approved in writing in advance by the Contracting Officer or another official expressly authorized in the BPA Call.
3. PERFORMANCE WORK STATEMENT
1.0 INTRODUCTION
EXIM seeks loan recovery assistance from recovery firms collecting balances of paid claims under its credit guarantee and insurance programs. The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other non-personal services necessary to perform the work, except for items expressly identified as Government furnished.
2.0 BACKGROUND
EXIM supports the financing of U.S. goods and services and assumes credit and country risks the private sector is unable or unwilling to accept. After payment of a claim, the Asset Recovery Group within the Asset Management Division seeks repayment from debtors and guarantors.
3.0 SCOPE
The Contractor shall provide collection, servicing, legal, and recovery services to support EXIM in collecting outstanding debts and recovering defaulted loan obligations from obligors and guarantors worldwide.
• Borrower negotiations, settlement efforts, and workout agreements;
• Credit restructuring and other recovery-related servicing activities;
• Asset searches, investigations, and due diligence activities;
• Site visits and field investigations, as appropriate;
• Documentation and execution of recovery, restructuring, and settlement agreements;
• Extrajudicial collection efforts and loan recovery services;
• Instituting and managing legal proceedings, litigation, and other legal enforcement actions;
• Seizure, embargo, execution, and enforcement against assets, where legally permitted;
• Periodic written case status reports; and
• Other actions required to effect recovery on behalf of EXIM.
Performance shall demonstrate measurable recovery outcomes, effective cross-border execution, and the ability to perform in the countries for which the Vendor represents it has coverage.
4.0 OBJECTIVES (NATURE OF WORK)
Recover assets, institute legal proceedings, and/or provide credit restructuring related to assigned claims involving debtors and guarantors. Legal proceedings may be instituted only with written approval from EXIM's Office of General Counsel.
5.0 APPLICABLE DIRECTIVES
The Contractor shall maintain knowledge of the applicable judicial and regulatory systems and shall use duly qualified, registered, licensed, or otherwise legally authorized professionals in each jurisdiction where litigation or enforcement activity is performed.
5.1 COMPLIANCE WITH U.S. AND FOREIGN LAW
The Contractor is responsible for identifying and complying with all laws, regulations, licensing requirements, professional-responsibility requirements, judicial rules, sanctions, export controls, anti-corruption requirements, data-protection requirements, labor requirements, tax requirements, and other legal obligations applicable to performance in each jurisdiction.
Nothing in a BPA or BPA Call authorizes an activity prohibited by applicable U.S. law or the law of the country of performance.
The Contractor shall promptly notify the Contracting Officer in writing when any legal, regulatory, licensing, conflict-of-interest, sanctions, data-transfer, or other restriction may affect performance, schedule, cost, or the availability of a proposed resource.
The Contractor shall not commence restricted activity without written authorization from the Contracting Officer and any other approval required by the BPA Call.
6.0 GOVERNMENT-FURNISHED INFORMATION OR PROPERTY
EXIM will provide case-specific information through the COR or other authorized official identified in the applicable BPA Call.
7.0 SPECIFIC REQUIREMENTS/TASKS
The Contractor shall attempt recovery and, when expressly authorized, institute legal proceedings and/or provide credit restructuring services related to assigned claims worldwide.
• Perform preliminary research and case evaluation, including asset searches, credit analysis, and review of legal actions registered against the obligor;
• Attempt extrajudicial collection within the timeframe stated in the BPA Call and report results in an acceptable format; and
• Upon written instruction from EXIM, file or manage legal proceedings against debtors and guarantors when extrajudicial efforts do not fully resolve the claim.
Task 1: Due Diligence
The Contractor shall prepare a written recovery plan addressing research, asset-search results, estimated collectability, proposed strategy, risks, schedule, and required authorizations. Unless otherwise stated in the BPA Call, the report is due within 60 calendar days after BPA Call execution.
Task 2: Contingency Recovery
The Contractor shall report proposed payment or recovery methods and shall be paid a percentage of monies collected only as authorized by the applicable BPA Call and accepted by EXIM.

4. ORDERING PROCEDURES
BPA Calls may be competed among BPA holders determined capable of performing in the applicable country or countries.
EXIM may consider case-specific technical approach, verified country capability, relevant past performance, price, availability, conflicts of interest, response time, and whether performance will be delivered through the BPA holder's own office or through third parties.
The Contracting Officer will identify the response period for each BPA Call request. BPA holders should generally be prepared to submit a BPA Call quotation within two (2) to five (5) business days when stated in the BPA Call request.
The existence of a BPA does not assure a BPA Call. Each BPA Call is subject to applicable competition, funding, authorization, and documentation requirements.
The existence of a BPA does not justify purchasing from only one source or avoiding applicable small-business requirements. If the number of available BPAs is insufficient to ensure maximum practicable competition for a particular purchase, the Contracting Officer may solicit quotations from other sources and may establish additional BPAs in accordance with FAR 13.303-5.
4.1 Conflicts of Interest
For each BPA Call request, the BPA holder shall promptly identify actual or potential conflicts involving the obligor, guarantor, related party, counsel, creditor, transaction, or proposed local resource. EXIM may require mitigation, additional information, or nonparticipation.
4.2 Key Personnel, Offices, and Local Resources
The BPA holder shall identify the office, personnel, counsel, investigators, subcontractors, or other resources proposed for each BPA Call. Substitution of key personnel, offices, or local resources may require prior written approval when stated in the BPA or BPA Call. A Vendor shall not represent unrelated third-party coverage as its own office presence.
5. QUOTATION PREPARATION AND SUBMISSION
Vendors shall submit all information required by this RFQ electronically in PDF format to Travis Finkle at Travis.Finkle@exim.gov by the date and time stated on the cover page. Technical and price quotations shall be separate. The technical quotation shall not contain pricing information.
5.1 Technical Quotation
• Company name, address, UEI, CAGE Code, business size, and active SAM status;
• Technical and Management Approach responsive to the worldwide PWS;
• Completed Worldwide Capability Summary and Country Coverage Matrix;
• Identification of every country proposed for coverage and the delivery model for each country;
• Identification of Vendor-owned or controlled offices, including address, years established, and core personnel;
• Identification of affiliated offices and unrelated third-party firms, local counsel, subcontractors, investigators, or operational partners;
• Explanation of processes for licensing, legal authorization, conflicts, quality control, data protection, and oversight across jurisdictions;
• Past Performance submission responsive to Factor Two;
• Proposed key personnel and qualifications; and
• Disclosure of known actual or potential organizational conflicts of interest.
5.2 Country Coverage Evidence
For each proposed country, the Vendor shall classify its coverage using one of the following categories and provide supporting detail:
• Category 1 - Vendor-owned or Vendor-controlled office with established personnel and operational capability in the country;
• Category 2 - Office of a legally affiliated entity within the Vendor's corporate organization;
• Category 3 - Established subcontractor, local counsel, or formal partner under a current written arrangement; or
• Category 4 - Other unrelated third-party resource or proposed ad hoc arrangement.
The Vendor shall distinguish current, operational coverage from planned or contingent coverage. Unsupported country lists, marketing-network claims, or statements that resources will be identified after award may receive little or no favorable consideration.
For evaluation purposes, “Vendor-owned or Vendor-controlled office” includes a headquarters, branch, regional, or satellite office over which the Vendor has direct ownership or legally enforceable managerial control and from which the Vendor maintains established personnel and operational capability. An affiliated entity, member firm, correspondent firm, network participant, subcontractor, local counsel, referral relationship, or unrelated third-party resource shall not be identified as a Vendor-owned, Vendor-controlled, branch, regional, or satellite office. The Government may request documentation sufficient to verify the claimed ownership or control, physical presence, staffing, operational history, and capability.
5.3 Price Quotation
• Completed pricing sheet for CLINs 0001 and 0002 or alternate proposed pricing plan;
• Any supplemental pricing by country, region, bundle, or optional task;
• Acknowledgment of amendments; and
• Statement that pricing is in USD and remains valid for the required acceptance period.
5.4 Submission Compliance
A quotation that fails to provide material information required for evaluation may be found unacceptable. Responses that merely repeat RFQ language or promise compliance without supporting detail may be assessed as insufficient. EXIM may verify claimed offices, affiliations, country capability, and past performance.
6. EVALUATION FACTORS AND BASIS OF AWARD
The Government will evaluate quotations using a best-value tradeoff under FAR 13.106-2. Quotations may first be assessed for compliance with mandatory submission requirements and minimum capability requirements. EXIM intends to establish BPAs without discussions but reserves the right to conduct exchanges.
Evaluation factors:
• Factor One - Technical and Management Approach, including Worldwide Coverage and Organizational Presence
• Factor Two - Past Performance
• Factor Three - Price
6.1 FACTOR ONE - TECHNICAL AND MANAGEMENT APPROACH
The Government will evaluate the credibility, breadth, quality, depth, and sustainability of the Vendor's worldwide recovery capability and the likelihood of successful performance.
Worldwide geographic coverage and direct international organizational presence are significant discriminators under this Factor. Vendors demonstrating credible operational capability in a greater number of countries will be evaluated more favorably than Vendors demonstrating credible capability in fewer countries, all other considerations being equal.
The Government will also evaluate the extent of the Vendor's direct organizational presence outside the United States. Vendors maintaining established Vendor-owned or Vendor-controlled branch, regional, or satellite offices in multiple countries may receive more favorable consideration because such offices may demonstrate stronger direct control, accountability, continuity, local knowledge, and readiness than coverage dependent upon unrelated third parties.
Evaluation credit will be based upon demonstrated and verifiable capability, rather than the size of a claimed network or country list. The Government will consider both the breadth of geographic coverage and the quality and credibility of the resources supporting that coverage. The evaluation will consider:
• Credibility, clarity, and completeness of the approach to asset identification, due diligence, collection, restructuring, enforcement, reporting, and cross-border coordination;
• Breadth of Worldwide Coverage. The Government will evaluate the number of countries in which the Vendor demonstrates current, credible, legally compliant, and operational capability to perform the required services. Greater verified country coverage will be evaluated more favorably than more limited country coverage, all other considerations being equal. Accordingly, a Vendor that demonstrates credible capability to perform in a greater number of countries may receive a higher rating under Factor One than a Vendor demonstrating credible capability in fewer countries. Evaluation credit will be based only on countries for which the Vendor provides sufficient evidence of actual operational capability;
• International Organizational Presence. The Government will evaluate the number, geographic distribution, maturity, staffing, and operational capacity of the Vendor's established offices outside the United States, including Vendor-owned or Vendor-controlled branch, regional, and satellite offices.
• A Vendor demonstrating established Vendor-owned or Vendor-controlled offices in a greater number of countries may receive a higher evaluation under Factor One than a Vendor relying predominantly on affiliated entities, subcontractors, local counsel, referral networks, or unrelated third parties, all other considerations being equal.
• The Government will also consider whether those offices contain established personnel with relevant recovery capabilities and whether the Vendor demonstrates effective managerial control, quality assurance, accountability, continuity, and the ability to mobilize resources for EXIM assignments;
• The extent to which proposed country coverage will be performed through the Vendor's own offices and personnel rather than unrelated third parties;
• The strength of affiliated-office, subcontractor, local-counsel, investigator, and partner arrangements, including oversight, accountability, quality control, and continuity;
• Ability to mobilize qualified personnel and legally authorized professionals in each proposed jurisdiction;
• Understanding of cross-border legal, regulatory, judicial, insolvency, collection, enforcement, data-protection, and records-handling considerations;
• Information security, conflict screening, communications, and reporting controls; and
• Ability to meet response times and manage multiple concurrent cases across regions.
Country coverage will be evaluated based on demonstrated operational capability, not merely the size of a claimed network. In assessing the credibility and strength of country coverage, the Government generally considers direct organizational presence to provide greater evidence of control, accountability, continuity, and immediate operational capability. Accordingly, all else being equal, coverage through (1) Vendor-owned or Vendor-controlled offices may receive greater consideration than coverage through (2) offices of legally affiliated entities, (3) established subcontractors or formal partners, and (4) unrelated third parties or resources proposed to be identified after BPA establishment.
Example: If two Vendors each credibly cover 50 countries, but one has its own established offices in 20 countries and the other has its own offices in 5 countries and relies on unrelated third parties for the remaining coverage, the first Vendor may be evaluated more favorably, all other factors being equal, because its organizational presence presents stronger direct control, accountability, and continuity.
A quotation that does not demonstrate credible capability in the countries it claims, or that materially mischaracterizes third-party resources as Vendor offices, may be rated Unsatisfactory or otherwise assessed as presenting significant performance risk.
6.2 FACTOR TWO - PAST PERFORMANCE
The Government will evaluate the Vendor's demonstrated record of performing services similar in size, scope, complexity, geographic breadth, and legal environment to the worldwide recovery requirement. The evaluation will focus on relevance, quality, timeliness, effectiveness, customer satisfaction, and measurable recovery outcomes.
Successful recovery work performed for U.S. Federal Government agencies may be evaluated more favorably when that experience demonstrates greater relevance to the Government oversight, authorization, reporting, legal, records-handling, security, or cross-border requirements of this acquisition. Federal experience is not a minimum eligibility requirement, and relevant non-Federal experience will be evaluated based on its demonstrated similarity in size, scope, complexity, geographic breadth, and performance environment.
The Vendor shall submit three (3) or more completed or ongoing projects demonstrating successful recovery, enforcement, collection, restructuring, or asset-recovery activity. Vendors are encouraged to submit projects that collectively demonstrate work in multiple countries or regions and the Vendor's direct role in performance.
Failure to submit three (3) past performance examples may result in the quotation being evaluated as incomplete or unacceptable.
Greater evaluation weight will be given to projects demonstrating:
• Successful recovery work performed for a U.S. Federal Government agency;
• Performance as the prime contractor or primary accountable entity;
• Comparable cross-border or multi-country recovery complexity;
• Documented and measurable recovery outcomes;
• Use of the Vendor's own established offices and personnel;
• Effective oversight of local counsel, subcontractors, investigators, or partners; and
• Strong quality, timeliness, and customer satisfaction.
Projects demonstrating both successful U.S. Federal Government recovery performance and credible multi-country execution may receive the highest relevance assessment. The absence of Federal experience will not, by itself, make a Vendor ineligible, but the Vendor will not receive the additional favorable consideration associated with successful Federal recovery performance.
Past Performance Submittal
• Project title and contract/project number;
• Client or agency name;
• Countries and locations of performance;
• Start and completion dates, or ongoing status;
• Contract type and approximate value, if disclosure is permitted;
• Description of services and Vendor's role;
• Measurable recovery, enforcement, collection, restructuring, or settlement outcomes;
• Identification of the offices and personnel used, including whether they were Vendor-owned, affiliated, subcontracted, or unrelated third parties;
• Identification of prime, subcontractor, local-counsel, or other role; and
• Customer reference information, if available.
EXIM may obtain and consider past performance information from CPARS, references, questionnaires, Government records, and Government knowledge. EXIM may verify claimed countries, organizational relationships, offices, and project outcomes.
6.3 FACTOR THREE - PRICE
The Government will evaluate the proposed Due Diligence Fee and Contingency Fee separately for fairness and reasonableness and may perform a comparative analysis of the overall pricing structure. The Government may consider country- or region-specific pricing, consistency between pricing and the technical approach, and whether pricing demonstrates an adequate understanding of worldwide recovery risks and complexity. Because actual case assignments and recovery amounts are unknown at BPA establishment, the Government will not calculate an evaluated total price using hypothetical recovery amounts unless the solicitation is amended to provide a common evaluation scenario.
6.4 Evaluation Ratings
Rating Abbreviation Definition
Superior S Greatly exceeds minimum requirements, presents a high probability of success, and contains no significant weaknesses or deficiencies.
Above Average AA Exceeds minimum requirements, presents an above-average probability of success, and contains no significant weaknesses and only minor correctable weaknesses.
Average A Meets minimum requirements and presents an acceptable probability of successful performance.
Unsatisfactory U Fails to meet material requirements, requires major revision, or presents a low probability of successful performance.
6.5 Relative Importance and Basis of BPA Establishment
The Government intends to establish BPAs with Vendors whose quotations represent the best value, considering the tradeoff among Technical and Management Approach, Past Performance, and Price. Factor One is more important than Factor Two.
Factors One and Two, when combined, are significantly more important than Price. Price may become more important as non-price quotations become more equal.
Within Factor One, breadth of verified worldwide country coverage and direct international organizational presence are significant comparative evaluation considerations. Greater verified country coverage will be evaluated more favorably than more limited verified country coverage, all other considerations being equal. Similarly, greater demonstrated use of established Vendor-owned or Vendor-controlled offices, including branch, regional, or satellite offices located outside the United States, may support a higher evaluation than comparable coverage dependent primarily upon affiliated firms, subcontractors, local counsel, referral networks, or unrelated third parties. Evaluation credit will be based upon the credibility and demonstrated operational capability associated with the claimed coverage and offices, and not solely upon an unsupported numerical country count. Within Factor Two, successful U.S. Federal Government recovery experience is a significant consideration to the extent it demonstrates relevance to this requirement. These considerations will be applied as comparative best-value discriminators and do not establish unstated minimum requirements, automatic numerical credits, or an entitlement to BPA establishment.
The Government may establish fewer BPAs than anticipated, establish no BPAs, or establish BPAs without discussions.
Vendors should submit their best technical and price terms initially.
7. CONTRACT ADMINISTRATION
The Contracting Officer is the only person authorized to establish, modify, or cancel a BPA and to issue or modify a BPA Call, except to the extent another official is expressly authorized in writing. Unauthorized direction does not change scope, price, schedule, terms, or conditions and does not authorize additional cost or performance.
A Contracting Officer's Representative or technical representative may be appointed for day-to-day administration but is not authorized to change price, scope, schedule, terms, or conditions unless separately authorized in writing.
Contracting Office Address:
Office of Contracting Services Export-Import Bank of the United States 811 Vermont Avenue, NW Washington, DC 20571
7.1 Additional Solicitation Provisions and Clauses
The FAR and agency provisions and clauses applicable to this acquisition shall be identified in the solicitation package and incorporated into each resulting BPA or BPA Call, as applicable. The final solicitation package shall include the provisions and clauses required for the acquisition of commercial services under FAR Part 12 and FAR Subpart 13.5, including applicable representations, certifications, terms and conditions, and any clauses required for performance outside the United States. If the solicitation documents conflict, the order of precedence stated in the applicable instrument will govern. [CONTRACTING OFFICER: Insert or attach the completed provision-and-clause matrix before issuance.]
