Multiple Award for Legal Services
Question and Answer
21 July 2020
1. Question: Is this a new requirement, or is there a current or previous contractor who has performed similar services?
Answer: Similar services are currently being provided
2. Question: If available, can EXIM please send along the incumbent contract or task order number?
Answer: Purchase Orders, 83310120P0022, 83310120P0023, 83310120P0024
3. Question: For the pricing, do contractors need to provide current hourly billing rates and anticipated hourly billing rates for the next 3 years? If so can future hourly billing rates be adjusted if needed?
Answer: Attachment I – Pricing, has separate tables for the Base year and each of the Option Years. Each year’s pricing should reflect anticipated pricing increases customary with normal commercial practices. Changes to these rates would require justification and a contract modification after an award has been made.
4. Question: Are hourly billing rates for specific individuals or for the categories referenced in
Attachment I?
Answer: Rates should be for the appropriate Labor Category.
5. Question: For the Past Performance Evaluations, can those be provided by current and/or retired EXIM Bank employees?
Answer: Contractors may submit 3 past performance responses from any clients to which they have done work for that is similar to the size, scope and complexity of the type work noted in the PWS. Responses from current EXIM employees are not acceptable. Responses from past employees or retired employees, or other third parties are acceptable. It is recommended that responses are from different clients to the maximum extent possible to avoid any conflict of interest concerns.
6. Question: Should Contractors include pricing for subcontractor’s hourly rates for this RFP?
Answer: Pricing for any anticipated Labor Categories should be included in the Proposal. Those not listed on the current Attachment I – Pricing, should be added as appropriate.
7. Question: Should Contractors note the possibility of engaging local counsel (e.g., bankruptcy counsel and counsel for the special purpose companies) in the context of teaming arrangements?
Answer: Yes, to the maximum extent possible.
8. Question: In some restructuring and bankruptcy matters, a contract is not necessary because the airline/borrower agrees to pay fees in connection with the matter. Would it be sufficient for Contractors to insert a description of the matter in the “Contract Number/Title” section of the Performance Evaluation Document?
Answer: Yes
9. What information should be inserted in the line item “Offer Evaluated” in the middle of the first page of the Performance Evaluation Document?
Answer: Offer Evaluated should reflect a description of the work completed by the Contractor.
