3. Statutory Authority: Federal Acquisition Regulation (FAR) 13.106-1(b)(1) - (Open Market Purchase Order) Soliciting from a single source (including brand name)
4. Description of Action: The objective of this effort is to obtain annual software maintenance during the base year Period of Performance 1 Oct 2022 through 30 Sep 2023, with two additional option years, from the Original Equipment Manufacturer (OEM) for ASSIST/TS TUTOR/TS software. Software maintenance includes the receipt of new versions and releases of software products. This software is incorporated in the Operation center’s mainframe environment.
5. Proposed Sole Source Contractor: GT Software, Inc.
6. Market Research: Based on current market research, dated April 2022, it has been determined that only the aforementioned ASSIST/TS TUTOR/TS software provided by GT Software, can fully support the Governments need. Market research was based on the prior years’ acquisitions. The software maintenance will continue the annual software renewal of the Operations Center architecture. Market research showed that this software license, maintained since the initial purchase, is commercially available to properly support the operating environment, and is not available on existing Government Services Agency (GSA) Federal Supply Schedule (FSS), NASA Solutions for Enterprise-Wide Procurement. The GT Software product is used within the DISA Operations Center environment. If functionality could be replaced, it would result in the Government losing its investment in the current infrastructure, as well as extensive application re-writing for the supported DISA customers.
In addition, extensive re-training of the DISA technicians who support this software would be required if the software functionality could be replaced. Decreased DISA data center productivity would be a major negative impact of discontinuing the specific software. In summary, no other software product can meet the Government’s technical capability needs in a cost-effective manner
7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this Sole Source justification for the proposed contract action pursuant to the authority cited above as the particular brand-name product is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.
Based on the justification provided by DISA HC Compute Operations Office, a determination has been made to issue a sole source solicitation for the above-described requirement.
