About this file
Summary
This is a Proposal Report for Project 123206, a bridge preservation contract issued by the Pennsylvania Department of Transportation (PennDOT) for State Route 180, Section 169, in Lycoming County. The project involves bridge preservation work on both eastbound and westbound structures over Loyalsock Creek, including scarification, polyester polymer concrete overlay placement, neoprene strip seal gland replacement, pavement markings, and miscellaneous construction activities. The work spans approximately 1.1 miles in Loyalsock Township. The scheduled bid let date is May 7, 2026, at 11:00 AM, with an anticipated Notice to Proceed of June 22, 2026, and required completion by November 23, 2026. The project includes multiple line items with varying quantities, including 8,410 square yards of polyester polymer concrete overlay, 402 linear feet of neoprene strip seal gland replacement, and various pavement marking items. No pre-bid meeting is scheduled, though a preconstruction conference will be required. The bid opening will be held at the Commonwealth Keystone Building, 7th Floor, Contract Awards Room, 400 North Street, Harrisburg.
The project is a federal project under PennDOT oversight with a cost range of $1,000,000 to $2,499,999.99 and requires prequalification. Structure work comprises 89 percent of the contract, with no Disadvantaged Business Enterprise (DBE) set-aside requirement. Heavy construction wage rates apply to actual bridge items, while highway construction wage rates apply to other work. The contract is subject to multiple federal and state requirements including Buy America provisions, Build America Buy America Act compliance, prevailing wage requirements, and various environmental and traffic control provisions. Specific construction restrictions prohibit work before July 6, 2026, and require completion of a preconstruction bat assessment between May 15 and August 15. Continuous 24-hour construction operations are required on weekends from Friday 7:00 PM to Monday 6:00 AM. Road User Liquidated Damages (RULD) will be assessed based on hourly rates outlined in the special provisions, with separate tables for eastbound and westbound restrictions. The contract requires electronic material certification submissions through ECMS and compliance with Pennsylvania's Worker Protection and Investment requirements.

SECTION 106—CONTROL OF MATERIAL
106.10(a) Buy America Provisions. Revise last paragraph to read as follows:
Products manufactured of foreign steel or iron materials may be used, provided the cumulative cost of such products as they are delivered to the project does not exceed 0.1% of the total contract amount, or $2,500, whichever is greater.
Add 106.11 BUILD AMERICA, BUY AMERICA ACT PROVISIONS.
106.11 BUILD AMERICA, BUY AMERICA ACT PROVISIONS—
(a) Build America, Buy America Act. The Federal Bipartisan Infrastructure Law (Public Law 117-58) includes the Build America, Buy America Act that requires all iron, steel, manufactured products, and construction materials used to be produced in the United States.
The term produced in the United States defined as:
1. Iron or Steel Products. All manufacturing processes from the initial melting stage through the application of coatings occurred in the United States according to Section 106.10(a).
2. Manufactured Product. Final assembly of all manufactured products permanently incorporated into the project must be manufactured in the United States.
March 17, 2026 11:39:59 AM Page 9 of 33
2.a A manufactured product, not predominantly steel or iron, is defined as an article, material, or supply that has been processed into a specific form and shape, or combined with other articles, materials, or supplies to create a product with different properties than the individual articles, materials, or supplies.
2.b Predominantly steel or iron is defined as greater than or equal to 50 percent of the total cost of the manufactured product.
2.c Manufactured products that are predominantly steel or iron must comply with Buy America provisions according to Section 106.10(a).
2.d If an article, material, or supply meets this definition but could also be classified as an excluded material or other product category, that article, material, or supply is not a manufactured product.
2.e Mixtures of excluded materials delivered to a work site without final form for incorporation into a project are also not manufactured products.
2.f Manufactured products where the final assembly did not occur in the United States may be used, provided the cumulative cost of such manufactured products is no more than the lesser of $1 million or 5% of total applicable costs for the project.
3. Construction Materials.

SECTION 107—LEGAL RELATIONS AND RESPONSIBILITY TO THE PUBLIC
Section 107.28 EROSION AND SEDIMENT POLLUTION CONTROL PLANS AND PERMITS. Revise to read as follows:
107.28 EROSION AND SEDIMENT POLLUTION CONTROL PLANS AND PERMITS—Install and maintain erosion and sediment (E&S) pollution control devices as indicated or submit an alternate plan for accomplishing equal or better temporary and permanent erosion and water pollution control. If an alternate plan is submitted, do not start work until the plan is approved by the County Conservation District and the Department. If a National Pollutant Discharge Elimination System (NPDES) Permit is involved, do not start work until the plan is approved by the DEP or the authorized County Conservation District and the Department. Concrete clean out areas, either contractor designed or indicated within the contract documents, are incidental to the contract items.
When a general or individual NPDES Permit is involved:
At the preconstruction conference, submit a Preparedness, Prevention and Contingency (PPC) Plan and identify a licensed professional (Professional Engineer, Geologist, Land Surveyor or Landscape Architect) registered in the Commonwealth and if applicable, their designee to be present onsite and responsible for implementing critical stages of the
Do not start earth disturbance activities until an environmental preconstruction meeting is held with DEP or delegated
CCD.
Within 14 days of completing the construction of a stormwater control measure (SCM) as determined by the licensed professional or designee, submit a completed Chapter 102 SCM Construction Certification Form for each SCM to the Representative through PPCC. Form CS-102 has information required to complete the Chapter 102 Form(s). Ensure the General Project and SCM Information, Construction Information, and Licensed Professional Certification sections are completed by the identified licensed professional responsible for overseeing the critical stages of the approved PCSM plan.
Prepare an as-built (record) PCSM Plan to be sealed and signed by the identified licensed professional registered in the Commonwealth. All construction survey, plan preparation, and engineering required for the as-built (record) PCSM Plan will be incidental to the contract items. The as-built (record) PCSM Plan must accurately reflect deviations from the approved PCSM Plan including, but not limited to, plan locations, dimensions, inverts/elevations, materials used and grading. Update the as-built (record) PCSM Plan as construction of the project’s PCSM features progresses. Have the identified licensed professional immediately notify the Representative of all deviations from the approved PCSM Plan. Deviations to the approved PCSM Plan must be submitted for approval. Assist with the determination and documentation if the as-built deviations require a permit amendment or if the PCSM features must be removed and replaced as indicated on the PCSM Plan.
Assist the Representative in performing visual site inspections weekly and after each precipitation event greater than 0.25 inches to ensure the project's E&S Best Management Practices (BMPs) are functioning properly. Immediately initiate corrective actions, at no additional cost to the Department, upon notification by the Representative of noncompliance with the provisions of this section that the Representative has determined requires immediate corrective action under Department policies. For all other notifications of noncompliance, initiate corrective actions within 24 hours. Failure or refusal to promptly comply with such notice upon receipt may, at the Department’s sole discretion, result in: the withholding payment of estimates for work completed until the requirements of the E&S Plan are met, assessment of E&S noncompliance liquidated damages as specified in Section 108.07(d) or issuance of a written order stopping all or part of the work until the corrective action has been taken and the requirements of the E&S Plan are met. No claims for extension of time, costs, or damages arising from, related to, or based upon such notices of noncompliance or stop orders will be granted, paid, or considered.
Nothing in this Section is to be interpreted to relieve the Contractor of its obligation to fully and timely comply with all applicable laws and any permits for the project. The time periods set forth in this Section do not supersede any more stringent time periods required by applicable laws or permits for the project.
If corrective action or noncompliance with the provisions of this Section result from design errors/omissions or a precipitation event exceeding the design storm criteria as specified in applicable Department publications; the cost and/or time required for the performance of the corrective actions for noncompliance notices or stop work orders will be considered as specified in Section 110.03 and Section 108.06, as applicable.
Utilize Department, DEP, or other authorized agency’s form(s) included in the contract or project permits unless directed otherwise by the Representative, DEP, the County Conservation District or other authorized regulatory agency.
approved Post Construction Stormwater Management (PCSM) Plan.
March 17, 2026 11:39:59 AM Page 11 of 33
For the purpose of determining compliance with the provisions of this section, “substantial completion” will be considered to have been attained when all of the following project milestones have been reached:
Either a semi-final or final inspection has been performed, physical work is complete, and an Environmental Commitments and Mitigation Tracking System (ECMTS) Sheet has been executed if applicable to the project.
Earth disturbance activity has been permanently stabilized and sufficient vegetative growth has been achieved to meet permit conditions (uniform 70% perennial vegetative cover) and agreed to by DEP or delegated CCD.
Installation of PCSM SCMs have occurred if applicable. Upon completion of PCSM conversions and facilities, the County Conservation District must approve the removal of all remaining E&S BMPs.
Once a project with a general or individual NPDES Permit has reached substantial completion, submit to the Representative a DEP Notice of Termination (NOT) Form ensuring Sections 2, 3, 4, 7 and 8, are fully executed. The NOT is to be accompanied by the required as-built (record) PCSM Plan, the final certification by the licensed professional and the Contractor’s executed portion of the ECMTS Construction Tracking Signature Sheet.

Section 106 - Electronic Submission of Material Certifications through ECMS
Provision Body:
SECTION 106—CONTROL OF MATERIAL
Section 106.03(b)3 Revise to read as follows:
3. Compliance Certification of Bulletin Materials. The Contractor is responsible for the control and quality of all materials, both Bulletin and non-Bulletin materials, arriving at the project. Each Bulletin material must be certified to be from a Bulletin source and to be in compliance with the specification requirements for the material. A properly completed and submitted Form CS-4171(DS), Certificate of Compliance, is the means for certification of Bulletin materials. Bulletin materials are defined in Section 106.02(a)1. The Department will review properly completed and submitted Certificates of Compliance and supplemental or alternate certification as specified in 106.03(b)3.c within 3 work days of submission in ECMS.
Prime contractors must use the automated Materials Certification process in ECMS to submit certifications electronically using DocuSign PDF certification forms only. Contact Department resource account via email at RA-PDECONSTRUCT@pa.gov regarding questions about the DocuSign PDF certification forms.
Contractors to contact and ensure manufacturers, producers, suppliers and subcontractors providing materials or working on this project have been informed of this requirement.
The Department reserves the right to sample and test any material for verification that specification requirements are met. Materials of questionable quality delivered to the project will be sampled, tested, and approved by LTS before incorporation in any work. Materials on a reduced certification level may be required to be sampled, tested, and approved by LTS before incorporation in any work. Random field verification samples of the material may be taken by the Representative at the material source, from delivered project material, or at the place of the last manufacturer, fabricator, or producer before delivery. Random QA samples may also be taken by the Representative from delivered project material, at the place of supply, or at the place of the last manufacturer, fabricator, or producer before delivery. The random samples will be sent to the LTS for testing.
3.a Form CS-4171 Completion. Form CS-4171(DS) is completed electronically by the manufacturer, fabricator, or producer (Producer) of Bulletin material provided to the project. The Producer submits the original Form CS-4171(DS) electronically to the project contractor and provides a paper copy of Form CS-4171 or Form CS-4171(DS) with each direct shipment to the project. The contractor then uploads the CS-4171(DS) into ECMS.
When a Producer sells a Bulletin 15 material to a distributor/supplier/private label company (shipper), the Producer provides a copy of Form CS-4171 or Form CS-4171(DS) with each delivery to the shipper. When a shipper provides Bulletin 15 material directly to the project, the shipper completes and signs a new Form CS-4171(DS) and includes a copy of the Producer's Form CS-4171 or Form CS-4171(DS), to be submitted electronically to the project contractor, and provides a paper copy of the shipper's Form CS-4171 or Form CS-4171(DS) with each direct shipment to the project. The contractor then uploads the CS-4171(DS) into ECMS. The shipper will maintain the copy of the Producer’s Form CS-4171 or CS-4171(DS) that they have received.
Form CS-4171 and Form CS-4171(DS) must be properly signed by a legally responsible company official.
3.b Form CS-4171 Submission for Project Shipments. Ensure that Form CS-4171(DS) is received for each project shipment of Bulletin material. Electronically submit a properly completed and signed copy of Form CS-4171(DS) for each project shipment. Do not incorporate any Bulletin material in the work until certification arrives on the project, unless otherwise approved by the Representative. Payment for material will be withheld until proper certification documentation is received.
Form CS-4171(DS) must be submitted to the Department electronically.
3.c Supplemental or Alternate Certification. Certain Bulletin materials require the submission of supplemental CS-4171 certification in addition to Form CS-4171(DS), to provide traceability of materials in multi-step manufacturing processes. Form CS-4171F(DS) and Form CS-4171LA(DS) must be submitted electronically within ECMS.

Structural steel, aluminum, or precast/prestressed concrete products, produced in a Bulletin 15 approved facility with an on-site Inspector or a Representative, must be stamped with an approved inspection stamp at the plant and certified with a Form CS-4171(DS).
Steel products containing foreign steel require the submission of supplemental Form CS-4171S.
Certain Bulletin materials require a form of certification other than the Form CS-4171, as identified in the particular material specification.
Section 701 and Section 702 materials require a properly completed vendor bill of lading.
Certification of daily bituminous mixtures by submission of Form CS-4171B.
Certification of locally approved non-Bulletin materials by submission of Form CS-4171LA(DS).
Organize and submit only Forms CS-4171(DS) and supplemental or alternate certifications for material supplied to the project. Submissions containing irrelevant forms or documentation for materials not incorporated into the project will not be accepted.
3.d CS-4171 Record Retention. Retain Form CS-4171 or Form CS-4171(DS) and supplemental and alternate certifications as defined in Section 106.03(b)3.c, for a period of not less than 3 years from the date of the last project shipment. Make files available for inspection and verification by the Department.
Notify shippers that a certification file must be maintained for purchased Bulletin materials to provide an audit trail to the Producer.
Certifications for purchased Bulletin materials must be maintained at their place of business for a period of not less than 3 years from the date of the last shipment to the project and must be available for inspection by the Department.
Notify Producers that all component certifications for purchased Bulletin materials must be maintained at their place of business for a period of not less than 3 years from the date of the last shipment to the project and must be available for inspection by the Department.
3.e Levels of Certification for Bulletin 15 Producers. The BOPD determines the Level of Certification for each Producer based on the Producer’s ability to comply with the material specifications. The Levels of Certification are defined in Table C. Bulletin 15 will indicate if a Producer is at a certification level other than Level 1. Material provided by Producers listed in Bulletin 15 is approved for use only in its intended application(s).

Suspension or Removal
According to the State’s Contractor Responsibility Program:
Producer may be suspended or removed from Bulletin 15 for any of the reasons stated in the Bulletin 15 Preface, regardless of Producer certification level.
Failure of Producer to advance above Certification Level 3 will result in PennDOT’s initiating action for suspension or removal from Bulletin 15.
* Certain Bulletin materials require supplemental or alternate forms of certification, as specified in Section 106.03(b)3.c. All Form CS-4171(DS), Form CS-4171F(DS), and Form CS-4171LA(DS) must be submitted electronically within ECMS.
3.e.1 LEVEL 1 (Standard Certification).
Initial Level of Certification typically issued to Bulletin 15 listed Producers.
Material is produced and tested in accordance with the Producer’s approved QC Plan.
No known material performance or quality issues exist that warrant a reduced level of certification.
Material is shipped on certification using Form CS-4171 or Form CS-4171(DS).
3.e.2 LEVEL 2 (Standard Certification - Reduced).
March 17, 2026 11:39:59 AM Page 21 of 33
Reduced Level of Certification issued to Bulletin 15 listed Producers who have exhibited minor/moderate material performance or quality issues.
Producer is required to work with PennDOT on submission of an improvement plan that may include, but is not limited to, any or all of the following items: a revised QC Plan, a failure analysis/action plan to assess why failures are occurring and how to prevent these failures from occurring in the future, correlation testing between in-house and independent lab testing to assist with validating results.
Material is produced and tested in accordance with the improvement plan approved by PennDOT.
Material is shipped on certification using Form CS-4171 or Form CS-4171(DS).
3.e.3 LEVEL 3 (Lot Approval Certification).
This Level of Certification is issued to Bulletin 15 listed Producers who have exhibited major material performance or quality issues.
Producer is required to work with PennDOT on an improvement plan as defined in Level 2.
Material cannot be shipped to projects using the standard CS-4171 certification process.
Producer must arrange for independent, in-plant acceptance testing (IPAT) that will be conducted side-by-side with “in-house” Producer testing at the designated frequencies in the revised QC plan. IPAT will be at the Producer’s expense. PennDOT’s LTS must approve the Producer’s proposed IPAT provider, before it begins.
Any material lot to be used on a project must be tested and approved by the IPAT as meeting the required PennDOT specification prior to shipment to the project.
Each material lot meeting the specification may be shipped to a project using a modified certification process as follows: submit Form CS-4171 or Form CS-4171(DS) along with a signed letter from the IPAT (on their official letterhead) indicating that the material lot meets testing and specification requirements.
Correlate results from parallel “in-house” Producer testing and IPAT testing, and submit to the LTS on a monthly basis.
