NATIONAL AERONAUTICS AND SPACE ADMINISTRATION

Langley Research Center (LaRC)

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(JOFOC)

For 80TECH22Q0018 Scramjet Test Complex Optimus System

1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”

This document is a justification for other than full and open competition prepared by the

National Aeronautics and Space Administration (NASA) Information Technology Procurement Office (ITPO) in support of the needs of the Langley Research Center (LaRC).

2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:

This justification provides the rationale for contracting other than full and open competition to award a sole-source contract for solicitation number 80TECH22Q0018 to Measurement Specialties. This action is a Firm-Fixed-Price Delivery Order (DO) issued for Measurement Specialties, Inc, a TE Connectivity Company, pressure scanner system to be housed in the NASA Langley Research Center Scramjet Test Complex (STC). The estimated lead-time for delivery is 44 weeks.

3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the

Agency’s needs (including the estimated value):

In support of NASA’s Hypersonic Technology Project (HTP) the NASA LaRC Scramjet Test Complex (STC) is seeking to upgrade its existing pressure data acquisition systems.

The estimated dollar value for this requirement is $261,237.98. Two of the facilities in the complex currently utilize the Measurement Specialties, Inc, a TE Connectivity Company, 8400 scanning pressure system, and one uses the Measurement Specialties Inc. Initium scanning pressure system. These systems control the data acquisition of pressure measurements from electronic scanning pressure (ESP) modules.

The models and configurations tested in the STC are typically heavily instrumented with pressure instrumentation. Many of the model pressure taps are connected to ESP modules for the measurement of static or total pressure values. The STC has an extensive stock of legacy and modern ESP modules. These modules span the wide range of pressures encountered in these facilities.

An upgrade is desired to these systems that will modernize and increase communications reliability, increase the number of supported ESP channels, and remain compatible with existing equipment in the facilities and across the center. The Optimus system from Measurement Specialties, Inc, a TE Connectivity Company, is the only system that will meet these requirements. The Optimus system is compatible with and reuses existing ESP modules as well as the pressure calibration units (PCUs) for these modules. These existing components represent a substantial investment in this type of pressure measurement system.

Not reusing existing modules and PCUs would incur significant cost and development time to engineer an alternative solution. Identical ESP modules and PCUs are in use in several facilities across the center (8-foot High Temperature Tunnel, Unitary Plan Wind Tunnel, and the Langley Aerothermodynamics Laboratory, to name a few) and maintaining this field-wide compatibility allows collaboration and access to large numbers of scanners for complex tests. In addition, a large knowledge base of operating and maintaining the 8400 system and its components exists from its decades of use. Staying within this family of pressure measurement systems means that knowledge can continue to be leveraged.

4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is 10 U.S.C.

2304(c)(1) the property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency. As well as 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.

Also, 10 U.S.C. 2304(c)(a)(1) Issuance of Orders- The following actions are (a) Issuance of Orders. The following actions are not required for the issuance of a task or delivery order under a task or delivery order contract: (1) A separate notice for such order under section 1708 of title 41 or section 8(e) of the Small Business Act (15 U.S.C. 637(e) as implemented by FAR 6.302-1. The following statutory authorities (including applications and limitations) permit contracting without providing for full and open competition.

5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition require use of the authority cited:

The rationale supporting the use of 10 U.S.C. 2304(c)(1) is the property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency as described below.

Identical ESP modules and PCUs are in use in several facilities across the center (8-foot High Temperature https://www.acquisition.gov/far/6.302-1 https://www.acquisition.gov/far/6.302-1

Tunnel, Unitary Plan Wind Tunnel, and the Langley Aerothermodynamics Laboratory, to name a few) and maintaining this field-wide compatibility allows collaboration and access to large numbers of scanners for complex tests. In addition, a large knowledge base of operating and maintaining the 8400 system and its components exists from its decades of use. Staying within this family of pressure measurement systems means that knowledge can continue to be leveraged.

The Optimus system is a direct replacement for the 8400 system and largely shares its control and command set. As such, substantial cost savings will be realized when programming the system interface; a job that will be accomplished by the in-house facility and support engineers.

6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:

Notice to the Government Point of Entry (GPE) website (Sam.gov) will be published as a combined synopsis solicitation in accordance with FAR 12.603. This posting informed potential sources of NASA’s intent to award this sole-source Contract to Measurement Specialties. The results of this synopsis are summarized in Section 10 below.

7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

It is determined that the anticipated cost to the government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to the execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable.

The Optimus system will compete as a brand name, combined synopsis/ solicitation. ITPO anticipates one vendor (Measurement Specialties) to provide a competitive price on the TE Connectivity Optimus Multi-Press System brand name request for a quote.

8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:

The Contract Specialist (CS) sent an email to the SEWP Team to confirm whether this requirement can be purchased from SEWP, with no response was received. The Technical Team confirmed this requirement could not be purchased from SEWP or GSA, as the TE Connectivity Optimus Multi-Press System was a brand name with authorized resellers on SEWP V or GSA. Measurement Specialties is a large business and the only source to provide this requirement.

9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:

None

10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:

A notice of NASA’s intent to award this sole-source action will be synopsized on the GPE website (Sam.gov) per FAR 12.603 (See Section 6 above).

11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

The Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
