NATIONAL AERONAUTICS AND SPACE ADMINISTRATION
NASA SHARED SERVICES CENTER (NSSC)
LIMITED SOURCES JUSTIFICATION
Electronic Health Record System (EHRS)
i. Identification of the agency and the contracting activity: National Aeronautics and Space Administration (NASA), NASA Shared Services Center (NSSC), Bldg. 1111, Jerry Hlass Rd, Stennis Space Center, MS 39529.
ii. Nature and/or description of the action being approved.
The NSSC Procurement Office is seeking approval of a Limited-Sources Justification (LSJ) for the procurement of an agency-wide Electronic Health Record System (EHRS) for the recurring requirement for NASA Headquarters, Office of the Chief Health and Medical Officer (OCHMO).
This action will be performed against GSA schedule GS-35F-0032U. The award shall be a twelve month (12-month) base ordering period of performance (POP) with one option period for 12 months; total estimated value of . The period of performance for this renewal is October 1, 2018 thru September 30, 2020.
iii. A description of the supplies or services required to meet the agency's needs (including the estimated value).
This order will provide NASA the ability to facilitate real-time identification of critical health issues, decrease the likelihood of medical errors occurring, assess the effectiveness of health promotion programs, and advance standardization and collaboration between NASA occupational health (OH) clinics and best EH/IH practices.
The total estimated value for this acquisition is . This includes the annual fee to support medical laboratory data transfer interfaces at . See the Independent Government Cost Estimate (IGCE) below:
iv. Authority and supporting rational is in accordance with 8.405-6(a)(i) and (b)(1);
demonstration of the proposed contractor’s unique qualifications to provide the required supply or service:
Authority: In accordance with FAR 8.405-6(a)(i)(C), this limited source justification for a logical follow-on to order number NNK08OW16D (the “original order”) awarded to Medgate Inc now known as Cority, which was competitively established in June 2008, utilizing the procedures of FAR 8.405-2s.
Supporting rationale: This acquisition is for the renewal of GX2, Electronic Health Record System License. This acquisition constitutes purchasing the appropriate licenses to access all environments of Cority’s GX2 system during FY 2019. Cority GX2 is offered as a license, meaning, the EHRS web-based program will function properly only for the duration of the license period.
NNK08OW16D provided for the deployment of Cority’s occupational medical and medical surveillance software application across the Agency, providing a single system to store, access, and record employee medical data (of medical care, first aid, emergency treatment, examinations, exposures, and consultations). NNK08OW16D was a major initiative and, to date, the Agency has already invested more than for use of the software application and related services (see paragraph 5.5). The Agency has also incurred substantial costs from NASA contractors supporting the implementation of this system. These costs would not be recovered through competition.
Use of another software application would not be compatible with the existing Cority system. The GX2 licenses provide access to elements of the EHRS that are already in use. Failure to purchase GX2 licenses would result in compromising the OCHMO’s ability to meet Government initiatives to enhance the efficacy of healthcare information management and associated electronic record security upgrades in a timely manner. An effort of this sensitivity (i.e., medical information), cost, and magnitude (i.e., rollout of a new Agency system, which significantly changes the way operations are conducted in Agency Occupational Health Clinics) was never intended to be a short-term acquisition, and included an annual consideration of software application upgrades and updates.
v. A determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d):
Pursuant to FAR 8.404(d), Pricing (DEVIATION), Supplies offered on the schedule are listed at fixed prices. Services offered on the schedule are priced either at hourly rates, or at a fixed price for performance of a specific task (e.g., installation, maintenance, and repair). GSA has determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, to be fair and reasonable for the purpose of establishing the schedule contract. GSA's determination does not relieve the ordering activity contracting officer from the responsibility of making a determination of fair and reasonable pricing for individual orders, BPAs, and orders under BPAs, using the proposal analysis techniques at 15.404-1. The Contracting Officer will determine price reasonableness during the proposal evaluation process prior to contract award, based on comparing proposed pricing to commercial pricing.
vi. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Market research was conducted July 23, 2018 with schedule holder Cority to find out the availability of value added resellers; however, during the market research Cority stated that they do not authorized resellers of their products/services.
vii. Any other facts supporting the justification:
The Office of the Chief Health and Medical Officer (OCHMO) located at NASA Headquarters in Washington, DC, is responsible for managing an Agency-wide electronic health record system (EHRS). The EHRS is a web-based software system that replaces traditional paper-based management of employee medical and environmental health/industrial hygiene (EH/IH) records.
The EHRS was deployed during 2011-2012 as a system for managing occupational medical employee records and industrial hygiene surveillance across 13 NASA installations.
This limited source justification provides the rationale for limiting competition toonly Cority, Inc. (formerly known as Medgate, Inc.), for purchasing licenses to access all environments of Cority’s GX2 version of the web-based EHRS.
viii. A statement of the actions, if any, the Agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
Due to the specialized nature of this requirement, there are no known actions which the agency may take to remove or overcome barriers to competition before any subsequent acquisition for the services required. Future requirements will be competed if the existing system fails to meet Agency requirements or the Agency determines that continued use of Cority’s system is not in the best interest of the Government.
ix. Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government's minimum needs or requirements or other rationale for limited sources) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.
Technical/Requirements Personnel Certification: “I hereby certify that the supporting data which form the basis of this justification to restrict competition is complete and accurate to the best of my knowledge and belief.”
7/17/2018
Contracting Officer Certification: “I have reviewed this justification to limit sources within the Federal Supply Schedules and certify that the justification is accurate and complete to the best of my knowledge and belief. I will make a best value determination consistent with FAR 8.404(d) before issuing an order.”
