(a) The purpose of this amendment is to respond to industry questions relative to the Consolidated Agency Technology Transfer Services (CATTS) Request for Proposal (RFP). Attachment A, RESPONSES TO INDUSTRY RFP QUESTIONS, provides responses to questions and comments provided by industry.

(b) Failure by the offeror to acknowledge receipt of this amendment, either on the Standard Form 33, SOLICITATION, OFFER, AND AWARD, SF30, AMENDMENT OF SOLICITATION/MODIFICATION OF CONTRACT, or transmittal letter by the due date for receipt of proposals may result in a determination that the proposal is unacceptable and therefore ineligible for award.

(c) All other terms and conditions of RFP 80MSFC23R0012 remain unchanged.

(d) In relation to Section L, Provision MSFC 52.205-90, Designated Point of Contact, paragraph (b), the period for questions or comments relative to this acquisition has closed (i.e., questions and comments relative to this acquisition were previously due no later than 5:00 p.m., Central Time, September 5, 2023). At this time, the Government is no longer accepting additional questions or comments in relation to the solicitation, as released on August 28, 2023.

ATTACHMENT A – RESPONSES TO INDUSTRY RFP QUESTIONS

In Factor III(c), the RFP indicates, “Two (2) past performance referenced contracts should be provided for the JV managing partner.” Considering the managing partner of the JV is not required to submit a past performance reference contract, please describe how the government will evaluate JV proposals where the managing partner does not have relevant past performance.

The evaluation of past performance will be in accordance with the criteria specified in the solicitation and any applicable Small Business Administration requirements. See Section M provision Volume III – Past Performance Volume Evaluation, paragraph (b), and 13 C.F.R. § 126.616.

In Factor III, Section I, the government calls for Offerors to identify their “Joint Venture role…” Please confirm the requested information pertaining to role is directed at the role the Offeror served for the cited contract. For example, if the cited past performance contract was owned by a JV consisting of the Offeror as a member of the JV, then the Offeror should identify its role in the contract citation as either the managing partner, non-managing partner, mentor, or protégé.

In Factor III, Section II(6), please confirm that Offerors with first-tier small business subcontractors who do not qualify as “major subcontractor” may merely provide administrative information (i.e., name, cage code, contract number, etc.) pertaining to their past performance information without having to address the four minimum of the 13 specified PWS elements.

Offerors are requested to furnish for each of the five allowed referenced contracts all information specified in Section I of Section L provision Factor II – Past Performance Volume Instructions. For these five referenced contracts, the information requested in Section I should be provided regardless of entity size (e.g., non-major, major, offeror). See paragraph (e), Section II, Item (6), for information regarding 13 C.F.R. §125.2(g).

In Factor III, Section II(6), if first-tier small business subcontractors that do not qualify as “major subcontractor” may merely provide administrative information (i.e., name, cage code, contract number, etc.) pertaining to their past performance information without having to address the four minimum of the 13 specified PWS elements, please explain how the government will evaluate each first-tier, non-major subcontractor past performance against the specified evaluation criteria.

The evaluation of past performance will be in accordance with the criteria specified in the solicitation and any applicable Small Business Administration requirements. See Section M provision Volume III – Past Performance Volume Evaluation, paragraph (b), 13 C.F.R. § 126.616, and 13 C.F.R. §125.2(g).

Will NASA inform offerors when the Past Performance Questionnaires are received? The impact is that if a Past Performance client does not end up completing the questionnaire in time, the offerer would like to know in time to provide a backup option.
No. Offerors should request that questionnaires be submitted directly to the Government by the due date specified for receipt of proposals. However, the Government recognizes that the completion and submission of these questionnaires by the customer is largely outside of the offeror’s control.

Related to RFP (page 266) - Past Performance Questionnaire instructions: the draft email text from NASA requests that PP clients return signed and completed forms. The forms contain no signature box. Will NASA eliminate the requirement for signed forms?

Yes. The completed form does not need to be signed by the customer completing and forwarding the questionnaire. As the change is considered minor, and complete reissue of the RFP to delete this requirement is considered unnecessary.
