AERONAUTICS AND SPACE ADMINISTRATION GEORGE

C. MARSHALL SPACE FLIGHT CENTER

JUSTIFICATION FOR OTHER THAN FULL AND OPEN

COMPETITION (JOFOC) PURSUANT TO TITLE

1. This document is a Justification for Other Than Full and Open Competition (JOFOC) prepared bythe NASA Marshall Space Flight Center (MSFC) in accordance with Federal Acquisition Regulation (FAR) Part 6.3, Other Than Full and Open Competition, and NASA FAR Supplement (NFS) Part 1806.3, Other Than Full and Open Competition.

2. Nature and/or description of the action being approved: This procurement is for the trade in of the existing Concept Laser 1000R laser powder bed fusion Additive Manufacturing (AM) machine for a GE Concept Laser X-Line 2000R AM machine. GE has agreed to a steeply discounted price on the X-Line 2000R to downgrade the X-line 1000R to a Research and Development (R&D) machine. The X-Line 2000R will be used to support the Liquid Engine Office (LEO) development program for the RS25 liquid rocket engine.

This machine will also support AM certification rationale and requirements development.

This information will support the development of NASA Agency wide certification standards. The X-Line 2000R is the largest commercially available powder bed fusion AM machines giving MSFC a unique capability that will support LEO and the RS25 prime contractor.

3. Description of the supplies or services required to meet the agency’s need, including estimated value: Purchase of the GE Concept Laser X-Line 2000R AM machine to be used to support Space Launch Systems (SLS) by supporting the LEO program office will be procured from Concept Laser, a GE company. The total estimated cost of this effort is $700,000 and the estimated period of performance or lead time for delivery is 9 months.

4. Statutory authority permitting other than full and open competition: This recommendation is made pursuant to FAR Part 6.302-1, which implements the authority for 10 U.S.C. § 2304 (c)(1) for acquisition of supplies or services from only one source and no other supplies or services will satisfy agency requirements.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires the authority cited: Concept Laser is the manufacturer of the X line 2000R Additive Manufacturing machine we are purchasing. Concept Laser is also the manufacturer of the X line 1000R that we currently have at MSFC. GE has offered to trade in our existing 1000R for a new 2000R. Only GE can make this trade in so it must be worked directly with them. The current Xline1000R has been a problematic machine so GE would like to get them out of service. By trading in the existing equipment, we will be able to upgrade to a new machine that has addressed the issues. The new 2000R machine is also one of the largest powder bed fusion machines available so it would allow MSFC to remain on the cutting edge of the technology. Our LEO customer wants the machine upgraded to allow MSFC to remain consistent with the technology in use at the RS25 prime contractor. The RS25 prime contractor is in the process of trading in their X line 1000R machines for the new X line 2000R machines. Having the same machines would allow MSFC to continue our efforts with LEO and the RS25 prime contractorto assist in build strategy and demonstration hardware manufacturing. This new Xline 2000R is a dual laser system which is a type of system we do not have at MSFC. By having the dual laser system at MSFC we would be able to develop certification rational and requirements for this type of configuration.

6. Description of the efforts made to ensure that offers are solicited from as manypotential sources as practicable: Pursuant to FAR Part 5.201, this acquisition will be synopsized on the Federal Business Opportunities (FBO). Any written inquiries received will be dispositioned appropriately and addressed within an addendum to this document.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: Determination will be based upon established baselineprice for the X-Line 2000R.

8. Description of the market survey conducted, and the results, or a statement of thereasons a market survey was not conducted: Market research and production evaluations were conducted by the Advanced Manufacturing and Digital Solutions team in EM42.Trade shows and AM conferences have been attended to gauge the state of the art in AM equipment and the sizes available. This research and evaluation shows that the X-Line 2000R required by this acquisition are not available from another manufacturer. The X- Line 2000R is capable of meeting all the Governments requirements.

9. Other facts supporting the use of other than full and open competition, such as the fact that Concept Laser is the manufacturer of the Xline 2000R AM machine we are purchasing. Concept Laser is also the manufacturer of the Xline 1000R that we currently have at MSFC. GE has offered to trade in our existing 1000R for a new 2000R. OnlyGE can make this trade in so it must be worked directly with them. If other resellers attempted to negotiate they would not be able to authorize the factory discount. GE Concept Laser is also the only vendor that produces a AM machine with the required build volume of 800 x 400 x 500 mm3 (x,y,z) build volume and 2, 1 KW lasers.

Machines with a smaller build volume or a single laser will not allow MSFC to develop the RS25 manufacturing process or the knowledge base for certification of this process.

Not acquiring this system that has been offered will result in having to spend $2M to $3M to procure another machine. No other options are available in this volume.

10. Sources, if any, that expressed an interest in writing in the acquisition: Pursuant to FAR

Part 5.201, this acquisition will be synopsized on the Federal Business Opportunities (FBO). Any written inquiries received will be dispositioned appropriately and addressed within an addendum to this document.

11. The actions, if any, the Agency may take to remove or overcome barriers to competition before any subsequent acquisition for the supplies or services required: The Agency has no known actions that it may undertake to remove barriers to competition before any subsequent acquisition for the system is required. For the above reasons, full and open competition is not feasible. Therefore, the purchase of the equipment or services fromGE Concept Laser is the only practical approach.

ADDENDUM

Pursuant to FAR 5.201, the proposed contract action was synopsized on the FedBizOpps website on 06/17/2019 with that synopsis closing on 06/19/2019. No responses were received; therefore, this procurement should proceed as a sole source to General Electric (GE) Company Doing Business As (DBA) GE Additive based on the rationale stated in the justification and approval (PR: 4200701944).

I hereby accept the above stated recommendation and determine that the circumstances of the proposed contract action deem only one source reasonably available.
