Attachment 20 RFQ Questions and Answers

Solicitation 80LARC20Q0001

NASA Langley Occupational Health Services

1. Reference PWS Section 9.0, Fee-for-Service Question There will be implementation and on-going execution costs to institute onsite insurance company billing within the fee-for service program. Does the government consider these costs allowable direct charge items?

Answer Under this RFQ, the submission of a staffing plan is required as a technical consideration. It is up to the contractor to determine how to properly staff to fulfill this requirement. The staffing plan and pricing volume should align with one another. The cost in question are allowable. However, it’s at the contractors’ discretion if they would like to include the cost within the Firm- Fixed-Price portion or Fee-for-Service portion of the contract.

2. Reference PWS Section 9.0 Fee-for-Service Question There will be a requirement for utilization of IT infrastructure to implement onsite insurance company billing. Will the contractor be allowed to utilize the government provided IT infrastructure for this purpose?

Answer The only IT infrastructure that the Government will provide under this effort are employee laptops and desk phones. All other equipment and IT infrastructure required for billing and insurance purposes shall be provided by the Contractor. This may include, but is not limited to, a credit card machine or point of sale (POS) system for collection of payment.

3. Reference PWS Section 9.0, Fee-for-Service Question Is it correct to say that areas of the clinic and the fitness center were once free to Contractors and to Retirees but now there is a Fee for Service for these areas?

Answer No. Currently and historically, the fitness center has been a free service for Civil Servants. There is a cost for Contractors and Retirees, but the LaRC Exchange is responsible for billing and collecting these payments.

Currently and historically, some clinic requirements have been offered at no cost to Contractors and LaRC Retirees at the Clinic. However, many of the services provided to these individuals have been on a fee-for-service basis. Please reference RFQ Attachment 2, Current/Historical Usage and

Data, which outlines the differences between this requirement under this RFQ and the current Clinic contract.

4. Reference PWS Appendix B, Contract Breakdown Question Does the Fee for Service only apply to Contractors and to

Retirees (CIVIL SERVANT AND MILITARY) retirees?

Answer Due to the large volume of Fee-for-Service questions, an additional appendix has been added to the PWS. Please reference PWS Appendix B for the Firm-Fixed-Price and Fee-for-Service portions of the contract.

5. Reference PWS Appendix B, Contract Breakdown

Question Does the Fee for Service apply to the EAP as well?

reference PWS Appendix B, Contract Breakdown for the Firm- Fixed-Price and Fee-for-Service portions of the contract.

6. Reference PWS Appendix B, Contract Breakdown

Question So if this is correct, the following Fee for Service would apply ONLY to retirees and contractors and the areas that the Fee for service applies to are:

1. The fitness center

2. The clinic areas (Massage and Optician) and flu vaccines etc.

3. EAP services

4. OR is this statement TRUE "All areas of this contract have a Fee for Service for ONLY retirees (civil servant and military) as well as contractors" AND civil servants and Active duty military are never charged a Fee for Service for ANY service?

reference PWS Appendix B, Contract Breakdown for the Firm- Fixed-Price and Fee-for-Service portions of the contract.

7. Reference PWS Section 9.1

Question Does the Clinic currently have a specific Tax Identification Number (TIN) and National Provider Identifier (NPI) that the contractor would be expected to use to set up a group for insurance billing?

Answer Per PWS 9.1, the Contractor is responsible for collecting the fees charged by establishing separate billing arrangements with on-site contractors, billing private medical insurance, including Medicare and Medicaid, for services rendered along with other methods of payment (e.g., credit/debit card, check). The insurance applied will be provided by the individual patient, therefore, a Tax Identification Number and National Provider Identifies is not information that the Government is able to provide.

8. Reference PWS Section 9.1

Question Could the government please provide a list of the Health insurances and their Plan levels for all civil servants and contractors that would use the Occupational Health Clinic? This is critical to ensure the clinic is able to accept all required insurances.

Answer Per PWS Section 9.1, the link listed will lead you to the OPM website that list the 2019 healthcare plans offered to Civil Servants. Using that link, you will be able to navigate to the 2020 healthcare plans offered to Civil Servants. We have provided below the list of healthcare plans offered by some of the onsite Contractors at LaRC. This is not a complete list for all Contractors.

- Anthem Blue Cross Blue Shield

- Anthem Blue Cross Blue Shield PPO

- United Health Care PPO

- Blue Cross Blue Shield of Alabama PPO

- Care First, Blue Choice Inc-Healthy Blue

- Blue Cross Blue Shield High Deductible Health Plan

9. Reference PWS Section 9.1

Question Is the occupational health clinic currently credentialed with any insurances?

Answer No, currently the Clinic does not accept insurance.

10. Reference PWS Section 9.1

Question Will the government provide Electronic Health Record (EHR) access to a 3rd party Medical Billing company?

Answer No, the government will not provide Electronic Health Record (EHR) access to a 3rd party Medical Billing company. If a 3rd Party Medical Billing Company needs access to Electronic Health Records for billing purposes, a separate Health Records System will need to be provided by the Contractor for the Fee-for-Service offerings. If an external system is planned to be used under this effort the Contractor must provide a IT Security Plan (Exteneral System Security Plan), as outlined in Exhibit B, Contract Document Requirements, I. Required Report, O. IT Security Plan (External System Security Plan).

11. Reference PWS Section 9.2

Question Our experience shows that there can be a large difference between the invoiced and recovered amounts, which could result in a net loss to the contractor.

Can the government clarify if the 15% credit is on the invoiced amount or the recovered amount?

Answer The 15% credit shall be on the recovered amount.

12. Reference PWS Section 9.1

Question Credentialing an employee with insurance companies can take up to 8 months and the Clinic would not be able to accept that insurance until the process is completed.

If the Occupational Health Clinic and Clinic employees are not credentialed with any insurance companies, is the Government willing to waive the requirement until the credentialing has been processed?

Answer Due to credentialing concerns, PWS Section 9.1 has been updated to provide an eight-month grace period upon award of the contract to allow time for credentialing of employees.

However, during this eight-month period, the fee-for-services offerings shall still be made available to personnel with payment being collected by non-insurance methods (e.g., credit/debit card, check), as is currently being done on the current contract.

A.14 INSTRUCTIONS FOR TECHNICAL VOLUME –I (TECHNICAL

CONSIDERATIONS)

(a) The Quoter shall submit a Technical volume that describes their Staffing Approach as specified in paragraph (a)(1) below. The Government will evaluate the Technical volume for acceptability as set forth in Section B.

(1) Staffing Approach: The Quoter shall submit a Staffing Plan that demonstrates its approach to provide a fully qualified and trained staff to perform the PWS requirements of the contract (See Exhibit D, Position Requirements). The staffing plan shall include, at a minimum, the proposed positions, skill mix, and associated Work Year Equivalents (WYEs) to perform the PWS requirements. If subcontractors and/or other teaming entities are proposed, the Quoter’s Staffing Plan shall clearly detail the positions and its plan to seamlessly perform the PWS requirements.

A.15 INSTRUTIONS FOR PAST PERFORMANCE VOLUME – II (FACTOR 1)

(a) Quote Guidelines – The Quoter shall include in its quote the overall corporate or Quoter past performance, but not the past performance of individuals who are proposed to be involved in the required work, to demonstrate the Quoter’s performance under prior contracts for work that is relevant to the technical performance areas specified below. However, for newly formed businesses having little or no experience as the new business entity, the Quoter may submit the past performance of a predecessor business entity or the past performance of the company's principal owner(s) or corporate officer(s). Newly formed business entities submitting such information shall also submit a thorough and clear explanation of why such information should be considered predictive of the Quoter’s performance under a contract resulting from this solicitation. Quoters which are subsidiaries or affiliates of other business entities may submit the past performance of such other business entities for consideration but such past performance will only be considered to the extent that the quote clearly demonstrates that the resources of the other companies will affect the Quoter’s performance on the proposed contract. The Government will consider the past performance information (PPI) for the prime Quoter and subcontractors that are proposed to perform the technical performance areas when such information is recent and relevant to those areas.

(b) Quote Content – The quoter shall submit a maximum of three (3) contract references for the prime quoter and a maximum of two (2) references for each subcontractor that are recent and that the quoter considers to be the most relevant in demonstrating the ability to perform the five (5) technical performance areas identified below in A.15 (d). References may include Federal, State, or local Governments or private customer contracts. If the prime is a Joint Venture (JV), at least one (1) reference must be provided from the managing partner. If the contract reference is an overarching Indefinite Delivery/Indefinite Quantity (ID/IQ) or Blanket Purchase Agreement (BPA), the Government will only assess performance at the ID/IQ level and not performance on each individual underlying task/delivery order. If quoters desire assessment of an individual task/call/delivery/purchase order, the quoter shall submit that as a separate contract reference.

(c) Recency – Relevant contract references shall be on-going performance or have been completed within the past five (5) years (from the date the RFQ is issued) for requirements that are similar in scope to the requirements of this RFQ.

(d) Relevancy – It is the responsibility of the quoter to clearly and completely demonstrate in its Past Performance Volume the recency and relevancy of each of the submitted reference contracts for the same or similar services. Specifically, the quoter’s written past performance narrative shall demonstrate relevancy in the following technical performance areas (reference specific PWS paragraphs listed below):

i. Contractor’s experience in operating an occupational health clinic that provides illness and injury diagnosis and treatment, complete medical health examinations, and occupation-related examinations (reference PWS Sections 1.2.1 Injury and Illness, 9.3(a) Health Maintenance Exams, and 1.2.2 Occupation-Related Examinations must be demonstrated for relevancy).

ii. Contractor’s experience in providing and managing an Employee Assistance Program (EAP) that provides problem identification, counseling, referral to appropriate community or professional resources for long term treatment and rehabilitation; and follow‐up services for effective readjustment after treatment (reference PWS Section 2.1 Employee Assistance Program must be demonstrated for relevancy).

iii. Contractor’s experience in promoting and educating audiences on physical and mental health, fitness, regular physical exercise and screenings for early detection of diseases (reference PWS Section 3.1 NASA LaRC Center Occupational Health and Wellness Program Promotion and Coordination Support, Program Coordination and Communication must be demonstrated for relevancy).

iv. Contractor’s experience in developing and administering a comprehensive fitness assessment and maintenance program for optimal employee health (reference PWS Section 4.0 Operation of NASA LaRC Physical Fitness Program and Fitness Center).

v. Contractor’s experience in billing private medical insurance, including Medicare and Medicaid, for services rendered along with other methods of payment (e.g., credit/debit/check) (reference PWS Section 9.1 Fee-for-Service must be demonstrated for relevancy).

(e) For each contract references identified, the Quoter shall include:

a. Contract Number and Title

b. Contracting Agency

c. Points of contact in the program and contracting offices, including accurate telephone numbers and e-mail addresses.

d. If a Government Agency, include both the Contracting Officer

(CO/KO) and Contracting Officer’s Representative (COR) points of contact

e. Contractor’s Name, CAGE code and DUNS number

f. Original cost/price as well as actual cost/price

g. Base, fixed, incentive and award fee available, if applicable. Incentive and award fee actually earned (by contract year), if applicable

h. Contract type

i. Contract beginning and ending dates

j. Status of Contract (current, terminated (if so, why), successfully completed)

k. Annual contract dollar value (If other than the Prime, provide the overall contract value and the subcontract value)

(f) Work Performance Matrix - The quoter shall complete and provide RFQ Attachment 4, Work Performance Matrix describing which teaming partner (prime and/or subcontractor(s)) will perform the five (5) Technical Performance Areas identified in A.15 (d). The quoter shall list itself and subcontractors (if any) in Column 1, then indicate the percentage of work to be performed by each firm in the remaining columns.

Percentages may be rounded to the nearest multiple of 5. Columns 2 - 6 should each total to 100%. The Work Performance Matrix shall match the Written Past Performance Narrative, clearly detailing what portions of the Technical Performance Areas each proposed entity (e.g. prime, subcontractors) is responsible for and the specific resources (workforce, management, facilities, or other resources) to be employed and relied upon to perform the proposed effort.

(g) Independent Past Performance Information - The Government may consider data obtained from other sources including, but not limited to, the Contractor Performance Assessment Reporting System (CPARS), interviews and other references in addition to those provided by the quoter and its subcontractors. The Government may consider past performance information determined to be relevant to the performance of this contract including, but not limited to, (1) Quality of Services, (2) Management of Personnel, (3) Contract Transition, (4) Phase-In, and (5) Staffing and Retention. While NASA may elect to consider data obtained from other sources, quoters retain the burden of providing relevant references that NASA can readily contact and for presenting information establishing the relevance of their experience to NASA’s requirements under this RFQ.

(h) Consent Letters (To be submitted in the Business Volume - IV) - The Quoter shall submit a written consent letter (RFQ Attachment 9) from each proposed subcontractor, teaming partner, and/or joint venture partner authorizing the release of past performance information to the Quoter and to allow NASA to discuss the past performance information with the Quoter.

(i) Proposal Clarity - Offerors shall ensure that proposals are specific, complete, and concise.

Offerors are urged to examine this solicitation in its entirety and to assure that their proposals contain all necessary information, provide all required documentation, and are complete in all respects since proposal evaluations will be based on the actual material presented and not on the basis of what is implied. The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and substantiation of all information.

The proposal should not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the offeror intends to meet these requirements.

A.16 INSTRUCTIONS FOR PRICE VOLUME - III (FACTOR 2)

(a) Quoters shall comply with the instructions in this section and the instructions on the Pricing Forms (Reference Attachment 1, Pricing Forms). For planning purposes, the Quoters shall propose the below not-to-exceed amount annually for CLIN 0002.

CLIN 0002 will be a Cost Reimbursable CLIN for PWS Section 8.0 Other Direct Costs (Not-to-Exceed CLIN).

PWS Section 8.0

Other Direct Costs $40,000 Annually

(b) For assistance in developing quotes please references Attachment 2, Historical/Current Data. This data is for informational purposes only. The requirements in Exhibit A- Performance Work Statement are similar but not identical to those requirements being performed on the current contract. Attachment 2 provides a summary of the changes. Therefore, NASA expects Quoters to propose an appropriate staffing structure to align with the current requirements of Exhibit A- PWS. While the Government does not want to hinder the innovation and creativity of Quoters in determining their proposed approach to performing the requirements of the PWS, it does want to provide some information regarding workforce data, position descriptions and average Work Year Equivalents (WYE) utilized to support the Occupational Health Support Services Contract over the past several years, and Clinic and Fitness Center Historical Data.

(c) Quoters shall also provide a supporting narrative discussing their proposed price and the rationale and assumptions used for its estimates.

(d) Attachment 1, Pricing Forms, Form F –Fee-for-Service lists all of the mandatory fee-for-service items that shall be priced (Firm-Fixed-Price) as part of this requirement.

The Quoter may include additional fee-for-service items as desired, as stated in Exhibit A, PWS, paragraph 9.0. This pricing sheet will be incorporated as part of the purchase order award.

A.17 INSTRUCTIONS FOR BUSINESS VOLUME – IV

Quoters shall submit their business volume in accordance with Table A-1 above and 52.212-1(b).

The Quoter shall submit a signed contract quote (see FAR 4.102, Contractor’s Signature) with their original quote since it is anticipated that award will be made without discussions (see FAR 52.212-1, Instructions to Quoters-Commercial Items (Oct 2018). Quoters must also acknowledge any RFQ amendments.

A.18 LIMITATIONS ON SUBCONTRACTING

(a) Per FAR 52.219-14, Limitations on Subcontracting, (c)(1), Services, (except construction) - “At least 50 percent of the cost of contract performance incurred for personnel shall be expended for employees of the concern.” Each quote submitted in response to this solicitation will be reviewed for compliance with this requirement. For purposes of determining compliance with this clause, the “cost of the contract” and the “cost of contract performance incurred for personnel” are defined in 13 CFR 125.6. The quoter shall complete Attachment 1, Price Forms to demonstrate compliance.

(b) Any quote that does not meet this requirement will be considered unacceptable and will not be considered for award.

SECTION B – EVALUATION FACTORS FOR AWARD

B.1 SECTION M PROVISIONS INCORPORATED BY REFERENCE

CLAUSE

NUMBER

CLAUSE TITLE

52.217-5 EVALUATION OF OPTIONS (JUL 1990)

B.2 52.212-2 Evaluation - Commercial Items (Oct 2014) - The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

Provisions B.3 through B.4 describe the factors that shall be used to evaluate quotes.

B.3 BASIS FOR AWARD

(a) This competitive best value source selection will be conducted in accordance with Federal

Acquisition Regulation (FAR) Part 12 Acquisition of Commercial Items, FAR Part 13.5 Simplified Procedures for Certain Commercial Items, and this solicitation using a best value tradeoff between Past Performance and Price.

(b) The Technical Volume’s “Technical Considerations” will be evaluated for acceptability (pass/fail basis) and the final selection decision will be based on a tradeoff (see FAR 13.106- 2(b)(4)(ii)) between the Past Performance and Price factors.

(c) Overall, in the selection of a Contractor for contract award, the Past Performance Factor is approximately equal to the Price Factor.

(d) In accordance with Clause 1852.219-11, award will only be made to an eligible 8(a) Small Business concern or 8(a) Joint Venture expressly certified by the Small Business Administration in the SBA’s 8(a) program (see clause 52.219-18 Notification Of Competition Limited To Eligible 8(a) Concerns (APR 2015) and that meets the requirements of clause 52.219-14, Limitations on Subcontracting (JAN 2019).

B.4 METHOD OF EVALUATION

(a) Quotes received in response to this solicitation will be evaluated by a Source Selection Evaluation Team, hereafter referred to as “evaluation team”, as follows:

Step 1 – Identify the Lowest-Priced Quote - The Government will rank all quotes based on price, from lowest to highest price, to identify the four (4) lowest-priced quotes. A quoter’s proposed price will be determined by the Total Proposed Price (TPP) which is the amount proposed in Attachment 1, Form A, Price Summary, “SUM OF ALL TOTAL AMOUNTS – BASE PLUS OPTIONS” (Including Cost Reimbursable CLIN 0002 – ODCs).

Step 2 – The Government will evaluate the Technical Volume –I for the four (4) lowest-priced quotes from Step 1 for “acceptability” based on the quoter’s ability to meet the “Technical Consideration” as set forth in Provision A.14. Ratings will be assigned as follows:

• “Acceptable” - A quote will be rated “Acceptable” under the Technical Volume, based on the quoter providing a staffing plan that demonstrates its approach to provide fully qualified and trained staff to perform the PWS requirements of the contract.

• “Unacceptable” – A quote will be rated “Unacceptable” under the Technical Volume, based on the quoter providing a staffing plan that does not demonstrate its approach to provide fully qualified and trained staff to perform the PWS requirements of the contract.

• “Potentially Acceptable” – A quote will be rated “Potentially Acceptable” under the Technical Volume when, after the initial evaluation, the quote does not fully meet the definition for an “Acceptable” or “Unacceptable” rating and the SET anticipates additional information that could be provided by the quoter during discussions, if held, or through minor quote revision, would result in a quote rating of “Acceptable” (“pass”).

Step 2(a): If during the technical evaluation process, the Government determines that any of the initial lowest-priced quotes are rated “Unacceptable”, the Government will include the next lowest-priced quote not originally included. The process to include additional quotes will continue until four (4) of the lowest-priced quotes are rated “Acceptable” or “Potentially Acceptable” or until all Quoters have been considered.

Quotes that are rated as “Unacceptable” will be eliminated from further consideration and notified accordingly. All “Acceptable” and “Potentially Acceptable” quotes will continue in the evaluation process.

Step 3 - The Government will evaluate the Past Performance and Price Volumes for the Quoters remaining from Step 3 where the Technical Volumes were rated as “Acceptable” or “Potentially Acceptable.” The evaluation will continue as follows:

Step 3(a): Past Performance Evaluation: The Government will evaluate the quoter’s past performance references for Recency (as defined in A.15(c)), Relevancy (as defined in A.15(d)), and Performance. Quoters’ past performance references must meet the Recency definition in order to be evaluated for Relevancy. In assessing Relevancy, the Government will consider the degree of similarity of worked performed under each referenced contract to the technical performance areas listed in A.15(d), considering the amount and type of work each entity is proposed to perform under this contract (Government will refer to quoter’s completed Attachment 4, Work Performance Matrix). The relevancy assessment may also consider the size (annual dollar value)/magnitude of the referenced contract. In assessing Performance, the Government will assess the quoter’s overall performance record for demonstrated experience in the Technical Performance Areas listed in A.15(d) for the work each entity is proposed to perform. The performance assessment will be based primarily on, but not limited to, past performance evaluation input from sources such as those listed in A.15(g).

The Past Performance factor is not numerically weighted or scored. The Government will assign a confidence rating as set forth below:

Very High Level of Confidence

The Quoter’s relevant past performance is of exceptional merit and is very highly relevant to this acquisition, indicates exemplary performance in a timely, efficient, and economical manner and very minor (if any) problems with no adverse effect on overall performance. Based on the Quoter’s performance record, there is a very high level of confidence that the Quoter will successfully perform the required effort.

Step 3(b) – Price Evaluation: The Government will perform a price analysis in accordance with FAR 13.106-3 by evaluating the prices proposed in response to this RFQ to determine if the prices are fair and reasonable. The price analysis will include, but may not be limited to, comparing all proposed prices and comparing each proposed price to the Independent Government Cost Estimate. In addition, the Government will evaluate the quoter’s compliance with Wage Determination (WD) requirements, as well as Limitations on Subcontracting (FAR 52.219-14). The Source Selection Authority’s (SSA) comparative assessment of quotes will be based on the Total Proposed Price (Total Base and Option Periods) in Attachment 1, Pricing Forms, Form A – Price Summary.

High Level of

The Quoter’s relevant past performance is highly relevant to this acquisition;

demonstrating very effective performance that would be fully responsive to contract requirements. Quoter’s past performance indicates that contract requirements were accomplished in a timely, efficient, and economical manner for the most part, with only minor problems that had little identifiable effect on overall performance. Based on the Quoter’s performance record, there is a high level of confidence that the Quoter will successfully perform the required effort.

Moderate

The Quoter’s relevant past performance is relevant to this acquisition, and it demonstrates effective performance. Performance was fully responsive to contract requirements; there may have been reportable problems, but with little identifiable effect on overall performance. Based on the Quoter’s performance record, there is a moderate level of confidence that the Quoter will successfully perform the required effort.

Low Level of

The Quoter’s relevant past performance is at least somewhat relevant to this acquisition, and it meets or slightly exceeds minimum acceptable standards. Quoter achieved adequate results; there may have been reportable problems with identifiable, but not substantial, effects on overall performance. Based on the Quoter’s performance record, there is a low level of confidence that the Quoter will successfully perform the required effort. Changes to the Quoter’s existing processes may be necessary in order to achieve contract requirements.

Very Low

The Quoter’s relevant past performance does not meet minimum acceptable standards in one or more areas; remedial action was required in one or more areas. Performance problems occurred in one or more areas which, adversely affected overall performance. Based on the Quoter’s performance record, there is a very low level of confidence that the Quoter will successfully perform the required effort.

Neutral In the case of a Quoter without a record of relevant past performance or for whom information on past performance is not available, the Quoter may not be evaluated favorably or unfavorably on past performance.

The Government will evaluate the pricing data requested in Section A.16 to determine if the quoter’s price reflects a clear understanding of the requirements.
