About this file

This justification provides rationale for awarding a sole-source bridge contract to the incumbent, Logical Innovations, Inc., to continue providing Center Administrative and Technical Support Services (CATSS) to the National Aeronautics and Space Administration Armstrong Flight Research Center (NASA AFRC). The bridge contract is necessary due to a protest filed on the recently awarded follow-on contract, which does not allow sufficient time for another full and open competition. Logical Innovations, Inc. is uniquely qualified as the incumbent provider to continue essential CATSS functions without disruption, leveraging personnel with existing security clearances and experience supporting NASA AFRC requirements. The bridge contract value is approximately for a six-month base period to continue services until resolution of the protest, after which the follow-on award will be made.

Armstrong Flight Research Center

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(JOFOC)

For 80AFRC23R0048/Center Administrative and Technical Support Services (CATSS II) Bridge

JOFOC #FY23-08

1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”

This document is a justification for other than full and open competition prepared by National Aeronautics and Space Administration (NASA) Armstrong Flight Research Center

(AFRC).

The procuring agency is the National Aeronautics and Space Administration (NASA) and the contracting activity is AFRC.

2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:

This justification provides the rationale for contracting by other than full and open competition to award a sole-source contract to Logical Innovations, Inc. The proposed procurement is for the acquisition of Center Administrative and Technical Support Services (CATSS) functions to support NASA-AFRC activities. Disruption of the phase-in of the new contract award does not provide sufficient time for another solution that will satisfy agency requirements. It is determined that the work and services covered by the current contract are vital to the NASA mission and must be maintained without interruption, both at the commencement and the expiration of this contract.

3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the Agency’s needs (including the estimated value):

The contractor shall perform high quality administrative and technical support services to assist NASA-AFRC to fulfill its missions. These services include functions support to NASA-AFRC and B703 through ongoing requirements and special projects. Some temporary work or support may be required at local communities or other locations. The functional areas supported are: Technical Publications Office, Office of Internal Controls and Management Systems, Administrative Office Support (Center-Wide), and Business Systems Support (Center-Wide).

The estimated value for one, six-month base period is plus on other direct costs (ODCs).

4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is 10 U.S.C.

3204(a)(2), as implemented by FAR 6.302-2 Unusual and compelling urgency.

5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The rationale supporting the use of 10 U.S.C. 3204(a)(2) is Unusual and compelling urgency for continuation of supplies and services from only one source as described below.

It is determined that this requirement to be available only from the original source for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements. Logical Innovations, Inc., as the current contractor, has the personnel on-site already to perform this bridge contract. The bridge contract is a short term remedy to allow continued performance until the resolution of the protest to the competed award to the follow-on contract.

A lapse in service and award to a new contractor that is not familiar with AFRC’s or B703’s requirements could be detrimental to the AFRC mission. As the incumbent contractor, Logical Innovations, Inc. provides the following advantages:

Personnel with a Secret security clearance, which could prevent a delay in services while a new contractor attempts to gain clearance for their personnel.

Adequate personnel and experience to continue providing critical administrative and support services.

6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:

The Contracting Officer has determined that this action is exempt from the notice required in FAR 5.202(a)(2), because unusual and compelling urgency precludes competition to the maximum extent practicable and the Government would be seriously injured if the agency complies with the publicizing and response time periods specified in FAR 5.203.

Due to the contract expiring on August 31, 2023, and the protest was filed on August 14, 2023, AFRC has a small window to award a bridge contract to continue current levels of support. Because the protest was filed during phase-in of the new contract, the current action will only be solicited from the current contractor. Logical Innovation has been performing the required services for the last seven years and have the experience and personnel capable to continue performing services without having a lapse in service.

7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. The Contractor shall be required to submit a proposal to be evaluated and negotiated by the Government. Prior to execution of the contractual instrument, a proposal analysis will be performed. The proposal analysis will ensure that the final agreed-to price for the contract action is fair and reasonable.

The bridge contract will be priced using the labor rates agreed upon the most current Service Contract Labor Standards Wage Determinations 2015-5603 Rev 22 (Kern County) and 2015- 5613 Rev 24 (Los Angeles County).

8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons market research was not conducted:

Market research was conducted as part of the solicitation process. The requirement was competed and an award was made. This action is due to a protest that doesn’t allow sufficient time to do another competition. Another competition would also be duplicative of the efforts performed to make the award. Logical Innovations is no longer a small business under NAICS code 561110, but to avoid a lapse in service it is recommended to make a direct award to Logical Innovations. The new award once the protest is resolved will be made to a small business regardless of the outcome of the protest.

9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:

Although there is a possibility there may be other sources capable of providing these services at AFRC for the proposed extension, it is not in NASA’s best interest to award a competitive contract to bridge the performance period identified without substantial disruption in services and significant impact to the AFRC mission. Continuity of services is imperative in meeting the ongoing AFRC CATSS requirement to mitigate impact to the center’s daily operations.

10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:

The competition for the CATSS follow-on contract provided several proposals from vendors. These had been evaluated and a selection made. No other action is needed beyond the resolution of the protest.

11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

The government competed this action for follow-on services as a small business set-aside.

There were no other barriers to this competed action. Delay is due to a post award protest filed on August 14, 2023, that prevents continuation of services from the awardee.
