STATEMENT OF WORK

BACKGROUND, PURPOSE, AND OBJECTIVES:

Multiple Award Schedule 736 for Temporary Administrative and Professional Staffing (TAPS) Services is intended to provide Federal agencies with a temporary solution i.e. staff augmentation, which would allow agencies to quickly respond to changing staffing requirements that arise when critical projects temporarily warrant more assistance or when key staff members are unavailable for work due to emergency, accident, illness, family responsibilities, jury services, etc. Services furnished by temporary help firms shall be performed by their employees who shall not be considered or treated as Federal employees for any purpose, shall not be regarded as performing personal service, and shall not be eligible for civil service employee benefits, including retirement. This schedule is not to be used to provide personal services as defined by FAR 2.101 and 37.101. Positions can be filled for an initial 120 workday basis with the ability to extend for an additional 120 days, not to exceed 240 days. Examples of positions that may be filled using this schedule include, but are not limited to the following: administrative assistant, personal computer support technician, fork lift operator, library aide/clerk, engineering technician, etc.

This solicitation is for commercial temporary, administrative and professional staffing services to be provided on a “temporary or contingent” basis (Task Orders are not to exceed 240 workdays). The Government contemplates award to private sector temporary help service establishments. A temporary help service firm is a private sector entity which quickly provides other organizations with specific services performed by its pool of employees, possessing the appropriate work skills, for brief or intermittent periods. For this solicitation it should be for NAICS Code 561320. The firm is the legally responsible employer and maintains that relationship during the time its employees are assigned to a client. The firm, not the client organization, recruits, tests, hires, trains, assigns, pays, provides benefits and leave to, and as necessary, addresses performance problems, disciplines, and terminates its employees. Among other employer obligations, the firm is responsible for payroll deductions and payment of income taxes, social security (FICA), unemployment insurance, and workers' compensation, and shall provide required liability insurance and bonding.

This solicitation will not to be used to solicit for facilities management, consultant, counseling, management, supervision, team lead, project management, business improvement, programming, design, health occupations, engineering services, financial audits, legal services, training, IT system integration, network services, software or software development, database planning, marketing, media, human resources, construction, alteration or repair of building structures, or other real property type contracts. Tasks may vary depending upon the assignment, i.e., assignments may require specialized knowledge of current commercially available software packages for word processing, electronic calendars, cc-mail or e-mail, spreadsheets, electronic forms, etc.

As shown in the Schedule of Items section, Geographic Coverage Requirements, Contractors are required to show area(s) they wish to service. Periodic adjustments to the rates are subject to clauses 552.216-70 (Economic Price Adjustment—FSS Multiple Award Schedule Contracts) (Alternate I), 52.222-43 Fair Labor Standards Act and Service Contract Act - Price Adjustment (Multiple Year and Option Contracts),22.1006(c)(1) I-FSS-969 Economic Price Adjustment—Fss Multiple Award. Schedule (JAN 2002) and 552.238-75 (Price Reductions).

The Contractor will act independently and not as an agent of the Government. The Contractor shall initiate work only when directed by a Task Order and which has been signed by a Contracting Officer from the ordering agency.

ORDERING PROCEDURES FOR SERVICES:

Orders placed against a GSA Multiple Award Schedule (MAS) contract, using the procedures under Federal Acquisition Regulation (FAR) 8.4, are considered to be issued under full and open competition (see FAR 6.102(d)(3)). Ordering offices do not need to seek further competition, synopsize the requirement, or make a separate determination of fair and reasonable pricing. By placing an order against a GSA Schedule contract using the procedures in this section, the ordering office has concluded that the order represents the best value and results in the lowest overall cost alternative to meet the government's needs.
