JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Pearl Harbor Naval Shipyard and Intermediate Maintenance Facility (PHNSY&IMF) Contracts Division Code 400.

2. Description of the Action Being Approved

A sole source contract action will be awarded to Fairbanks Morse, LLC (Fairbanks) to provide services as the qualified Original Equipment Manufacturer (OEM) to inspect, disassemble and repair the Emergency Diesel Generator (EDG) Scavenging Air Blower.

3. Description of Supplies/Services

a. Repair and overhaul of Emergency

Diesel Generator Scavenging Air Blower.

b. The total estimated dollar value: $547,644.00

c. Period of Performance:

e. The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C.2304(c)(1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirement.

5. Rationale Justifying Use of Cited Statutory Authority

The Repair and Overhaul requires a qualified Original Equipment Manufacturer (OEM) representative to inspect, disassemble and repair the EDG Scavenging Air Blower. Per Engineering and Planning Department (EPD), Fairbanks Morse owns the necessary equipment and is experienced in performing the appropriate procedures and services identified in Paragraph 3.a. They are currently the only known vendor that has performed this particular repair and is the OEM of Emergency Diesel Generators on

As the OEM, Fairbanks will be able to provide proprietary specialized materials, tools and equipment to accomplish the repair in accordance with proprietary drawings and specifications.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

The proposed contract was synopsized on the U.S.

Government’s website Beta.Sam.Gov. A sources sought was published on 22 March 2021 and no other potential sources expressed interest on this requirement. No additional market research was conducted because it is not practicable, for reasons discussed in paragraph 5 above, for any company other than Fairbanks to provide the required supplies and services.

7. Determination of Fair and Reasonable Costs (Required if over

$250,000; otherwise delete)

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. PHNSY Code 410.2 previously awarded contract in support of for a similar requirement awarded to Fairbanks Morse. This contract will be used to compare the proposal received in response to the solicitation.

8. Actions to Remove Barriers to Competition (Required if over

$250,000; otherwise delete)

For the reasons set forth in Paragraph 5, Pearl Harbor Naval Shipyard and Intermediate Maintenance Facility (PHNSY & IMF) has no plans at this time to compete future contracts for this type of supply covered by this document. If another potential source emerges, PHNSY & IMF will assess whether competition for future requirements is feasible.
