About this file

This document is an addendum to an Invitation to Bid (ITB) issued by the Florida Department of Agriculture and Consumer Services, Florida Forest Service (FFS) for the construction of the Washington Crossing seawall located in Ebro, Florida. The project consists of constructing a seawall along Pine Log Creek. The addendum provides answers to vendor questions regarding the project timeline, permitting requirements, insurance coverage, and other specifications. The solicitation has a final completion deadline of September 1, 2025 due to funding limitations. A mandatory pre-bid meeting was held on October 16, 2024, and the attendance list is provided. The seawall materials are specified in the plans, and the solicitation is open to bids from licensed Florida marine contractors.

The project was funded for $475,000. Bidders are required to provide a builders risk policy, but the policy can be bound only during the period when work is being performed. The FFS will work with the awarded contractor on any design changes that may be needed during construction. Removal and disposal of trees and debris will be handled by the FFS.

ADDENDUM TWO

DATE: October 23, 2024

TO: Vendors Addressed

FROM: Michelle O. Faircloth

RE: ITB FFS 24 25 76

Washington Crossing Seawall

This addendum is to provide answers to questions received in reference to this request for Invitation to Bid (ITB).

Question / Answer

1. Funding for the Work above is likely tied to a schedule deadline. In accordance with below, please consider extending the deadline.

• Solicitation Award & Protest Period ~ 1 Mo (November 2024)

• Agreement, Bond, Insurance & Holiday's ~ 1 Mo (December 2024)

• Submittals, Reviews & Approvals ~ 1 Mo (January 2025)

• Steel Pile Procurement Mill Rolling ~ 4 Mo (February 2025 thru May 2025)

• Hot Dip Galvanizing of Steel Pile ~ 1 Mo (June 2025)

• Mobilization & Field Work Duration ~ 2 Mo (July 2025 thru August 2025)

• Final Completion & Acceptance ~1 Mo (September 2025)

Due to limitations on funding, the final completion date cannot be changed. Funding will not carry past September 1st, 2025.

2. I am inquiring about the Washington Crossing Seawall (Bid #: ITB FFS 24 25 76). Could you please share the mandatory pre-bid meeting/site-visit attendance list?

Attendance list is attached.

3. Additionally, is the material for the seawall defined yet (e.g. concrete, vinyl, steel?

The materials are specified in the set of plans. Please refer to the General Notes on page 1.

4. Section 2.3 Permit reads "The contractor is responsible for obtaining and paying for any and all permitting required, including any other drawings, design or engineering which may be needed for those permits, to fully complete this project." Some of the permits required for this project will take a long time to acquire.

a. Do you have an Army Corp. permit? N/A

i. Will this permit required? N/A

b. Do you have a FDEP permit? No.

ii. Will this permit be required? Answer below.

FFS is working with FDEP and has submitted a permit application, FFS will pay for any permitting fees necessary for this project.

5. Section 11.2 (1) Workers Compensation Insurance does not mention USL&H (Longshore & Harbor Workers Compensation Act) coverage. This should be a requirement for workers performing the work described in the bid documents.

Pine Log Creek is not commerce driven navigable water body. This insurance is not required in this instance.

6. Section 11.2 (7) Builders Risk Coverage reads "The Contractor shall procure and maintain during the life of this Agreement a “Builder’s Risk Policy” in an amount equal to 100% of the Contract Price, issued to provide coverages on an “all risk” basis including theft. This coverage shall not be lapsed or cancelled because of partial occupancy by the Owner prior to Final Completion." Builder's Risk is a cost for the amount of time the policy is binding. This means the coverage cannot/should not be bound until there is work being performed onsite. The time from contract execution to NTP should not be required for Builder's Risk Coverage. Also, it will be near impossible to find an underwriter to provide coverage on a project like this.

a. Will a Builder's Risk policy be required?

Yes, a builders risk policy will be required.

b. Will the Builder's Risk coverage be bound only during the time work is being performed?

As long as the policy is enforced at the beginning of work and continues through completion, FFS will not have any issues. Please refer to your insurance agent.

7. What is the project budget or engineers estimate? I need this for bid bond estimation purposes. The estimate you provide will not impact my bid amount.

The project was funded for $475,000.00

8. In order for each contractor to provide you with a competitive bid we need to all bid the same information to you. Please provide a quantity of fill estimated for the project. You can adjust your bid form to also require a per cy cost for any structural fill. This can be adjusted during to project for additional materials needed or deducts of materials not used.

a. What is the cubic yardage of structural fill needed for the project?

The Project is 11 ½ feet wide and 550 feet long, due to topography an exact number cannot be given. The site visit allowed time for measurements to determine fill needed.

9. The access to the waterfront work area is limited by a concrete pool behind the veteran's lodge. Every piece of equipment and every load of structural fill will go right next to this pool.

a. To what extend do we need to protect the pool?

The pool should be protected, but there is enough room on the side to grant access. The FFS contract manager will work with awarded bidder to ensure access.

10. The project work site is not very wide. We will likely need to build our way in and backfill as we go to have enough room to access with an excavator large enough to do this work.

a. Is the wall designed to handle the load of a 40,000 excavator after it is constructed?

A determination of load for a 40,000-pound excavator was not in the scope of the drawings. We understand this may be a limitation.

11. Detail 2 of sheets A1.1 and A2.1 shows one rod for each W6x20 piling. We have concerns that having a tie-rod on only 1 side of the "H" pile will cause the piling to begin to twist and as a result make the wall crooked.

a. Are you open to a different design for the seawall?

All design changes as the work progresses will be approved by the contact manager and the FFS as the need arises.

12. Will we be required to haul off all of the trees and debris removed to perform the work of this project?

Trees and debris will be placed in an agreed upon staging area and then be removed and disposed of by FFS.

13. Section 2.4 reads "Substantial Completion Deadline is May June 30,2025."

a. How many calendar days are from the Notice to Proceed to Substantial Completion?

FFS will make every effort to ensure a timely notice to proceed is given to the awarded bidder. Unfortunately, due to the financial policies and procedures an exact date cannot be given at this time, a good estimate is 150 days.

14. Section Could you please share the mandatory pre-bid meeting/site-visit attendance list?

Attendance list is attached.

15. Additionally, is the material for the seawall defined yet (e.g. concrete, vinyl, steel?

The materials are specified in the set of plans. Please refer to the General Notes on page 1.

16. Can you please advise the licenses required for this solicitation - we are a Specialty Marine Contractor registered with the State of Florida - we have a contract in place with the City of Miami Beach specifically regarding the maintenance and construction of seawalls. The solicitation documents state that you need to be either " at a minimum, Registered Contractor, Certified Building Contractor, General Contractor or Underground Utility and Excavation Contractor license". We would determine from that language that our solicitation response would not be accepted?

FFS would obliged to accept a bid from a registered Florida Marine Contractor. Your license would be acceptable for this project.

This Addendum is hereby incorporated into and made a part of the above noted ITB. All other terms, conditions, and specifications of this ITB will remain the same. For questions regarding this Addendum, please contact the Purchasing Office at Bids@FDACS.gov.
