1 Solicitation Sections A - J

We understand that the period of performance will include a base period and four option periods. Can HRSA share the expected start date for the IDIQ? The anticipated start date is by the end of September 2024.

Solicitation Instructions (Section L)

Please confirm whether the First Task Order proposal should be included in Volume I. Technical Proposal. The summary of due dates includes the First Task Order proposal in Volume III, while the organization of the technical proposal includes the First Task Order Technical and Management Approach as Section F in Volume I. Technical Proposal.

The First Task Order Technical and Management Approach should be included in Volume I. See Section L.3.1.F.

Solicitation Instructions (Section L)

The final RFP specifies that the Technical Proposal shall include a section about the First Task Order Technical and Management Approach and a section about Section 508 Compliance. Please confirm that, with the addition of these two sections between the draft and final RFP, the page length continues to be limited to 50 pages.

Please advise if HRSA Section 508 VPAT can be included as an Appendix (i.e., not contributing to the limit of 50 pages for the technical proposal).

VPAT will not count towards the total page limit. The total page limit for Volume I has been increased to 75 pages.

Awardable Sample Task Order for BOD Support

Can HRSA provide the estimated start date and level of effort for the Task Order?

The estimated start date for the BOD Task Order will be September 2024.

The level of effort for the BOD Task Order should be proposed by the vendor to meet the requirements of the Performance Work Statement (PWS).

Awardable Sample Task Order for BOD Support

In Section 6.3, the RFP states that the BOD Executive Director and Program Manager should attend the kickoff meeting. Please clarify whether this Executive Director would be the current executive director of the BOD or the project director for the awarded Task Order. In addition, please confirm that the key personnel for the Task Order are the BOD Executive Director and Program Manager.

Please see updated work statement. The Executive Director is not expected to attend the kickoff meeting. The Executive Director nomination and support under this task order is for a new Executive Director, distinct from the current one or a task order project director. The key personnel for the awarded BOD Task Order will be the Executive Director and Program Manager.

6 Awardable Sample Task Order for BOD Support

The RFP states that the technical proposal shall not exceed 50 single-spaced pages, excluding resumes and other required appendices. Can HRSA clarify/confirm that resumes are only required for key personnel? Is there a page limit for resume length?

Technical Proposal page limit has been increased to 75 pages. Resumes are only required for Key Personnel, which should be added as appendices and will not count towards the page limit.

Awardable Sample Task Order for BOD Support

The RFP specifies that the contractor shall “coordinate and manage an annual nomination and elections process overseen by the Nominating committee to determine members of the Board of Directors as well as to select members of the Board of Directors to serve on the EC.” The RFP specifies that the contractor shall develop the process in collaboration with the Board of Directors and the Nominating Committee, and post the approved process on the OPTN website. The RFP does not include information on when the nomination and elections process should take place. Can HRSA clarify when this process should take place?

Timeframes, including nomination and elections dates, will be determined during the collaboration process with the contractor, BOD and Nominating Committee.

Government Responses to Vendor Questions to Final RFP

Performance Work Statement (PWS)

May the contractor provide an honoraria and reimbursement for travel to in-person meetings for the volunteers on the OPTN Board of Directors (other than the paid Executive Director)? If so, are there a limitation on the honoraria amount.

This work will be supported under the Operations IDIQ and awarded Task Orders under that IDIQ.

Performance Work Statement (PWS)

The RFP states that the contractor shall: “Review current OPTN Board of Directors structure and composition requirements within NOTA, the OPTN final rule, and OPTN bylaws, and review and analyze stakeholder feedback, public input, and industry best practices to produce a report for HRSA on the most effective governance structure for the OPTN Board of Directors.” The Awardable Task Order specifies that the comprehensive review will include stakeholder feedback and public input. Can HRSA please confirm that the contractor would be reviewing and analyzing previously collected stakeholder feedback and public input and not collecting new stakeholder feedback and public input?

The contractor will be responsible for reviewing, analyzing and collecting new stakeholder feedback and public input in addition to reviewing and analyzing any previously collected stakeholder feedback and public input.

Performance Work Statement (PWS)

The RFP states that “All entities contracted to support the OPTN, including the Board Support Contractor, shall meet on a regular basis to be determined by HRSA to report on the status of deliverables and action items and shared metrics, conduct strategic planning, collaborate on innovative reforms, identify and address risks, and implement the HRSA OPTN Modernization Initiative.” Can HRSA specify what is meant by “a regular basis” for budgeting purposes?

For the purposes of budgeting, a regular basis means monthly.

11 Performance Work Statement (PWS)

Does HRSA intend for the Executive Director to become an employee of the Board Support Contractor or function as an independent consultant to the Board (non-employed)?

Vendors are free to propose the option that best meets the work statement requirements.

Performance Work Statement (PWS)

In light of HRSA’s sole source action to hire a contractor to “incorporate” the OPTN, should the contractor assume that OPTN is/will be incorporated under the laws of some jurisdiction on a completely separate track from the IDIQ response the contractor is preparing?

Yes. The Contractor can assume for proposal purposes that the OPTN Board will be incorporated under the laws of a jurisdiction, under the separate existing contract, and not under contracts resulting from this solicitation.

13 Solicitation Sections A - J Is there a pricing format that HRSA would like bidders to utilize?

Cost and pricing data must be prepared with supporting attachments which satisfy the instructions and appropriate format prescribed in Table 15-2 of FAR Part 15.408 and the specific requirements under Section L.5.

Evaluation Factors For Award (Section M)

The RFP states that the Government “will conduct a past performance evaluation of the Offeror’s past performance as well of its subcontractors (if applicable).” Among the three past performance examples, is the contractor required and/or allowed to submit past performance examples from its subcontractors, and is there a limitation as to the number of examples a subcontractor may provide?

Past performance references must be where the Offeror was the prime contractor or subcontractor for relevant work completed within the past 3 years. References must demonstrate the prime contractor's involvement.

Section M has been revised for consistency.

15 Solicitation Instructions (Section L)

Please confirm that subcontracts are not required to submit cost and pricing data at the proposal stage.

Subcontractors will be required to submit their cost and pricing data to the prime for the proposal.
