FAR 52.212-1 - Instructions to Offerors - Commercial Products and Commercial Services (NOV 2021), applies to this acquisition.

General

Contained herein are the minimally acceptable requirements for quote information that is to be submitted in accordance with the following instructions for the format and content of quotes.

Offeror’s shall submit the quote volumes stated below to be considered responsive to this solicitation, no exceptions. Failure to submit a completed quote by the time that quotes are due will result in the exclusion from further consideration by the Government for award.

Quotes shall stipulate that it is predicated upon all the terms and conditions of this solicitation. In addition, it must contain a statement to the effect that the quote is valid for a period of at least 60 days from the date of receipt by the Government. Offerors shall submit quotes and data comprehensive enough to provide the basis for a sound evaluation. The data and information should be precise, factual, and responsive and shall be keyed to each paragraph of the technical quote requirements as outlined below.

Quote information shall be submitted in separate volumes and clearly labeled. Each volume shall be separate and complete unto itself so that the evaluation of one volume may be accomplished independently of the evaluation of the other volume(s).

Quotes shall be submitted in three (3) volumes as follows:

Volume Title

I Technical Quote II Past Performance III Business Quote

The solicitation shall be signed by an official authorized to bind your organization and shall be submitted with your quote by email by the date and time specified on page 1 of the solicitation to Charisse Whitney at cwhitney@hrsa.gov.

All questions and/or inquiries concerning this solicitation shall be submitted via email to Charisse Whitney at cwhitney@hrsa.gov by 10AM Central Time, July 13, 2022. Questions submitted after the due date and time for questions will not be accepted. Any resulting addition, deletion, or change to the solicitation will be made by issuing a formal amendment. Offerors are

Title: Orthotics Technician Services; Attachment C – Clauses, Instructions and Evaluation; Solicitation instructed to contact only the issuing contract office in connection with any aspect of this requirement prior to contract award.

Electronic documents submitted as part of your quote shall be submitted in Word or PDF, single spaced, printable on 8.5 x 11-inch paper, paginated front to back, font 12 Times New Roman, .5 to 1 inch margins, and searchable. Pricing information shall be submitted in MS Excel format with formulas intact. Each page shall be numbered in a page X of Y format, for example; page 1 of 3, page 2 or 3, page 3 of 3. Each page shall include a header that states the organizational name and if applicable a footer on applicable pages that notes that proprietary information. Each volume shall be formatted to include a table of contents which corresponds to the section of that volume.

Technical Quotes shall not exceed 15 pages, excluding attachments, addendums, resumes and other required appendices. Offerors are advised to strictly observe limitations on the length and format specified since review of the quote will be limited to 15 pages. There is no page limit for the business quote.

Where data and/or information appear in one volume, it does not have to be repeated in any other part. However, if data and/or information does appear in more than one volume it shall be cross referenced by indicating the specific location including the volume and page number as a minimum. The clarity, relevance, and conciseness of the quote is important, not the length.

The Government will evaluate quotes in accordance with the evaluation criteria set forth within this solicitation.

This solicitation does not commit the Government to pay any cost for preparation or submission of a quote. In addition, the Contracting Officer is the only individual who can legally commit the Government to the expenditure of public funds in connection with this proposed acquisition.

United States Governmental, or Department of Health and Human Services, or Health Resources Services Administration, or National Hansen’s Disease Program letterhead and/or logo should not be included in your quote. Your quote also should not include quotes from past contracts unless it is requested in the past performance section.

Past Performance Instructions – Volume II

Volume II – Past Performance shall contain information related to the offerors past performance on past contracts where the offeror was the prime contractor or subcontractor for relevant work completed within the past three (3) years as required by this solicitation. “Relevant” is defined as similar in size, scope and complexity to this procurement.

Title: Orthotics Technician Services; Attachment C – Clauses, Instructions and Evaluation; Solicitation

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial items or commercial services for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and-

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

Factor 1: Technical Factor 2: Past Performance Factor 3: Price

Each of the three (3) factors will be evaluated on a stand-alone basis. Factor 1 – Technical; will be evaluated on either acceptable or unacceptable basis. Factor 2 – Past Performance; will be evaluated using Past Performance Relevancy Rating Standards and Performance Confidence Assessments Standards. Factor 3 – Price; will be evaluated on a total price basis and reasonableness.

Title: Orthotics Technician Services; Attachment C – Clauses, Instructions and Evaluation; Solicitation

Selection of Offeror(s):

1. Each quote will be evaluated in strict conformity with the Solicitation, utilizing written critiques.

2. The Government reserves the right to make an award without further discussion of quotes received. Therefore, it is important that your quote be submitted initially on the most favorable terms from both the technical and cost standpoints.

3. The Government reserves the right to make a single award, multiple awards, or no award as a result of this solicitation. In addition, the solicitation may be amended if determined to be in the best interest of the Government. The Government reserves the right to make award without discussions.

Evaluation:

Factor 1 – Technical.

The following Technical Factors will be evaluated on an acceptable or unacceptable basis, using the ratings and descriptions outlined as follows:

Acceptable – Quote clearly meets the minimum requirements of the solicitation.

Unacceptable – Quote does not clearly meet the minimum requirements of the solicitation.

1. Understanding the Scope of Work

The Government will evaluate the Offeror’s:

• Understanding of the mission of the NHDP and of the objectives and tasks described in the SOW.

• Demonstrated understanding of peripheral nerve damage and the management of the secondary effects of nerve damage.

2. Technical Approach

The Government will evaluate the Offeror’s technical approach to meeting each of requirements within the solicitation.

3. Key Personnel and Staffing Plan

The Government will evaluate the Offeror’s:

• Staffing plan to for backfilling the orthotics technician assigned under the resultant contract.

Title: Orthotics Technician Services; Attachment C – Clauses, Instructions and Evaluation; Solicitation

• Proposed orthotics technician to ensure they have the necessary knowledge, skills and abilities as required by this solicitation.

Factor 2 - Past Performance.

The Offeror’s past performance will be evaluated in accordance with the following Past Performance Relevancy Rating Standards and Performance Confidence Assessments Standards.

The Government will conduct a past performance evaluation of the Offeror’s past performance as well as that of its subcontractors (if applicable). Past performance consists of past performance relevancy and performance confidence; thus, the Offeror will be assigned two (2) ratings for past performance: First, the Government will evaluate the Offeror’s past performance references to determine how relevant a recent effort is to the current requirement for source selection. Common aspects of relevance include similarity of service/support, complexity, magnitude of effort, dollar value, and contract type. Second, the Government will evaluate the Offeror’ s past performance to determine the quality of work performed and assess the level of expectation that the Offeror can successfully perform the required effort.

Past Performance Relevancy Rating Standards

Rating Definition

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

FAR 52.212-3 Offeror Representations and Certifications-Commercial Products and Commercial Services (MAY 2022), applies to this acquisition.
