About this file

This document is a set of questions and answers (Q&A) related to a Request for Quotation (RFQ) issued by the Department of Health and Human Services (HHS) Office of the National Coordinator for Health Information Technology (ONC) for a National Survey of Digital Health Companies.

The key details include:

  • This is the first time ONC has solicited proposals for this scope of work, with no previous incumbent.
  • The survey was previously conducted by the University of California at San Francisco (UCSF) under a grant from the California Health Care Foundation.
  • Incentives for survey participants may be included in the business proposal but must be pre-approved.
  • Proposals are due on June 13, 2024 at 4:00 PM ET.
  • The solicitation is not a small business set-aside, so the Limitations on Subcontracting clause (FAR 52.219-14) does not apply.
  • ONC's logo may be used on the survey to indicate ONC funding, but HHS's website is not required as the survey distribution method.
  • The anticipated contract value is not being released due to the competitive nature of the requirement.

Answer/Response
1
Is there a previous incumbent for this solicitation?

No. This is the first time ONC has solicited proposals to be performed for this scope of work.

2
If previous incumbent, are you able to provide the contract number?

N/A

3
Can you clarify if a Contractor performed the “survey of digital health companies to assess digital health companies’ use of and experiences with adopting APIs to integrate with EHRs from June – November 2022” located on Page 5 of the Solicitation or was this performed in-house? I have been able to locate the open source article (https://academic.oup.com/jamia/article/31/4/866/7590608) for the survey but have been unable to located a potential contract or grant this was resultant from.

If this was performed through a Contract, could you kindly provide the Contract number so I may identify the correct company who performed this survey?

ONC previously partnered with the California Health Care Foundation on a survey of digital health companies. CHCF funded the work and made a grant to the University of California at San Francisco (UCSF) to complete the work.

4
Was the ONC 2022 survey referenced in the solicitation conducted by ONC or was that performed by contractors? If it was done by contractors, would you please provide the contractor’s name?

ONC previously partnered with the California Health Care Foundation on a survey of digital health companies. CHCF funded the work and made a grant to the University of California at San Francisco (UCSF) to complete the work.

5
Would a company working on SBIRs in the digital health space be precluded from performing this work - would it be considered as ‘conflict of interest’?

Participating in a Small Business Innovation Research (SBIR) would not preclude the vendor from performing this work.

6
Would we need to provide letters of support from relevant entities willing to work with us or could we mention the entities in the proposal without letters of support. We are planning on using subject matter experts as consultants on the project.

Letters of support are not required, just include a bio/resume of the consultants

7
Does the 25 page limit for the "Technical proposal" apply to just the Technical Volume or to the entire proposal consisting of all three Volumes for Technical, Business, and Past Performance Information?

The 25-page limit does not include the business proposal and past performance information volume, which are separate.

8
Will a cover sheet for the Technical Volume be counted towards the 25 page limit? We understand that the Table of Contents is not included in the page count.

No, a cover sheet will not be counted toward the 25-page limit.

9
Does our response to Factor 4 – Past Performance (which is evaluated as Pass/Fail) in the Technical Volume count towards the 25 page count?

No. Past performance information can be submitted as a separate volume and includes the Past Performance Questionnaire posted with the solicitation.

10
Does our response to Factor 5 – HHS Section 508 and Accessibility Standards (which is evaluated as Acceptable/Unacceptable) in the Technical Volume count towards the 25 page count?

Information included in the technical proposal relevant to compliance with the established EIT accessibility standards counts toward the 25-page limit of the technical volume. However, the completed HHS 508 Evaluation Template does not count toward the 25-page limit.

11
Please confirm that we will discuss our past performance (defined as "experience" related to "type and amount of work previously performed by a contractor") in the Technical Volume under Factor 4 - Past Performance and our past "performance" (defined as "quality and how well a contractor performed") in the Past Performance Information Volume.

Past performance information can be submitted as a separate volume and includes the Past Performance Questionnaire posted with the solicitation.

12
The solicitation requests information on organizational experience under Factor 2 - Personnel ("Demonstrates previous organizational experience in performing survey work similar to that outlined in the SOW.") and also under Factor 4 - Past Performance ("Describes the offeror’s (within 10 years) experience performing the same or similar work as that described in the SOW.")

To avoid providing ONC with duplicative information, we request clarification on which section of the Technical Volume should address organizational experience.

Factor 2 – Personnel reflects the ability of personnel to perform work which can include their prior experience and expertise. This is where the abilities and skills of individual personnel can be described. Factor 4 – Past Performance is specific to the offeror/vendor submitting the proposal. This describes the vendor/offeror’s organizational experience to perform the work.

13
The solicitation requests "3 references" under Factor 4 - Past Performance of the Technical Volume, and also "A maximum of seven (7) performance references" under the Past Performance Information Volume.

Please clarify whether ONC seeks 3 separate references in the Technical Volume and no more than 7 references in the Past Performance Information Volume. May these references be repeated?

Offeror provides a description of the organization’s past performance in Factor 4 of the Technical Proposal. The Past Performance Information volume includes the information included in the instructions for past performance information related to the past performance described in the Technical Proposal volume.

14
Section G.2 states that "Unless the Contracting Officer provides explicit written approval for gift card/gift certificate expenses, such expenses are not allowable under this contract." Is proposing incentives for survey participants allowable?

Yes, incentives for survey completion may be included in the business proposal but must be pre-approved.

15
Section L.7 Business Proposal Instructions states that "offerors shall include a completed copy of Section B of the solicitation in its proposal. Business proposals shall include pricing for each contract line item (CLIN) specified in Section B, as well as the total price for the entire contract." Is further breakout of the proposed fixed price required to be submitted with the Business Proposal, or just the total fixed price for each contract line item (CLIN) specified in Section B?

Offerors’ business proposal shall include pricing for each contract line item (CLIN) specified in Section B, as well as the total price for the entire contract. Additional information beyond this is not required.

16
Page 1, Box 8, of the solicitation indicates the Offer Due Date is May 30, 2024 at 4:00PM ET. However, page 66 states “[t]he quote must be submitted no later than June 13, 2024 at 4:00 PM Eastern Time.” Can you please clarify if the due date/time is June 13, 2024 at 4:00 PM ET?

Proposals are due June 13, 2024 at 4:00 PM Eastern Time

17
Although this solicitation was not released as a set-aside, FAR 52.219-14 (Limitations on Subcontracting) is incorporated into the Contract Terms and Conditions as listed on Page 40. Can you please confirm that FAR 52.219-14 does not apply?

FAR 52.219-14 does not apply, this solicitation in not a small business set aside

18
Per solicitation page 33, “[u]nless the Contracting Officer provides explicit written approval for gift card/gift certificate expenses, such expenses are not allowable under this contract.” Can you please clarify whether this includes how incentives may be distributed?

Incentives for survey completion may be included in the business proposal but must be pre-approved.

19
What is the anticipated value of this project?

Because this is a competitive requirement, an anticipated value is not being released.

20
Will contractors be able to use the logo and sponsorship of the Office of the National Coordinator for Health Information Technology to ensure sufficient credibility in our mailings and contacts with potential respondents?

Yes, the survey may contain the ONC logo to indicate that the work is funded by ONC.

21
Would it be possible to use HHS’ website as the gateway for the survey?

The offeror’s technical proposal should include their proposed method of distributing the survey. HHS’ website is not a required gateway for the survey.
