B.5 CONSIDERATION AND PAYMENT (T&M – Severable Services)

In consideration of satisfactory performance of the work as described throughout this contract, the Contractor shall be paid in accordance with the fixed loaded hourly rates as shown herein for the specified categories of labor based on the number of actual hours incurred in the performance of the work specified.

Fully loaded rates shall be all inclusive of direct labor, fringe benefits, applicable indirect costs, and any profit for each labor category. Additionally, the contractor shall be paid for materials and travel directly chargeable to this contract. If the options are exercised funding will be obligated by modification to the contract. L.7 INQUIRIES/SUBMISSION

All questions/inquiries concerning the solicitation document must be submitted by e-mail (no faxes or telephone calls please) to the Contract Specialist, no later than July 20th, 2020 at 12:00 pm Eastern Time. Questions should be e-mailed to the following address:

sonja.scott@psc.hhs.gov. The Government's response to the inquiries will be posted on FedBizOpps. Any resulting additions, deletions or changes to the solicitation will be made by issuance of a formal amendment. Offerors are instructed specifically to contact only the issuing contract office in connection with any aspect of this requirement prior to contract award. The Government does not intend to extend the due date for proposals.

The proposal must be submitted no later than August 10th, 2020 at 12:00 pm Eastern Time.

L.9 TECHNICAL PROPOSAL INSTRUCTIONS (Time and Materials / Labor Hour)

Technical proposals shall be limited to 50 double-spaced pages, with 1-inch margins, and using not less than 12 point font. Offerors are encouraged to be succinct and economical in their presentation. Excessive volume and elaborate presentation are unnecessary. Cover Letter, Tables of contents, and works cited and the Technical Appendices are not included in the page count.

The technical proposal must not contain references to price; however, resource information, such as data concerning labor hours and categories, materials, subcontracts, etc., must be contained in the technical proposal so that your understanding of the scope of work may be evaluated. It must disclose your technical approach in sufficient detail to provide a clear and concise presentation that includes, but is not limited to, the requirements of the technical proposal instructions. The proposal shall contain a response to each of the factors and subfactors identified in Section L and will be evaluated in accordance with Section M. Proposals which merely offer to conduct a project in accordance with the requirements of the Government's scope of work will not be eligible for award. The technical proposal should reflect a clear understanding of the nature of the work being undertaken.

Technical Appendices:

The technical appendices shall only include transcripts, resumes, Staffing Chart, and letters of commitment.

The technical proposal shall address the following factors:

FACTOR 1 - Understanding of the Issues and Purpose of the Project

The proposal shall demonstrate that the offerors understanding of the mission of the Office of Refugee

Resettlement, Division of Unaccompanied Children Operations Services.

The proposal shall demonstrates the Offeror’s comprehensive understanding of child welfare services, juvenile justice, family reunification and release risk assessment, mental health, and child placement.

Special attention should be given to demonstrating a clear understanding of the specific role of the Case Coordinator in the field setting.

The proposal shall demonstrates the Offeror’s clear and innovative understanding of the program management responsibilities.

FACTOR 2 - Technical Approach

The proposal shall demonstrate that the offeror understands the work. The proposal shall demonstrate a clear and comprehensive methodology for carrying out the objectives of the SOW, defined tasks, and implementation of the project.

The proposal shall provides a clear plan for program management, including the provision of technical and program activities that are necessary for the effective project management of the SOW. Special attention should be given to the ability to child welfare based recommendations, ability to coordinate and oversee the safe and timely release of children, assess child behavioral issues, create safety plans, find and establish connections with community providers, staffing cases and reviewing individual service planning.

The proposal shall include a description of the particular methods and techniques for completing each task requirement. Clear description of how the program design is appropriate for the targeted population, taking into account culture, native language and special needs of UAC.

The proposal shall demonstrates a comprehensive overview of the applicant’s organization, including qualification, performance history, organizational mission and goals.

The proposal shall describe a staffing plan that provides a sound relationship between the propose responsibilities of Project Manager, Supervisory Case Coordinator, Director Operation Coordinator and Case Coordinator in successfully executing project management.

The proposal shall addresse the educational, professional experience and technical capabilities required for key positions according to requirements outlined in the SOW.

FACTOR 3 - Organizational Profile

The proposal shall demonstrate the ability to supervise a regional or national network of professionals with child welfare and multi-disciplinary expertise, as outlined by the SOW. Offeror must demonstrate adequate knowledge and experience showing how they can provide support for a national network.

The organization’s ability to hire and train necessary personnel and related support staff when required by a specific task.

The proposal shall demonstrate the application of a management structure to be utilized by the project team while working on the project.

The proposal shall demonstrate a clear organizational structure of the proposed program that describes delineation of authority, roles and responsibilities and supervision across the entire organization

The proposal shall demonstrate experience with cultural competency. Demonstrate ability to provide child welfare services to children with various cultural backgrounds, and various language capabilities, special needs, including vulnerability of human trafficking.

The proposal shall demonstrate ability of the organization to provide recommendations free from conflicts of interest or conflicts of financial incentives.

The proposal shall provide a staffing chart depicting labor categories and level of efforts necessary to provide the services described in section C..

FACTOR 4 - Key Personnel Staff

The proposal shall demonstrate a proposed Project Manager with availability for a full-time commitment to the project who demonstrates experiences and success in managing projects of this magnitude, complexity, and sensitivity. Project Manager who demonstrates extensive experience and high level of expertise child welfare and scope of work.

The proposal shall demonstrate resumes for each proposed key staff; letters of intent for staff members whose hiring is contingent upon award of the contract; a full time commitment for each person on the contract; and when staff will be available to begin working under this award. If certain staff has not yet been identified, the Offeror should specify the qualifications these persons would be expected to possess.

FACTOR 5 - Section 508 Compliance

The offeror must demonstrate their compliance with the applicable Section 508 standards. This includes submitting the completed HHS Section 508 Evaluation Template (Attachment J.2), Information about Section 508 is available at http://www.section508.gov/. L.10 BUSINESS PROPOSAL INSTRUCTIONS (Time and Materials / Labor Hour)

The Business Proposal shall contain the following information:

L.10.1 Offerors must complete and include Standard Form 33, blocks 12 through 18.

Completion of this form indicates that the Offeror agrees with all the terms and conditions contained in solicitation Sections A through M. In addition, the proposal must contain a statement to the effect that it is firm for a period of at least 120 days from the date of receipt thereof by the Government.

L.10.2 Proposal Bidding Assumptions

To assist Offerors in the preparation of their proposals, the Government presents the following bidding assumptions. Offeror’s are expected to make an independent assessment of the resources required to perform the tasks described in Section C. Offerors should use their own judgment based on their experience and approach to completion of this project to propose the cost appropriate for the requirement. Offerors shall include a completed copy of Section B of the solicitation in its proposal. Business proposals shall include pricing for each contract line item (CLIN) specified in Section B as well as the cumulative price estimate for the entire contract.

Effort:

Effort should be projected out across for the base and three periods, FTE hours assumed on 2080 hours annually.

Locations:

Listed in the SOW are the areas for which coverage is to be provided, along with the projected bed capacity.

The areas and/or projected bed capacity are subject to change should there be additions to the ORR shelter network. Based on the coverage areas listed below, the Contractor shall have coverage for a funded capacity of 14,500 UAC with the ability to meet the demands associated with potential expansions of licensed and emergency influx funded capacity. The Contractor shall provide full coverage for the areas identified in the SOW and additional areas as needed.

Material Costs:

Cost shall be included for leased laptops + home office setups, printers and supplies for staff.

Travel:

Travel funding in the event direct on-site work is needs in other locations. Travel will cover local mileage, travel to various ORR care provider location.

L.10.3 Cost or Pricing Data

(a) Submission of certified cost or pricing data is not required.

(b) Provide the data described below:

The Offeror shall submit a price proposal adequate to determine whether the proposed pricing is consistent with the technical proposal and level of effort anticipated. Items 1 through 3 shall be addressed by each task per CLIN:

1. Labor - Labor estimates shall be supported with breakdowns by individual tasks including the number of labor hours estimated for each proposed labor category by CLIN.

2. Material Costs - Include in this category estimated costs for all materials associated with providing the type of service to be acquired (e.g., direct materials, subcontracts for supplies and incidental services for which there is not a labor category specified in the contract, and other direct costs such as incidental services for which there is not a labor category in the contract, travel, computer usage charges, etc.). A complete explanation of each material element, detailing the rationale used in developing the estimate must be included as well as supporting documentation.

3. Material Indirect Costs - Indirect costs shall be proposed in accordance with the Offeror's current negotiated indirect rate agreement. The Offeror shall provide the name, address and telephone number of its cognizant Government audit agency and a copy of its latest negotiated rate agreement. If the Offeror does not have a negotiated rate agreement, the indirect rates proposed must be fully justified and are subject to negotiation.

4. Financial Capacity - The Offeror shall indicate if it has the necessary financial capacity, working capital, and other resources to perform this contract without assistance from any outside sources. (If not, indicate the amount required, the anticipated source, and associated costs for such support.)

The Offeror shall submit any information deemed relevant to convincingly demonstrate its ability to perform the requirement from a financial point of view; this may include providing a copy of the Offeror's most recent financial statement.

5. Commitments - The Offeror shall list commitments of key personnel with other clients/contracts and indicate whether these commitments will or will not interfere with the completion of work and services contemplated to be completed under this contract.

L.10.4 SUBCONTRACTING PLAN

All Offerors, other than those certifying themselves as a small business under the authorized NAICS industry subsector, shall provide a completed "Small Business Subcontracting Plan" in accordance with the instructions provided in FAR Clause 52.219-9 "Small Business Subcontracting Plan - Alternate II". Shown below are the subcontracting goals for HHS. These subcontracting goals are based on the total subcontracting dollar of the contract.

If subcontractors are proposed, Offerors shall include a commitment letter from the subcontractor detailing:

(1) Willingness to perform as a subcontractor for specific duties (list duties).

(2) What priority the work will be given and how it will relate to other work.

(3) The amount of time and facilities available to this project.

(4) Information on their cognizant field audit offices.

(5) How rights to publications and patents are to be handled.

(6) A complete price proposal in the same format as the Offeror's price proposal.

(7) For each subcontract over $700,000, the support should provide a listing by source, item, quantity, price, type of subcontract, degree of competition, and bases for establishing source and reasonableness of price, as well as the result of review and evaluation of subcontract proposals when required.

An acceptable plan must, in the determination of the Contracting Officer, provide the maximum opportunity for small business concerns and small business concerns owned and controlled by socially and economically disadvantaged persons to participate in the performance of the contract. If the apparently successful offeror fails to negotiate a subcontracting plan acceptable to the contracting officer within the time limit prescribed by the contracting officer, the offeror will be ineligible for award.

L.10.6 REPRESENTATIONS AND CERTIFICATIONS

A completed and executed copy of Section K - Representations, Certifications and Other Statements of Offerors or Respondents, must be included as part of your business proposal.

L.10.7 ORGANIZATIONAL CONFLICT OF INTEREST DISCLOSURE/MITIGATION

Offerors are required to identify actual and potential organizational conflicts of interest (OCI) related to the services described in the statement of work for itself, as well as employees, consultants and subcontractors proposed. This includes, but is not limited to:

- The existence of conflicting roles that might bias judgment; and

- Access to nonpublic information that will give the offeror an unfair competitive advantage.

Offerors shall include an explanation of the process used to identify OCIs. If an actual or potential OCI is identified, the offeror shall submit a mitigation plan as part of its proposal.

Offerors shall submit with their proposal an OCI affirmation, using the following language:

"I, (Name and Title), warrant that: 1) I am an official authorized to bind the entity; and 2) to the best of my knowledge and belief , actual and potential organizational conflicts of interest have been identified, and disclosed to the Contracting Officer (identify section of proposal) as of (Date)."

SECTION M - Evaluation Factors for Award

M.5 ADJECTIVAL RATING SCHEME

The Government will evaluate the Technical Proposal using the following color/adjectival coded ratings. Each factor will receive one of the color/adjective coded ratings defined below, and then there will be an overall color/adjectival coded rating for the proposal.

TECHNICAL EVALUATION FACTORS

FACTOR 1 - Understanding of the Issues and Purpose of the Project

1. Offeror will be evaluated on the extent to which its proposal demonstrates a clear understanding of the mission of the Office of Refugee Resettlement, Division of Unaccompanied Children Operations Services.

2. Offeror will be evaluated on the extent to which its proposal demonstrates the ability to establish a comprehensive understanding of child welfare services, juvenile justice, family reunification and release risk assessment, mental health, and child placement.

3. Offeror will be evaluated on the extent to which its proposal demonstrates clear and innovative understanding of the program management responsibilities.

4. Offeror will be evaluated on the extent to which its proposal demonstrates a clear and innovative understanding of the specific role of the Case Coordinator in the field setting.

FACTOR 2 - Technical Approach

1. Offeror will be evaluated on the extent to which its proposal demonstrates an understanding of the work, including a clear and comprehensive methodology for carrying out the objectives of the SOW, defined tasks, and implementation of the project.

2. Offeror will be evaluated on the extent to which its proposal demonstrates a clear plan for program management, includes the provision of technical and program activities that are necessary for the effective project management of the SOW. Special attention should be given to the ability to child welfare based recommendations, ability to coordinate and oversee the safe and timely release of children, assess child

5. Offeror will be evaluated on the extent to which its proposal demonstrates a comprehensive overview of the applicant’s organization, including qualification, performance history, organizational mission and goals.

6. Offeror will be evaluated on the extent to which its proposal describe a staffing plan that provides a sound relationship between the propose responsibilities of Project Manager, Supervisory Case Coordinator, Director Operation Coordinator and Case Coordinator in successfully executing project management.

7. Offeror will be evaluated on the extent to which its proposal address the educational, professional experience technical capabilities required for key positions according to requirements outlined in the

SOW.

FACTOR 3 - Organizational Profile

1. Offeror will be evaluated on the extent to which its proposal demonstrates the ability to supervise a regional or national network of professionals with child welfare and multi-disciplinary expertise, as outlined by the SOW.

2. Offeror will be evaluated on the extent to which its proposal demonstrates knowledge and experience showing how they can provide support for a national network.

3. Offeror will be evaluated on the extent to which its proposal demonstrates the organization’s ability to hire and train necessary personnel and related support staff when required by a specific task.

4. Offeror will be evaluated on the extent to which its proposal demonstrates the application of a management structure to be utilized by the project team while working on the project.

5. Offeror will be evaluated on the extent to which its proposal demonstrates a clear organizational structure of the proposed program that describes delineation of authority, roles and responsibilities and supervision across the entire organization

6. Offeror will be evaluated on the extent to which its proposal demonstrates experience with cultural competency. Demonstrate ability to provide child welfare services to children with various cultural backgrounds, and various language capabilities, special needs, including vulnerability of human trafficking.

7. Offeror will be evaluated on the extent to which its proposal demonstrates the ability of the organization to provide recommendations free from conflicts of interest or conflicts of financial incentives.

8. Offeror will be evaluated on the extent to which proposal demonstrates a clear staffing chart depicting labor categories and level of efforts necessary to provide the services described in section C. as part of the evaluation to the government will be considering whether the level of effort and labor mix in the staffing chart is appropriate for the work to be performed.

FACTOR 4 - Key Personnel Staff

1. Offeror will be evaluated on the extent to which its proposal delivers a proposed Supervisory Case

Coordinator, Director Operations Coordinator, Supervisory Case Coordinator that demonstrate a fulltime commitment to the project and who possess the quality and level of education in working with similar populations and projects. Please note personnel with Masters in Social Work and personnel with specific experience working with child welfare services, juvenile justice, family reunification, immigrant youth and families and trafficking victims as described in the SOW is significant.

2. Offeror will be evaluated on the extent to which its proposal demonstrates experiences and success in managing projects of this magnitude, complexity, and sensitivity of a proposed Project Manager with availability for a full-time commitment to the project.

3. Offeror will be evaluated on the extent to which its proposal delivers a Project Manager who demonstrates extensive experience and high level of expertise child welfare.

4. Offeror will be evaluated on the extent to which its proposal provides resumes for each proposed key staff; letters of intent for staff members whose hiring is contingent upon award of the contract; a full time commitment for each person on the contract; and when staff will be available to begin working under this award. If certain staff has not yet been identified, the Offeror should specify the qualifications these persons would be expected to possess.

FACTOR 5 - SECTION 508 COMPLIANCE (ACCEPTABLE/UNACCEPTABLE)

In order to be evaluated as "Acceptable", the offeror must complete the HHS 508 Evaluation Template, demonstrate compliance with the established EIT accessibility standards for the duration of the contract, and the technical proposal must include a binding statement of conformance to the established EIT accessibility standards.

It is unclear against what bed capacity the government will evaluate compliance with the Subtask 1.10 requirement of no more than 85 beds to 1 Case Coordinator. The solicitation notes a requirement for a funded capacity of 14,500 beds throughout, but the location assignments add up to only 10,031 beds.

Please confirm that bidders are required to propose staffing levels based on the assumption of 14,500 beds for the base period and each option period while utilizing the location assignments as reference for cost and other assumptions; and tha the proposed Case Coordinator ratio of Coordinator to beds cannot be less than 1:85 beds per CC.

The location assignments were based on the ORR funded capacity.

However, the 14,500 bed capacity is inclusive of ORR reserve capacity and unforseen surges in bed capacity. As stated in the SOW, the areas and/or projected bed capacity are subject to change should there be additions to the ORR shelter network. Capacity may vary depending on migration patterns. As stated in the SOW, the contrctor shall be prepared to scale operations to meet fluctuations in capacity.
