JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

Acquisition Year (FY): 2020

Author: Michelle Haney

2. Description of Action:

Nature: New Requirement Follow-on Order

Modification to Existing Delivery/Task Order/Contract Number:

Order Against: Multiple Award ID/IQ Contract Number: HHSN316201200078W

Pricing: Firm-Fixed Price Time & Materials Cost Type

3. Description of Applicable Contract Provisions:

N/A

4. Description of Supplies or Services:

The estimated value of the proposed action, including all options, is: $ 365,433.38

The Contractor shall support the new requirement of HHS Reimagine, on behalf of the U.S. Department of Health and Human Services (HHS), Program Support Center (PSC), Financial Management Portfolio (PSC), Payment Management Service (PMS), to allow all recipient users of the Payment Management System (the System) to access the System through GSA’s Login.gov. The Payment Management Service provides grants payment and cash management services to HHS and other Federal Agencies. The System is a designated High Value Asset (HVA) and is used by both the awarding agencies and the recipients of grants and contracts to request draw downs, reports, expenditures and review related reports.

The Contractor shall implement the functionality to allow recipients to create credentials at GSA Login.gov; manage the interface to the System; and perform full life cycle of the System Change Request in the System.

The period of performance is four (4) months.

5. Authority and Rationale:

The Contracting Officer shall give every awardee a fair opportunity to be considered for a delivery/task order exceeding the micro purchase threshold unless one of the following statutory exceptions applies. FAR 16.505(b)(2). Mark the applicable exception:

The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays [FAR 16.505(b)(2)(i)(A)];

Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized [FAR 16.505(b)(2)(i)(B)];

Digital Management, LLC (DMI) is the only known contractor that can meet the requirements. DMI has familiarity with the Legacy Code base of the current data structures and development caveats that will be augmented within Payment Management Systems FFR Module. DMI personnel have been vetted with appropriate high security clearances to access the System through the NIH VPN as well as the appropriate clearances at HHS/ASA/PSC for access to the Development tools required to update the FFR module. These are all time consuming vetting activities required by the two Agencies. DMI's modification of the current FFR reporting module is inherently feasible as they are intimately knowledgeable of COBAL/PL SQL and the programmatic nuances that enable rapid code integration and development that include database updates, code testing, compliance with current High System development requirements and FIPS 199 rated security compliance.

The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order [FAR 16.505(b)(2)(i)(C)];

It is necessary to place the order to satisfy a minimum guarantee [FAR 16.505(b)(2)(i)(D)]; or

A statute expressly authorizes or requires that the purchase be made from a specified source. [FAR 16.505(b)(2)(i)(E)].

6. Agency Actions to Take or Remove Barriers That Led to Fair Opportunity Exception (If applicable):

Describe the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration prior to any subsequent acquisition for the supplies of services is made. If no such actions have been taken, explain why.

The agency is taking steps to make future requirements can be made available for competition. The agency will build a 30 day knowledge transfer plan for ease of transitioning to a new contract provider into the resulting contract, as is aware the Payment Management System code base needs to be overhauled for ease of programming ability for future ease of development.

7. Fair and Reasonable Price/Cost Determination: I hereby determine that the anticipated price/cost for this contract action will be fair and reasonable.

Before award, the contracting officer will ensure that the pricing is fair and reasonable. The fully loaded hourly rates established at the NITAAC/CIO-SP3 contract level have already been determined fair and reasonable and price analysis will be conducted to ensure the quoted rates are consistent with those on DMI’s CIO-SP3 contract. Further, the price analysis will consider the level of effort and labor mix to ensure it is appropriate for the work to be performed, as well as historical information on prices previously paid. No open market costs are anticipated.

Tight time-lines of 4 months to accomplish this request as the Presidents Management Agenda (PMA) and the HHS Reimagine initiatives are scheduled for completion in an 8 month time period as these efforts are politically time sensitive.
