Statement of Work NIH Water Treatment Supplies BPA

Background:

The National Institutes of Health (NIH), a part of the U.S. Department of Health and Human Services, is the nation’s biomedical research agency – making important discoveries that improve health and save lives. NIH is made of 27 institutes and centers, each with a specific research agenda. Given scale of operations, the National Institutes of Health leases multiple facilities in addition to their own buildings.

Currently the NIH has a reoccurring need for varying amounts of water treatment supplies monthly. These supplies are utilized to maintain critical infrastructure key to ensuring continual operations in support of NIH operations and research.

Location of work:

The purpose of this Blanket Purchase Agreement (BPA) is to provide water treatment supplies, to include 50 LB BAGS OF WATER SOFTENING SALTS (MORTONS 1501 or Equivalent), which includes but is not limited to NIH Buildings on the Bethesda, Poolesville, Fort Detrick, Maryland Campuses which the contractor may perform for the Government if and when requested by the Contracting Officer.

Project Scope:

WATER TREATMENT SUPPLIES BLANKET PURCHASE AGREEMENT (BPA) FOR THE

NATIONAL INSTITUTES OF HEALTH OFFICE OF RESEARCH FACILITIES,

BETHESDA, MARYLAND

This Master Blanket Purchase Agreement (BPA) is hereby made to address reoccurring needs for water treatment supplies, including softening salts (50lb Bags Morton Salt 1501 or Equivalent), with CALLs up to $45,000 per order. This BPA may be in effect for three years.

Annual review of BPAs will be performed to determine whether the Government is receiving fair and reasonable pricing, usage and participation, which may result in either continuing the BPA or early expiration. When Request for Quotes are offered, the prime BPA Contractor must submit a quote to the requesting Government Contracting Officer (CO) or Contract Specialists (CS) within the stated time according to the RFQ. If an agreement vendor fails to provide a quote on three consecutive projects, the vendor may have their BPA terminated and replaced with another vendor.

BPA Calls Up to: $45,000.00

EXTENT OF OBLIGATION: The Government is not obligated to place any calls under this BPA. The Government is only obligated to the extent authorized by the calls that are placed.

PRICING: The prices to the Government for all materials, equipment, labor and supervision provided under the BPA shall be as low as, or lower than these charged the contractor’s most favored customer for comparable quantities under similar terms and conditions.

PURCHASE LIMITATIONS: Calls will typically be no more than $45,000.00, the Government reserves the right to place orders up to the Simplified Acquisition Threshold ($250,000.00) under this agreement if it so chooses.

CALL PROCEDURES: When a need for additional products are identified, the CO/CS will transmit a Request for Quotes to all BPA holders. The Terms and Conditions set forth in this agreement shall be applicable to all orders, and therefore will not be reiterated in the RFQ unless the CO determines it necessary for the requirement to include additional terms and conditions.

a. The BPA holder shall provide a quote to the requesting CO/CS for products and delivery within the specified time requested. Quotes shall be guaranteed for a period of 14 business days from the date submitted.

b. Quotes will be evaluated by Lowest Price Method only, unless otherwise stated by the CO in the RFQ.

c. The Contracting Officer will notify the BPA holders of the Government’s decision to award a Call. Only the CO has this authority to obligate the Government.

d. Upon award of a call. The Contractor must contact the Contracting Officers Representative (COR) to coordinate delivery times and locations, unless specified as an emergency call in the RFQ. Due to the congestion of vehicular traffic and pedestrian traffic at NIH locations, deliveries requiring a Tractor Trailer will be required to be performed outside of normal duty hours (Mon-Fri 7am – 5pm EST) unless coordinated prior to delivery with the COR.

e. After successful delivery of the required products, the contractor will notify the COR. Inspection and acceptance will be in accordance with those governing commercial items and services. If any deficiencies or damaged goods are identified after delivery, the contractor maybe liable for the return of said items and required to replace with acceptable items that conform to the requirements set forth in this agreement or those of the call.

f. When accepted by the COR, the contractor may invoice for their Call based on the items supplied and the cost of delivery.

NOTICE OF INDIVIDUALS AUTHORIZED TO PURCHASE UNDER THE BPA AND

THEIR DOLLAR LIMITATIONS: A list of individuals authorized to place Calls under this agreement (specifying dollar limitations per call) will be furnished separately by letter to the Contractor. The CO at the time of orders will also designate a COR who is authorized to contact the contractor as needed to have supplies acquired under the order delivered as needed.

A Contracting Officer must issue that letter.

The Contractor, by acceptance, must identify the name and contact information for all persons authorized by their Company to accept and sign Calls under this BPA. These persons will be the main points of contact regarding all matters under this agreement, and all orders that arise from the agreement.

POST CALL AWARD PROCEDURES: After award of a Call, a Contracting Officer Representative (COR) will be assigned to the order and will conduct a call to coordinate times and delivery of required products to the desired location with the vendor.

SAFETY REQUIREMENTS: Contractor is responsible for ensuring that all drivers and vehicles are insured, and that all drivers hold current licenses for operating the classification of vehicle utilized for accomplishing delivery.

EMERGENCY ORDERS: Emergency orders under this agreement require that the vendors be able to meet a 48-Hour lead time. Emergency Orders may only arise out of an unexpected loss of stored supplies, or an unexpected increase in utilization of consumables due to factors outside of the Governments control. Not as a result of failure to properly forecast supply needs. These orders will only be made for the required amount needed to ensure continued operations until a proper order can be made to restore operational inventories.

Due to the urgency and need for additional supplies these emergency orders may be placed without competition and will be made on a rotational basis between BPA holders. If a contractor is non-responsive or unable to meet the order, the next contractor in the rotation will receive the order.

DELIVERY: Upon completion of delivery of any goods, the BPA holder will notify the COR and provide them with a Delivery Ticket Receipt containing the following information:

(i) Name of Supplier

(ii) BPA Number

(iii) Date of Purchase

(iv) Purchase Number

(v) Itemized list of supplies furnished

(vi) Quantity, unit price, and extensions of each item, less applicable discounts

(vii) Date of Delivery or Shipment

If the Delivery Ticket Receipt is for partial fulfillment of an order, the ticket must also reflect the amount of the order, and the remaining total required to complete the order.

Period of Performance & Working Hours:

This BPA shall be in effect for a period not to exceed three years from the date of establishment, which is tentatively on or around the date of 9 September 2019. This agreement will be reviewed annually to determine whether or not this agreement is beneficial to the Government.

Deliveries requiring a Tractor Trailer must be conducted outside of normal business hours (Mon-Fri 7am – 5pm EST) unless coordinated with the COR before delivery.

2. Prior to the delivery under this agreement, approval to must be received from the COR in order to allow proper notification of the receiving facility.

Interference in The Performance of The Requirement:

The following provisions must be adhered to by contractor personnel throughout the duration of this agreement:

1. Contractor may be required to interrupt their work at any time so as not to interfere with the normal functioning of the facility; e.g. utility services, servicing of fire protection systems, and the passage of facility patients/personnel, etc.

2. In the event of an emergency, contractor services may be stopped and rescheduled at no additional cost to the government.

3. Contractor personnel must inform the COR of the need to gain access to secured areas. If access is required to secure areas, prearranged scheduling must be made by the COR.

Contractor Responsibilities:

1. The Contractor must be responsible for ensuring all personnel are properly licensed to operate a motor vehicle if operating a motor vehicle on NIH properties.

3.All deliveries shall be performed Monday through Friday before or after Administrative Hours (7:00 AM- 4:30 PM) unless coordinated with the COR.
