Occupational Medical Services Solicitation Number: 75N98019R00017 Amendment No. 1
1. Is this a new contract or an existing one?
Response: This is a re-compete of an existing contract.
2. If this is an existing one, what is the name of the current Contractor?
Response: The name of the current contractor is Concentric Methods.
3. Please provide the option year prices for the contract.
Response: All Offerors are to provide pricing information to the Government for this requirement based on their organization’s business strategy and current pricing.
4. Is the offeror required to submit resumes for each labor category and the number of positions?
Response: Offerors shall submit the resumes for key personnel. The Government reserves the right to request additional resumes. Offerors should review PWS, C.8.3.10 for FTE levels. In addition, please see the response to question 17. How these hours are best distributed among individual workers is to be proposed by Offerors. Requisite services shall be provided in timely fashion at the expected level of quality (see QASP).
5. Should the offeror use the pricing table located in Article B.2 for submission?
Response: Yes. Please use the pricing table in Article B.2 of the RFP.
6. In Article C.8 nursing assistants are noted, but nursing assistants are not listed for any locations listed. Please clarify if nursing assistants should be staffed Response: Nursing assistants are described to permit the Offeror the flexibility to deploy sufficiently qualified staff to aid the clinical staff expressly required with certain limited duties. There is no requirement for a CNA. The description serves to delineate the minimum qualification, should the Offeror choose to exercise this option, to ensure that staff detailed to such limited clinical duties is appropriately trained.
7. The RFP requires the Offeror to certify the adequacy of its accounting system in the Business Proposal according to Section L.2 Business Proposal Instruction. However, these instructions are not included. Can you please clarify this requirement?( Page 38, RFP L.1.c.3)
Response: The following language is added to the RFP via this amendment:
Adequate Accounting System
FAR Part 16 sets forth the requirements and limitations for consideration of contract type. As stated in Section L.1., General Instructions of this solicitation, the resultant contract will not be Firm-Fixed Price. Therefore, the offeror's/contractor's accounting system and practices must be adequate and suitable for accumulating costs under government contracts.
To be considered for an award under this solicitation, the offeror shall include, in the Business Proposal, the following Certification:
"By submission of its signed offer, the Offeror certifies that its accounting system:
· Complies with generally accepted accounting principles (GAAP).
· Provides for:
· Proper segregation of direct costs from indirect costs.
· Identification and accumulation of direct costs by contract.
· A logical and consistent method for the allocation of indirect costs to intermediate and final cost objectives.
· Accumulation of costs under general ledger control.
· A timekeeping system that identifies employees' labor by intermediate or final cost objectives.
· A labor distribution system that charges direct and indirect labor to the appropriate cost objectives.
· Interim (at least monthly) determination of costs charged to a contract through routine posting of books of account.
· Exclusion from costs charged to government contracts of amounts that are not allowable in terms of FAR 31, "Contract Cost Principles and Procedures," or other contract provisions.
· Identification of costs by contract line item and by units (as if each unit or line item were a separate contract) if required by the proposed contract.
· Segregation of preproduction costs from production costs, if applicable.
· Accounting system provides financial information:
· Required by contract clause concerning limitation of cost (FAR 52.232-20) or limitation on payments (FAR 52.216-16).
· Required to support requests for progress payments.
· Accounting system was designed, and records are maintained in such a manner that adequate, reliable data are developed for use in pricing follow-on acquisitions.
· Accounting system is currently in full operation.
The Contracting Officer reserves the right to request, with the Final Proposal Revision (FPR), a current (within 18 months) CPA opinion confirming that the Offeror's accounting system is compliant as certified above.
8. The labor hours chart includes a table for labor hours through Year 7; however, L.1.c.2 states that the term of the contract is 5 years. Can you please confirm which is correct? ( Page 39, RFP L.1.e.)
Response: The table is provided as an example. Offerors shall delete years 6 and 7.
9. This section includes the requirement that the technical proposal "must include direct cost and resources information, such as labor-hours and categories and applicable rates." What are considered "applicable rates" since the instructions also provide that the technical proposal should not include pricing data related to individual salary information, indirect cost rates or amounts, fee amounts (if any), and total costs?" (Page 40, RFP Section L.3)
Response: The Government is attaching the Technical Proposal Cost Summary (SF2043) with this modification. The completed form shall be included only with the Technical Proposal.
In addition, the Government is attaching the Breakdown of Estimate Cost Excel spreadsheet. The complete spreadsheet shall be included only with the Business Proposal.
10. This section includes the reference to "See Section J, Attachment entitled, TECHNICAL PROPOSAL COST SUMMARY"; however, there is no attachment in Section J for this. Will the government provide this attachment?( Page 40, RFP Section L.3)
Response: See response to question 9.
11. To demonstrate appropriate continuity of service, should the Offeror provide resumes for all staff members with the proposal submission? ( Page 45, RFP Section L.2.c.b.1)
Response: RFP, page 45: Resumes are only required for key personnel (see PWS, C.8.1 and C.8.2). The Offeror is expected to provide highlights of relevant experience and qualifications of non-key personnel, especially professional staff, as described in the first paragraph of RFP, Section L.2.c.1.b, top of p.45, and any aspects that would make them stand out beyond the minimum (PWS, C.8.3 and C.8.4.)
12. Please clarify the difference between the Qualifications of the Offeror section in the Business Proposal, and the experience and past performance sections in the Technical Proposal volume. Is it the Government's intent to include the same information in both volumes? ( Page 48, RFP Section L.2.c.5).
Response: There is some overlap, but the information for the Technical and Business Proposals differ in their emphasis. For “past performance” in the Technical Proposal refer to RFP, Sections L.2.a.10, p. 43, and M.1,p.51, and pp. 53-54, section entitled Past Performance. Personnel qualifications and experience are highly relevant to the Technical Proposal and as technical evaluation criteria (see RFP, Sections L.2.b.1.b, L.2.b.2., and M.3.2. and M.3.3, pp. 52-53).
13. Under Subcontractors section, item f indicates that "a complete cost proposal in the same format as the offeror's cost proposal" is required. Does this requirement for subcontractors include the requirements for Qualifications of Offeror or is this limited to providing the cost breakdown and associated narrative to support it? ( Page 49, RFP Section L.2.c.6.f)
Response: Subcontractors are only required to submit the cost breakdown and associated narrative to support it.
14. May subcontractors submit their cost proposals directly to the POC identified in the RFP? (Page 49, RFP Section L.2.c.6.f)
Response: The subcontractors must submit their business proposals through the Prime.
15. Is the required Annual Financial Report required for only the Prime contractor? (Page 49, RFP Section L.2.c.7)
Response: Yes.
16. Due to potential funding limitations and delays in Government payments, is a line of credit, upwards of $7 million, required to demonstrate the financial ability to maintain operations during these occurrences? (Page 49, RFP Section L.2.c.7)
Response: Yes.
17. In Article C.8 there is a list of personnel requirements for full-time equivalents (FTEs). Are offerors to use this list of FTEs as the sole basis of the staffing and pricing or is this provided as a minimum staffing level, allowing offerors to propose its own solution for staffing that will ensure full performance of all OMS requirements? (PWS Page 30, Article C.8)
Response: These are minimum FTEs required to provide adequate staffing levels during normal operating hours at each location except the 0.5 per diem physician (see also PWS, C.8.3.10). How these hours are best distributed among individual workers is the task for the Offerors to determine as long as requisite services can be provided in timely fashion at the expected level of quality (see QASP).
18. Can the Offeror propose an alternate staffing plan, which delineates associated managerial/staffing lead requirements for each program to ensure quality performance? (PWS Page 32, Articles C.8 and C.8.3)
Response: See answer to question 17.
19. Did the Government only intend for these to establish minimum education and experience requirements? (PWS Page 32, Articles C.8.3)
Response: Yes.
20. Is the transition phase-in plan required to be submitted with the proposal or following contract award? (PWS Page 43, Article C.12)
Response: Yes. Note the following correction to the PWS: The Transition Plan is ARTICLE C.12 Transition Plan (Phase-In and -Out of the Contract) and not ARTICLE C.11.
21. The packaging and delivery of proposals documents states that only one copy of technical/business proposal is required and provides two addresses. Is this to be a hard copy or an electronic copy submission? (Packaging and delivery of proposals)
Response: Only submit an electronic copy of the business and technical proposals.
Other Change to the RFP:
Page 20 under ARTICLE H.8. AWARD TERM
2. Award Term Provisions
1. This contract has a base performance period of 12 months. The Contractor will have the opportunity to earn 4 additional 12-month Option years of work as described under Section B., Article B.3. using the evaluation process described herein. These additional years of work are called Award Terms. The total duration of this contract, including all Award Terms, shall not exceed a period of 5 years from J. (Delete text “from J)
2. Quality Assurance Surveillance Plan (QASP)
1. The "Contractor Assessment Report/Performance Indicators and Standards" will be prepared by the Government, resulting in an overall rating which will be disseminated to the Contractor annually. The Award Term earned will be determined based upon review of the Contractor's performance against the performance indicators and standards in the QASP to this RFP.
(Only the section below is deleted from RFP – follow the QASP) [ Using the 0-5 point score in the Plan, the Contractor must receive an average of 3.5 or betterfor the first three years of Contractor performance. In years four and five, the Contractor mustreceive an average of 3.8 or better in each year to earn the Award Term.] These goals areintended to be a stretch for the Contractor, but achievable.
[ At the conclusion of year four, in addition to the year four "Contractor Assessment Report/Performance Indicators and Standards," the Government will prepare a summary report whichwill set forth the average rating for the first three years' of performance and the year four rating. This summary report will be used to determine if the Award Term for year six has been earned.Likewise, at the conclusion of year five, the Government will prepare a "Contractor AssessmentReport/Performance Indicators and Standards"and a summary report of year five to determine ifthe Award Term for year seven has been earned.]The advance evaluation of performance is required to allow adequate time for recompetitionof the requirement in the event that Contractor performance does not meet the Award Termrequirements. If the Contractor does not earn the first Award Term, there will be no opportunityto earn subsequent Award Term(s) and the contract expiration date will remain unchanged.
