About this file
This document is a Notice of Intent to award a sole source contract for preventative maintenance and service on a Leica confocal microscope Stellaris 8 system. The National Institute of Neurological Disorders and Stroke (NINDS) intends to award a firm-fixed price contract with option years to Leica Microsystems Inc., the original equipment manufacturer, to provide maintenance services for the government-owned microscope. The microscope is a critical piece of equipment used in NINDS research, and the sole source justification is that Leica Microsystems is the only authorized provider capable of maintaining the proprietary system. The contract will have a base year from 9/6/2024 to 9/5/2025 with four one-year option periods. The place of performance is at the NIH facility in Bethesda, Maryland. Interested parties may submit capability statements by the response date of 7/29/2024 to the Contracting Specialist, but this is not a request for competitive proposals.

NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET
ASIDE STATUS
The intended procurement is classified under NAICS code 811310 with a Size Standard of $8M.
This acquisition is NOT set aside for small businesses, but rather is a sole-source acquisition to Leica Microsystems Inc.
REGULATORY AUTHORITY
This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1 (b) Soliciting from a single source.
BACKGROUND, PURPOSE AND OBJECTIVES OF REQUIREMENT
The National Institutes of Health (NIH) is the nation’s leading medical research agency and the primary Federal agency whose mission is to seek fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life, and reduce illness and disability, conducting, supporting and making medical discoveries that improve people’s health and save lives.
The National Institute of Neurological Disorders and Stroke (NINDS) mission is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease. With this Leica confocal microscope stellaris 8, we can take high resolution images from both fixed samples and living cultures. These high-resolution images will provide us many critical information, such as where the protein locate in the tissue, how proteins are interacting with each other, et.al. This confocal microscope, which is purchased in 2021, is a critical component in the carrying out collaborations within the NINDS. It is one of the most often used instrument, a service agreement allows for quick repair if needed and regular maintenance work to ensure continued use of the equipment for scientific experiments.
The Leica Stellaris 8 Confocal microscopy system provides state of the art imaging capabilities that are required for the investigations ongoing in the NINDS Molecular Neurobiology Section, Ngai laboratory. The system requires routine preventative maintenance. This contract will ensure minimal downtime due to hardware and/or software malfunction. Additionally, the contract is required in order to maintain the study of adult stem cell-mediated regeneration, because it retains the ability to generate new neurons throughout the lifespan of the animal, including single-cell transcriptomic and epigenomic analyses, mouse genetics, viral transduction, immunohistochemistry, multiplexed RNA in situ hybridization, primary tissue culture, and confocal microscopy, to predict and test determinants of neural regeneration from a variety of angles. the equipment must be in operable condition and prevent costly repairs.
CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION
(INCLUDING BRAND-NAME) DETERMINATION
Leica Microsystems Inc., as the authorized partner of Leica Confocal Microscopy Stellaris 8 System, is the only contractor authorized and capable of providing the necessary maintenance support service to the Leica Confocal Microscopy Stellaris 8
System because the equipment is proprietary. Leica Microsystems Inc is the only source for factory trained and certified technicians to maintain and service the equipment.
The equipment requiring maintenance is continually used for research purposes. The microscopy system with incorrect parts, or other unsupported service provided by a non-authorized vendor, would void data standardization and cause irreparably damage to NIH research data. Furthermore, use of any other contractor for maintenance would void equipment warranties and jeopardize system integrity and functionality.
Only an OEM-authorized service provider has access to the latest services and support information. Replacement parts or accessories must be compatible with the existing equipment, and only Leica Microsystems Inc. can certify compatibility. An OEM-authorized service provider is the only source with direct access to these parts and labor.
Leica Microsystems Inc is the only source authorized by the OEM to provide maintenance services for this equipment. Because of the significant investment by NINDS in the purchase of this equipment, using an OEM-Authorized Service Provider is essential for maintaining the integrity of the system.
In accordance with FAR part 10, extensive market research was conducted to reach this determination. Specifically, contact with knowledgeable individuals both in industry and Government, as well as reviews of available product literature, revealed no other sources. A review of the GSA Advantage, Dynamic Small Business Search, and previous Government acquisitions returned no results that meet all requirements. A letter from the OEM confirmed that Leica Microsystems Inc. is the only OEM-authorized service provider for this equipment. Therefore, only Leica Microsystems Inc., is found to be capable of meeting the needs of this requirement.
The intended source is:
Leica Microsystems Inc 10 Parkway North, Suite 300 Deerfield, IL 60015
