About this file

This is a Questions & Answers document for RFQ 75H71325Q00011 for Behavioral Health Nonpersonal Services at the Western Oregon Service Unit (Chemawa Indian Health Center). The document addresses two key questions: 1) clarification on wage determination requirements, where the response indicates contractors must follow the SCA conformance process for proposing job titles and wage rates within 30 days of employment beginning, and 2) confirmation that professional liability insurance meeting the $1,000,000 per specialty per occurrence requirement is sufficient to satisfy the medical liability insurance requirement for both prime and subcontractors under PWS Section 1.3.3.

The related solicitation is a small business set-aside specifically for Indian Small Business Economic Enterprise (ISBEE) with a NAICS code of 621112 and size standard of $13.5 million. The period of performance includes a one-year base period plus four one-year options, with work to begin within 30 days of award. Quotes are due January 23, 2024 at 5:00 PM PST, with evaluation factors including price, demonstrated prior experience, and past performance.

ATTACHMENT 6 – QA 1 RFQ 75H71325Q00011

QUESTION 1: Will the positions be subject to Wage Determination (WD), or will we have the flexibility to propose candidates outside the scope of WD, provided we offer full benefits and salaries exceeding WD requirements? Additionally, if the government opts to classify these positions under WD, which specific labor category under the WD is being recommended?

ANSWER 1: The SCA conformance process is a method by which a contractor may propose job titles and wage rates to legally employ workers engaged in work on a contract in occupations that are not listed in the applicable SCA wage determination. The contractor must forward the conformance request to the contracting agency no later than 30 days after employment of workers has begun in the occupation to be conformed.

Please see the following link for more a more detailed explanation of the SCA Conformance Process: https://www.dol.gov/agencies/whd/government-contracts/prevailing-wage-resource-book/sca-conformance-process

QUESTION 2: In reference to [Performance Work Statement] Section 1.3.3, to clarify, both the prime and any subcontractors must have medical liability insurance for protection against malpractice. Is professional liability insurance that demonstrates the intended contract positions are included, sufficient to meet the liability requirements?

ANSWER 2: Yes, the prime contractor is responsible to provide evidence of and maintain insurance in accordance with paragraph (a) of Clause 52.237-7. The Contractor shall maintain during the term of this contract liability insurance issued by a responsible insurance carrier of not less than the following amount(s) per specialty per occurrence: $1,000,000.
