About this file
This is a Request for Quotation (RFQ) combined synopsis/solicitation for remote outpatient and inpatient medical coding and limited data entry services to support Navajo Area Indian Health Service (NAIHS) Health Information Operations. The solicitation number is 75H71026Q00276, issued by the Navajo Area Office, with quotes due by September 15, 2026 at 2:00 PM MDT via electronic mail. This is a 100% Indian-owned Small Business Economic Enterprise (ISBEE) set-aside pursuant to the Buy Indian Act, with NAICS code 561410 (Document Preparation Services) and a small business standard of $19 million.
The Government intends to establish multiple-award Blanket Purchase Agreements (BPAs) with a maximum value of $2 million per BPA over five years. The acquisition covers four coding categories: Outpatient Low (Simple), Outpatient Moderate, Outpatient Complex, and Inpatient encounters. Quoters must submit four separate volumes: Volume I (Administrative), Volume II (Technical Capability – Pass/Fail evaluation addressing organizational coding capability, RPMS/IHS system experience, sample coder resumes, quality control systems, security/HSPD-12 compliance, and workload management), Volume III (Past Performance with 2-5 organizational references), and Volume IV (Pricing). Evaluation criteria prioritize technical acceptability, past performance confidence rating, and price under a Lowest Price Technically Acceptable (LPTA) approach. Qualified coders must hold current AHIMA or AAPC certification (CCS, CCS-P, CPC, CPC-P, COC, CIC, or CPC-H) with minimum two years of recent relevant experience. BPA calls will identify applicable service units, encounter types, coding periods, and estimated encounter volumes, with per-encounter rates remaining firm across all five NAIHS Service Units. The contract period runs November 1, 2026 through October 31, 2031, with option periods exercisable at Government discretion based on continuing need, available funds, and satisfactory performance.

(DEVIATION)
(a) Submission of Quotes
Submit signed and dated quotes to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotes shall be submitted electronically to [insert email address or submission portal] by the method specified in the solicitation. Late quotes will be handled in accordance with paragraph (c) of this provision.
Only one quote per Quoter will be accepted. Quoters wishing to revise a submitted quote must withdraw the original quote and resubmit in accordance with paragraph (c) of this provision before the quote due date.
The clause at FAR 52.202-1, Definitions, is incorporated by reference and applies to this solicitation and any resulting Blanket Purchase Agreement (BPA).
Quotes shall be organized into four (4) separate volumes as described below. Each volume shall be clearly labeled with the solicitation number, Quoter name, and volume number and title. All four volumes shall be submitted together as a complete package.
Volume I — Administrative
No page limit. No pricing information permitted in this volume.
Volume I shall contain all administrative and certification documents required for a complete quote. At a minimum, Volume I shall include:
SF-1449 or Signed Letterhead Quote. A signed and dated Standard Form 1449, or a signed quote on company letterhead, acknowledging agreement with all terms and conditions of the solicitation. The SF-1449 or letterhead quote shall identify the solicitation number, Quoter name and address, Unique Entity Identifier (UEI), and Electronic Funds Transfer (EFT) indicator as applicable.
Solicitation Amendments. Signed acknowledgment of all solicitation amendments issued prior to the quote due date. Failure to acknowledge all amendments may render the quote ineligible for consideration.
Representations and Certifications. Completed representations and certifications required by this solicitation that are not collected via the System for Award Management (SAM). Quoters are responsible for ensuring their SAM registration is current and accurate at the time of quote submission and throughout the BPA period.
Quoter Point of Contact. Name, title, telephone number, and email address of the individual authorized to respond to questions regarding this quote.
Designated BPA Point of Contact. Name, title, telephone number, and email address of the individual who will serve as the Contractor's primary point of contact for all BPA and call order operations, consistent with PWS Section 6.2. If an alternate point of contact is proposed, identify the alternate and the circumstances under which the alternate serves as primary. Both the primary and alternate designees must be available by telephone and email during normal business hours, Monday through Friday, excluding federal holidays.
Volume II — Technical Capability
Page limit: 20 pages. Standard 8.5" x 11", minimum 11-point font, 1-inch margins. Tables and charts count toward the page limit. Sample coder resumes submitted as appendices do not count toward the page limit.
⚠ Pricing information shall not be included anywhere in Volume II. A quote containing pricing in this volume may be found technically unacceptable.
Volume II shall address the Quoter's organizational capability to perform all requirements of the PWS. The Government will evaluate Volume II on a Pass/Fail basis in accordance with RFQ 52.212-2. The focus of this volume is the Quoter's organizational infrastructure, coding workforce capacity, quality control systems, and remote performance capability — not the qualifications of individual coders in isolation. Volume II shall be organized to address each of the following elements:
Element 1 — Organizational Coding Capability and Experience
Describe the Quoter's organizational experience providing remote medical coding services for outpatient, ambulatory, and inpatient encounters. The description shall address:
• The types of encounters coded (outpatient/ambulatory, emergency department, inpatient, ancillary);
• The coding classification systems used in prior performance, including ICD-10-CM, ICD-10-PCS, CPT, HCPCS Level II, DSM, and CDT, as applicable;
• The nature of the healthcare organizations served, including any experience with IHS facilities, Tribal health programs, federally operated health centers, or comparable rural and remote healthcare settings;
• The Quoter's organizational capacity to manage concurrent call orders across multiple Service Units and to absorb workload surges and coding backlogs without disruption to ongoing performance; and
• The Quoter's familiarity with ORAP Third Party Revenue requirements, IHS HIM coding policies, or comparable federal health program coding requirements.
Quoters that submit individual coder experience in lieu of organizational experience will not satisfy this element.
Element 2 — RPMS and IHS System Experience
Describe the Quoter's organizational experience using the Resource and Patient Management System (RPMS), IHS Electronic Health Record (EHR), Patient Care Component (PCC), or a comparable federal or tribal healthcare electronic health record system. The description shall address:
• Specific systems used in prior performance and the nature of the work performed in those systems;
• The Quoter's approach to onboarding coders who have not previously used RPMS, including how the
Quoter will ensure coders are proficient within the Government-provided orientation timeframe before performing independent coding; and
• The Quoter's process for ensuring coders comply with IHS IT security policies and remote access requirements, including secure connection protocols and prohibition on storing Government data on non- Government systems, consistent with PWS Sections 6.4 and 8.0.
Quoters without prior RPMS experience shall describe their experience with comparable federal or tribal health IT systems and their approach to RPMS onboarding. Lack of prior RPMS experience will not automatically result in a rating of Unacceptable under this element, provided the Quoter presents a credible onboarding plan.
Element 3 — Sample Coder Resumes — Pipeline Demonstration
To demonstrate the caliber and current availability of its coding workforce, the Quoter shall provide resumes for a minimum of two (2) and a maximum of five (5) sample coders currently available for placement under call orders issued against the resulting BPA.
Important: Sample resumes are submitted as organizational pipeline evidence only. Submission of a resume does not constitute a commitment to assign that individual to any specific call order, and the Government will not select, approve, or designate named coders for specific call orders at the quote stage. Post-award assignment of all coders performing services under the BPA is governed by the personnel requirements of PWS Section 5.0 and the call order commencement requirements of PWS Section 1.3.1.
Each sample resume shall demonstrate that the individual meets all of the following minimum qualifications consistent with PWS Sections 5.1 and 5.2:
• Current, active certification through AHIMA and/or AAPC appropriate to the encounter types the coder will perform, including one or more of the following: CCS, CCS-P, CPC, CPC-P, COC (outpatient/ambulatory); CIC, CPC-H (inpatient);
• A minimum of two (2) years of recent medical coding experience relevant to the encounter types the coder will perform under this BPA;
• Demonstrated experience using RPMS, IHS EHR, PCC, or a comparable federal or tribal healthcare electronic health record system, or a clear statement that the coder will require RPMS orientation prior to independent performance; and
• No history of adverse certification action, exclusion from Federal health care programs, or unfavorable background investigation adjudication.
Each resume shall clearly identify the coder's current certification, certification expiration date, years of coding experience, encounter types coded, and systems used. Resumes shall be provided as an appendix to Volume II and do not count toward the page limit.
Element 4 — Quality Control and Accuracy Management
Describe the Quoter's organizational quality control system for ensuring coding accuracy, certification compliance, and sustained performance at or above the 95% accuracy AQL established in PWS Section 9.0. The description shall address:
• The Quoter's internal coding audit process, including audit frequency, sample size methodology, error categorization approach, and the process for identifying, documenting, and correcting coding errors;
• How the Quoter monitors coder certification currency across its coding workforce, including the system or platform used to track expiration dates and the Quoter's process for ensuring no coder with a lapsed certification performs services under this BPA;
• The documented process when a coder's certification lapses, is suspended, or is subject to adverse action — including the timeline for CO notification within 24 hours and the Quoter's replacement or coverage approach consistent with PWS Section 5.1; and
• Any technology platforms, coding management systems, or audit tools used to maintain real-time visibility into coding accuracy and workforce compliance status.
The Quoter shall commit to submitting a complete Quality Control Plan (QCP) within 15 calendar days of BPA establishment, addressing all minimum requirements set forth in PWS Section 3.2.
Element 5 — Security, HSPD-12, and Remote Access Compliance
Describe the Quoter's organizational capability to meet all security, background investigation, and remote access requirements for performing medical coding services using Government information systems. The description shall address:
• The Quoter's experience initiating and managing the HSPD-12 security clearance process for its coders, including the Quoter's approach to accounting for the 14-to-30-calendar-day processing window before coders may be granted system access, consistent with PWS Section 5.3;
• The Quoter's process for ensuring all coders complete required IHS IT security and privacy training before system access is granted, consistent with PWS Section 5.5;
• The Quoter's controls for ensuring Government data — including PHI and PII accessed through RPMS and IHS EHR — is not stored, copied, or retained on non-Government systems or personal devices, consistent with PWS Sections 6.4 and 8.0; and
• The Quoter's incident response process for reporting actual or suspected data breaches to the CO and COR within one hour of discovery, and for purging Government data from Contractor systems within two business days of call order completion, consistent with PWS Section 8.0.
Element 6 — Workload Management, Surge Capacity, and Continuity
Describe the Quoter's approach to managing as-needed call orders across all NAIHS Service Units, including workload surges and concurrent call orders. The description shall address:
• How the Quoter will maintain a sufficient pool of pre-credentialed, HSPD-12-cleared coders available to commence performance within the call order commencement timeframe established in PWS Section 1.3.1;
• The Quoter's internal methodology for distributing call order work among its coders, managing competing priorities, and resolving internal capacity constraints without Government involvement;
• The Quoter's contingency approach when a coder becomes unavailable during an active call order — including how the Quoter will ensure continuity of coding performance and protect against backlog accumulation; and
• The Quoter's approach to deficiency management and weekly deficiency reporting across multiple concurrent call orders and Service Units, consistent with PWS Sections 2.4 and 4.0.
Volume III — Past Performance
No page limit for reference submissions. Standard format required per the table below.
⚠ Pricing information shall not be included anywhere in Volume III. Do not include contract values or per-encounter rates in this volume.
Volume III shall contain past performance information for a minimum of two (2) and a maximum of five (5) contracts or agreements performed within the three (3) years preceding the date of this solicitation that are recent and relevant to the services described in the PWS. The Government will evaluate Volume III in accordance with the past performance confidence rating scale set forth in RFQ 52.212-2.
Organizational references required. References must reflect the organizational performance of the Quoter — the company or entity submitting the quote. References describing the performance of individual coders, subcontractors, or other personnel will not be considered and do not satisfy this requirement.
CPARS. The Government will access and consider Contractor Performance Assessment Reporting System (CPARS) reports for any prior Government contracts performed by the Quoter. Quoters are advised that CPARS reports and other Government records may be used to supplement, verify, or contradict information submitted in Volume III.
Past Performance Questionnaires (PPQs). For each reference submitted, the Quoter shall request that the reference complete RFQ No. 75H71026Q0187 Attachment D - Past Performance Questionnaire (PPQ) using the form provided in this solicitation. Completed PPQs shall be submitted directly by the reference to the Contracting Officer at Jericho.Lewis@ihs.gov no later than the quote due date. PPQs submitted by the Quoter on behalf of a reference will not be accepted. The Government will not follow up with references to obtain PPQs not received by the due date; it is the Quoter's responsibility to ensure timely submission. A minimum of two (2) – but no more than five (5) – completed PPQs submitted directly by references are required. Quoters who fail to obtain the required number of PPQs may receive a reduced confidence rating reflecting the limited information available.
For each reference, the Quoter shall provide the following information in Volume III:
Element Required Information Contract/Agreement Number Full contract, BPA, or agreement number
Contracting Agency / Customer Full name of the agency, facility, or organization

The same per-encounter rates apply uniformly across all NAIHS Service Units. Quoters shall not propose different rates for different Service Units.
2. Total Evaluated Price
The Quoter shall provide a summary total evaluated price using the Government's encounter volume estimate table provided in the solicitation, calculated as the sum of each proposed per-encounter rate multiplied by the Government's estimated annual encounter volume for that coding category, across all five years and all Service Units. This figure will be used for price comparison purposes only. The Government does not guarantee any minimum encounter volume under any BPA established as a result of this solicitation.
3. Price Acknowledgment
A statement that proposed per-encounter rates are firm and will remain in effect for the period specified in paragraph
(b) of this provision.
The Government will evaluate price for fairness and reasonableness through price competition consistent with FAR Part 12 simplified commercial services procedures. Cost analysis and cost realism analysis will not be conducted.
(b) Period for Acceptance of Quotes
The Quoter agrees to hold the prices in its quote firm for [insert] calendar days from the date specified for receipt of quotes.
(c) Late Submissions, Modifications, Revisions, and Withdrawals of Quotes
• Quoters are responsible for submitting quotes and any modifications or revisions to the Government office designated in this solicitation by the time specified.
• Any quote, modification, or revision received after the time specified for receipt of quotes is "late" and will not be considered unless it is received before BPA establishment and the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition. However, a late modification of an otherwise successful quote that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
• If an emergency or unanticipated event interrupts normal Government processes so that quotes cannot be received by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotes will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
• Quoters may withdraw their quotes by written notice to the Government received at any time before BPA establishment.
(d) BPA Establishment
The Government intends to evaluate quotes and establish BPAs without discussions. Therefore, the Quoter's initial quote should contain the Quoter's best terms from a price and technical standpoint. However, the Government reserves the right to conduct clarifications consistent with FAR 12.201-1 if necessary. The Government may reject any or all quotes if such action is in the public interest, and may waive informalities and minor irregularities in quotes received.
Establishment of a BPA does not obligate the Government to place any call orders or guarantee any minimum volume of work to any BPA holder. Call orders will be placed at the discretion of the Contracting Officer consistent with the ordering procedures described in PWS Section 6.5.
(e) Debriefings
If a post-establishment debriefing is given to requesting Quoters, the Government will disclose the following information, if applicable:
• The agency's evaluation of the significant weak or deficient factors in the debriefed Quoter's quote;
• The overall evaluated price and technical acceptability rating of the successful Quoters and the debriefed
Quoter, and past performance information on the debriefed Quoter;
• The overall ranking of all Quoters, when any ranking was developed by the agency during source selection;
• A summary of the rationale for the BPA establishment decision; and
• Reasonable responses to relevant questions posed by the debriefed Quoter as to whether the agency followed source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities.

NOV 2025
(DEVIATION)
(a) Evaluation Factors
The Government will establish multiple Blanket Purchase Agreements (BPAs) resulting from this solicitation with responsible Quoters whose quotes conforming to the solicitation are most advantageous to the Government using a Lowest Price Technically Acceptable (LPTA) source selection process. Quotes will be evaluated against the following factors in the order listed:
• Factor 1 — Technical Acceptability (Pass/Fail)
• Factor 2 — Past Performance (Confidence Rating)
• Factor 3 — Price
BPAs will be established with all Quoters whose quotes are rated Acceptable under Factor 1 and receive a past performance confidence rating of Satisfactory Confidence, Substantial Confidence, or Neutral/Unknown under Factor 2, subject to the availability of funds and the Government's determination that establishing multiple BPAs is in the Government's interest. Price will not be traded off against technical or past performance factors. A quote rated Unacceptable under Factor 1, or receiving an Unsatisfactory Confidence rating under Factor 2, will not be considered for BPA establishment regardless of price.
Quoters should refer to the Instructions to Quoters at provision 52.212-1 for the specific content, format, volume organization, and submission requirements applicable to each factor.
Factor 1 — Technical Acceptability (Pass/Fail)
Technical acceptability is a pass/fail determination. The Government will evaluate the content of Volume II submitted in accordance with 52.212-1 against the following standards. A quote must satisfy all standards to be rated Acceptable. A quote that fails any standard will be rated Unacceptable and will not be considered for BPA establishment regardless of price.
Standard Description
1.1 — Organizational Coding Capability
The Quoter demonstrates organizational capability to provide certified medical coders experienced in outpatient, ambulatory, and inpatient coding using ICD-10-CM, ICD-10- PCS, CPT, HCPCS, DSM, and CDT, as applicable, and to manage fluctuating workloads and coding backlogs across multiple Service Units on an as-needed basis.
1.2 — RPMS and IHS System Experience
The Quoter demonstrates organizational experience using RPMS, IHS EHR, PCC, or a comparable federal or tribal healthcare electronic health record system, or a credible plan for onboarding coders to RPMS within the Government-provided orientation timeframe.
1.3 — Coder Qualifications — Pipeline Demonstration
The Quoter provides resumes for a minimum of two (2) sample coders currently available for placement, each demonstrating current AHIMA or AAPC certification appropriate to the encounter types they will code, and a minimum of two (2) years of recent relevant coding experience consistent with PWS Section 5.1 and 5.2.
1.4 — Quality Control and Accuracy Management
The Quoter demonstrates an organizational quality control system capable of achieving and sustaining a 95% coding accuracy rate, including internal audit processes, error correction procedures, and monitoring of coder certification currency consistent with PWS Section 3.2.
Standard Description
1.5 — Security and HSPD-12 Compliance Capability
The Quoter demonstrates organizational capability to initiate and complete HSPD-12 background investigations for all coders before system access is granted, and to comply with all IHS IT security, HIPAA, and Privacy Act requirements for remote access to Government systems, consistent with PWS Sections 5.3 and 8.0.
Factor 2 — Past Performance (Confidence Rating)
The Government will evaluate the Quoter's past performance record submitted in Volume III in accordance with 52.212-1 to assess the likelihood of successful performance under the resulting BPAs. References must be recent (within three years of the solicitation date) and relevant (medical coding services for outpatient, ambulatory, or inpatient encounters at a hospital, health center, IHS facility, Tribal health program, or comparable healthcare organization).
The Government will access and consider Contractor Performance Assessment Reporting System (CPARS) records for any prior Government contracts performed by the Quoter. CPARS records and other Government sources may be used to supplement, verify, or contradict information submitted in Volume III.
Past performance will be rated using the following confidence scale:
Rating Definition
Substantial Confidence
The Quoter's recent and relevant performance record provides high confidence of successful performance, including demonstrated coding accuracy at or above 95% and strong fill rate and timeliness performance.
Satisfactory Confidence
The Quoter's recent and relevant performance record provides reasonable confidence of successful performance.
Neutral/Unknown No recent or relevant past performance record exists, or the record is insufficient for a meaningful assessment. Treated as neither favorable nor unfavorable. Eligible for BPA establishment.
Limited Confidence The Quoter's recent and relevant performance record provides low confidence of successful performance.
Unsatisfactory Confidence
The Quoter's recent and relevant performance record provides very low confidence of successful performance. Not eligible for BPA establishment.
Quoters with no recent or relevant past performance shall submit a statement to that effect in Volume III and will receive a rating of Neutral/Unknown.
Factor 3 — Price
Price will be evaluated for reasonableness across all encounter types identified in the BPA pricing schedule. The Government will evaluate the Quoter's proposed per-encounter rates for each coding category — outpatient/ambulatory and inpatient — for the base year and all renewal years.
Price will be evaluated through price competition among technically acceptable Quoters. The hourly rate breakdown submitted in Volume IV will be used solely to assess price reasonableness. Cost analysis and cost realism analysis will not be conducted.
BPAs will be established with all technically acceptable Quoters whose prices are determined fair and reasonable.
At the call order level, the Government will obtain competition among BPA holders consistent with FAR 13.303-5 and will place call orders with the BPA holder offering the best value for the specific call order requirement, considering price and any other factors identified in the call order.
(b) Multiple Awards
The Government intends to establish BPAs with multiple Quoters determined to be technically acceptable under Factor 1 and receiving an acceptable past performance confidence rating under Factor 2. The Government reserves the right to establish a BPA with any number of Quoters, including only one, if the Government determines that establishing multiple BPAs is not in the Government's interest or if an insufficient number of Quoters are determined technically acceptable.
(c) Options / Renewal Periods
The Government will evaluate quotes for BPA establishment purposes by considering the proposed per-encounter rates for the base year and all annual renewal periods. The evaluation of renewal periods does not obligate the Government to renew any BPA. The Government may determine that a quote is unacceptable if renewal period rates are found to be significantly unbalanced relative to the base year.
(d) Notice of BPA Establishment
A written notice of BPA establishment furnished to a Quoter within the time for acceptance specified in the quote shall result in an established BPA without further action by either party. The establishment of a BPA does not obligate the Government to place any call orders or guarantee any minimum volume of work.

NOV 2025
(DEVIATION)
(a) Definitions. As used in this clause—
Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
Subsidiary means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
(b) Government agencies are not permitted to use appropriated (or otherwise made available) funds for contracts with either an inverted domestic corporation, or a subsidiary of an inverted domestic corporation, unless the exception at 9.108-3(b) applies or the requirement is waived in accordance with the procedures at 9.108-5.
(c) Representation. The Offeror represents that-
(1) It □ is, □ is not an inverted domestic corporation; and
(2) It □ is, □ is not a subsidiary of an inverted domestic corporation.

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY
MATTERS
NOV 2025
(DEVIATION)
(a)(1) The Offeror certifies, to the best of its knowledge and belief, that—
(i) The Offeror and/or any of its Principals—
(A) Are □ are not □ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have □ have not □, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);
(C) Are □ are not □ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision; and
(D) Have □, have not □, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied. Federal taxes are considered delinquent if both of the following criteria apply:
(1) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if a pending administrative or judicial challenge remains. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(2) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) The Offeror has □ has not □, within a 3-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) "Principal," for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the Government will consider the certification in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) This provision does not require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a). The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If the Government later determines that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
